Entity & authority

Italian Data Protection Authority (Garante) levied a €31.8 million fine against an Italian Financial Institution

What happened

An employee executed 6,600 unauthorised database queries over 26 months. Internal security controls existed in policy, yet failed to detect the anomalous query volume in practice. The institution subsequently delayed regulatory and data subject notifications until compelled by the regulator.

Why it matters

It establishes regulatory zero-tolerance for passive audit logs that lack active, configured anomaly detection thresholds.

EU sustainability rules reset under Omnibus I

The EU has now formally scaled back its sustainability reporting and due-diligence regime. For businesses, the key issue is checking whether the company remains in scope and whether existing compliance workstreams need to be redesigned.
  • The CSRD is narrowed to companies with more than 1,000 employees and more than €450 million net annual turnover, with separate revised thresholds for certain third-country groups.
  • The CSDDD / CS3D is narrowed to companies with more than 5,000 employees and more than €1.5 billion net turnover, with a more targeted due-diligence model and reduced trickle-down pressure on smaller business partners.
  • The package also removes the obligation to adopt a climate transition plan under the CSDDD, postpones the CS3D transposition deadline to 26 July 2028, and the Commission plans to adopt revised ESRS in Q2 2026 / before summer 2026.

About Us

The European Company Lawyers Association (ECLA) is the umbrella organisation for 25 company lawyer associations in Europe and represents the common interests of European company lawyers. During the past 40+ years, ECLA has established itself as the leading representative of European company lawyers' associations.

The Company Lawyer

Ensuring the legality of operations is the first step in corporate stability. Bringing this function in-house creates a necessary synergy between legal expertise and business strategy. Because in-house counsel understands the specific mechanics of the organisation, they ensure that commercial objectives are met with security and precision - often making the difference between a company that survives and one that thrives.

Mission

As the operational realities of in-house teams become increasingly standardised across Europe, co-operation becomes essential. ECLA serves as the vital link between national associations, recognising that our members often face identical challenges regardless of their jurisdiction. By fostering a pan-European network, we enable the exchange of high-level expertise and best practices, ensuring that the profession advances as a collective force.
