These Terms & Conditions govern the use of services provided by Hostishere.com, including VPS hosting, dedicated servers, IP allocations, networking, infrastructure services, and all related products and services. By registering an account, ordering services, or accessing our infrastructure, you agree to these Terms in full.

By placing an order through our website or client area, you submit a legally binding request for service.
A contract is formed once payment has been received and the requested service has been provisioned or activated by Hostishere.
We reserve the right to reject, delay, manually review, or cancel any order for fraud prevention, technical limitations, compliance reasons, or risk assessment purposes.
Customers must provide accurate, complete, and up-to-date registration information.
Fake identities, inaccurate billing information, temporary email services, identity masking, or fraudulent registrations may result in immediate suspension or termination.
We reserve the right to request identity verification, billing verification, proof of address, or additional information at any time.
Failure to cooperate with verification requests may result in suspension, termination, or refusal of service.
Hostishere provides virtual private servers (VPS), dedicated servers, networking resources, IP allocations, and related infrastructure services.
Provisioning is usually automated but may require manual review, fraud checks, inventory checks, or infrastructure availability validation.
Specific hardware models, processors, storage devices, routing paths, or IP addresses are not guaranteed unless explicitly agreed otherwise.
Equivalent hardware replacements, alternative routing, or infrastructure migrations may occur when technically necessary.
All services are billed in advance unless otherwise stated.
Failure to pay invoices on time may result in suspension, late fees, service limitation, termination, or permanent deletion of services and associated data.
Prices may change at any time with reasonable notice. Price changes do not affect already paid billing periods.
Taxes, VAT, or local regulatory charges may apply depending on jurisdiction.
Refunds, withdrawal rights, chargebacks, and cancellation policies are governed exclusively by our Refund Policy.
By ordering instantly provisioned digital services, customers acknowledge that refund eligibility may become limited once provisioning has started.
Cryptocurrency transactions are generally irreversible.
Payments made using cryptocurrency are therefore generally non-refundable, unless required otherwise by applicable law.
Customers are responsible for ensuring that payments are sent to the correct wallet address and network.
Customers may not use our infrastructure for illegal, harmful, abusive, or disruptive activities.
Prohibited activities include but are not limited to:
• DDoS attacks or amplification attacks
• Malware hosting or distribution
• Phishing or fraud operations
• Spam or unsolicited bulk messaging
• Unauthorized access attempts
• Botnets or scanning activity
• Cryptocurrency mining abuse
• Copyright infringement
• Hosting illegal content
• Child exploitation material
• Terrorist or extremist content
• Network abuse or infrastructure attacks
We maintain a strict zero-tolerance abuse policy.
To protect infrastructure stability, network integrity, other customers, upstream providers, and third parties, we may take immediate technical measures without prior notice.
Measures may include:
• Service suspension
• Traffic filtering
• Rate limiting
• IP blocking
• Blackholing / null-routing
• Bandwidth limitation
• Service termination
Abuse investigations may involve cooperation with datacenters, network providers, payment processors, and law enforcement authorities where legally required.
All services are subject to fair and reasonable infrastructure usage.
Excessive CPU usage, memory exhaustion, disk abuse, network flooding, or activities negatively affecting infrastructure stability may result in temporary limitation or suspension.
We reserve the right to protect infrastructure stability even if no intentional abuse exists.
While we aim for high availability, 100% uptime cannot be guaranteed.
Interruptions may occur due to maintenance, security incidents, hardware failures, routing issues, power outages, upstream provider problems, or force majeure events.
Scheduled maintenance may occur without prior notice in urgent situations.
Dedicated server hardware may require maintenance, replacement, migration, or emergency intervention.
Hardware failures, storage corruption, network interruptions, or infrastructure outages may occur unexpectedly.
Equivalent replacement hardware, alternative routing, or infrastructure migration may be provided where technically necessary.
Customers are responsible for maintaining appropriate backups, redundancy strategies, and disaster recovery procedures.
Hostishere may provide automated backups, snapshots, or recovery systems for selected services.
Unless explicitly agreed otherwise, backup services are provided without guarantee and customers remain responsible for maintaining independent backups.
Hostishere is not liable for backup failure, corruption, partial recovery, unavailable restore points, or data loss.
Backup systems may be unavailable, delayed, incomplete, or affected by infrastructure failures, software issues, customer actions, or force majeure events.
Customers are fully responsible for all data, software, applications, configurations, and content stored on their services.
Customers are responsible for securing, maintaining, and updating their systems and software installations.
Hostishere is not liable for data loss, corruption, deletion, configuration issues, security incidents, service interruption, or damages caused by hardware failures, software issues, cyberattacks, user actions, third parties, or force majeure events.
IP addresses remain the property of Hostishere or its upstream providers.
Customers receive no ownership rights over assigned IP addresses.
IP allocations may change due to operational, technical, abuse-related, or legal requirements.
BGP announcements, routing policies, and network configurations may be modified when necessary.
Customers are responsible for securing their systems, applications, passwords, and software installations.
Customers must maintain appropriate security practices, including software updates, firewall configuration, access control, and credential protection.
Customers are solely responsible for activities occurring on their services.
We may monitor infrastructure, network usage, resource utilization, and abuse indicators to protect infrastructure stability and comply with legal obligations.
We do not actively monitor customer content unless required for abuse handling, security investigations, or legal compliance.
We reserve the right to suspend, restrict, or terminate services immediately and without prior notice in cases involving:
• Abuse or prohibited activity
• Fraud or payment disputes
• Chargebacks
• Legal violations
• Infrastructure attacks
• Risk to network stability
• Violation of these Terms
Termination may occur without refund where legally permitted.
Opening unjustified chargebacks or payment disputes may result in immediate suspension, termination, loss of data, refusal of future service, or debt collection measures where legally permitted.
Customers are expected to contact support before initiating disputes.
All trademarks, branding, logos, website content, software, and infrastructure systems related to Hostishere remain our property or the property of respective licensors.
Customers may not copy, reverse engineer, modify, resell, or exploit our systems outside explicitly permitted usage.
We may rely on third-party providers including datacenters, network operators, payment processors, software vendors, and infrastructure suppliers.
Availability and functionality may partially depend on these providers.
All services are provided on an "as is" and "as available" basis.
Hostishere makes no guarantees regarding uninterrupted availability, specific performance levels, routing quality, latency, or compatibility with customer workloads.
To the maximum extent permitted by law, Hostishere shall not be liable for indirect, incidental, special, consequential, or economic damages, including loss of profits, business interruption, data loss, or reputational harm.
Our total liability is limited to the amount paid for the affected service during the relevant billing period.
Hostishere shall not be liable for failures or delays caused by events beyond reasonable control, including natural disasters, war, government actions, internet failures, datacenter outages, power failures, cyberattacks, or upstream provider disruptions.
We reserve the right to modify, replace, suspend, or discontinue services, features, pricing, or infrastructure components at any time where reasonably necessary.
We may update these Terms periodically.
Continued use of our services after changes become effective constitutes acceptance of the updated Terms.
These Terms are governed by the laws of Germany.
Where legally permissible, the place of jurisdiction shall be Germany.
Mandatory consumer protection rights under applicable law remain unaffected.
If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain fully effective.
