Jan Vishwas (Amendment) Act, 2023
Decriminalization of minor offenses across key environmental regulations.
The Paradigm Shift
The Jan Vishwas Act represents a major shift from imprisonment to financial penalties for procedural and minor EHS non-compliances. It amended the EP Act (1986), Air Act (1981), and Water Act (1974), replacing fear-based compliance with a structured, monetary penalty system managed by Adjudicating Officers.
Key Amendments
National Green Tribunal (NGT)
The apex judicial body for expeditious disposal of cases relating to environmental protection.
Jurisdiction & Power
Established under the NGT Act 2010, the Tribunal is not bound by the Code of Civil Procedure but is guided by principles of natural justice. It has the power to hear all civil cases relating to environmental issues and questions linked to the implementation of laws listed in Schedule I of the Act.
