Privacy Policy
Last updated: May 20, 2026
The protection of your privacy is important to us. We want you to know when we process your personal data, and which data we use. In this privacy policy we will inform you about the personal data we process, the legal basis and your rights.
As a private company, we are subject to data protection regulations such as the European General Data Protection Regulation (GDPR), the German Federal Data Protection Act (BDSG), and the Act on Data Protection and Privacy in Telecommunications and Telemedia (TDDDG). We have taken appropriate technical and organizational measures to ensure that the regulations on data protection are observed both by us and by our external service providers.
Table of Contents
1. Definitions
We are required by law that personal data are processed lawfully, in good faith, and in a manner that can be comprehended by the persons who are affected (“lawfulness, fair processing, transparency”). To this end, we hereby inform you about the individual legal definitions of the European General Data Protection Regulation (GDPR) and the new German Federal Data Protection Act, which are also used in these data privacy regulations.
1.1 Personal data
"Personal data" means any information relating to an identified or identifiable natural person (hereinafter the "data subject"). A natural person is considered to be identifiable if he or she can be identified directly or indirectly, in particular by association with an identifier such as a name, an identification number, location data, an online identifier, or one or more special features which express the physical, physiological, genetic, mental, economic, cultural or social identity of the natural person.
1.2 Processing
"Processing" means any operation or set of operations which is performed on personal data, whether or not by automated means, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.
1.3 Restriction of processing
"Restriction of processing" means the marking of stored personal data with the aim of limiting its processing in the future.
1.4 Profiling
”Profiling“ means any form of automated processing of personal data consisting of the use of personal data to evaluate certain personal aspects relating to a natural person, in particular to analyze or predict aspects concerning that natural person's performance at work, economic situation, health, personal preferences, interests, reliability, behavior, location or movements.
1.5 Pseudonymization
“Pseudonymization“ means the processing of personal data in such a manner that the personal data can no longer be attributed to a specific data subject without the use of additional information, provided that such additional information is kept separately and is subject to technical and organizational measures to ensure that the personal data is not attributed to an identified or identifiable natural person.
1.6 Filing system
“Filing system“ means any structured set of personal data which is accessible according to specific criteria, whether centralized, decentralized or dispersed on a functional or geographical basis.
1.7 Controller
“Controller“ means the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data. Where the purposes and means of such processing are determined by European Union or Member State law, the controller or the specific criteria for its nomination may be provided for by European Union or Member State law.
1.8 Processor
“Processor“ means a natural or legal person, public authority, agency or other body which processes personal data on behalf of the controller.
1.9 Recipient
“Recipient“ means a natural or legal person, public authority, agency or another body, to which the personal data is disclosed, whether a third party or not. However, public authorities which may receive potentially personal data in the framework of a particular inquiry in accordance with European Union or Member State law shall not be regarded as recipients. The processing of that data by those public authorities shall be in compliance with the applicable data protection rules according to the purposes of the processing.
1.10 Third party
A “third party“ means a natural or legal person, public authority, agency or body other than the data subject, controller, processor and persons who, under the direct authority of the controller or processor, are authorized to process personal data.
1.11 Consent
The “consent“ of the data subject means any freely given, specific, informed and unambiguous indication of the data subject's wishes by which he or she, by a statement or by a clear affirmative action, signifies agreement to the processing of personal data.
2. Lawfulness of processing
Processing shall be lawful only if and to the extent that at least one of the following applies:
a) the data subject has given consent to the processing of his or her personal data for one or more specific purposes;
b) processing is necessary for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract;
c) processing is necessary for compliance with a legal obligation to which the controller is subject;
d) processing is necessary in order to protect the vital interests of the data subject or of another natural person;
e) processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller;
f) processing is necessary for the purposes of the legitimate interests pursued by the controller or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data, in particular where the data subject is a child.
3. Use of our website for informational purposes only
In this section, we inform you about what data are processed by us when you use our website for informational purposes only, i. e. when you do not actively submit data to us when visiting our website.
3.1 Log files
When you view our website, we collect the following data in so-called log files, which are technically required for us to be able to display our website to you and to ensure stability and security:
- IP address
- Date and time of the request
- Time zone difference to Greenwich Mean Time (GMT)
- Content of the request (specific page)
- Access status / HTTP status code
- Amount of data transferred per request
- Website from which the request originates
- Browser
- Operating system, including its interface
- Language and version of the browser software
We are entitled to collect and store this data in accordance with Art. 6 para. 1 p. 1 lit. f) GDPR, because we have a legitimate interest in the security and stability of our website. They will be automatically deleted after fourteen days at the latest, unless there is a reasonable suspicion of an unlawful act.
3.2 Cookies
In addition to the data mentioned above, cookies are set during the use of our website. Cookies are small text files that are stored on your terminal device, through which the party setting the cookie receives certain information. Cookies cannot execute programs or transfer viruses to your computer. They serve to make the internet service altogether more user-friendly and effective.
3.2.1 Essential cookies
We only use cookies that are essential for enabling certain functions of our website, in order to make your visit here as pleasant as possible. In particular, these include the so-called session cookies. They store a so-called session ID, with which the various requests from your browser can be allocated to the joint session. This way, your terminal device can be recognized when you return to our website. The session cookies are deleted when you log out or close the browser.
In accordance with Art. 6 para. 1 p. 1 lit. f) of the EU GDPR, we are authorized to use these cookies, as we have a legitimate interest in the functionality and correct display of our website. Consent is not required according to § 25 para. 2 no. 2 TDDDG.
3.2.2 Cookie settings
You can also access our website without having cookies stored on your terminal device. However, if you want to make use of our website to its full extent and in a comfortable way, you should accept cookies. Most web browsers are set by default to accept cookies. Nevertheless, you can set your browser to display cookies before they are stored, to accept or reject only certain cookies, or to reject cookies in general. Please note that changes to settings only affect the browser in question. If you use other browsers or a different end device, you will have to change the settings again. Furthermore, you can delete cookies from your storage medium at any time. Information on cookie settings, their modification, and the deletion of cookies can be found in the help section of your web browser.
3.3 YouTube
On our website, we embed videos from YouTube, a platform of Google Inc, USA. When you access a website in which a YouTube video is embedded, data are usually already transmitted to a Google server in Ireland and stored there. It cannot be ruled out that, in exceptional cases, Google may also transfer data to servers in the USA to process them there. If you have a user account with Google and are registered, Google can assign the visit to your user account. Google stores these data as usage profiles and utilizes them for advertising and market research purposes.
To avoid this processing by Google, we use the plug-in “Embetty”, an open-source project of heise online, the online portal of the Heise group, for embedding YouTube content. The preview image of the YouTube video is displayed by Embetty, without immediately establishing a connection between your terminal device and Google’s server. The connection to Google’s server is only made when you click on the video.
We embed YouTube content on our website in order to make it directly available to you without you having to obtain it specifically from YouTube. This allows us to optimize and make more interesting both our services and your user experience. This also constitutes our legitimate interest in the processing of the above-mentioned data by the third-party provider. The legal basis is Art. 6 para. 1 p. 1 lit. f) GDPR.
When you click on a YouTube video embedded using Embetty, data may be transferred to servers of Google Inc. in the USA. The data transfer to the USA takes place on the basis of the adequacy decision of the European Commission dated July 10, 2023. According to Art. 45 GDPR, the European Commission can determine by means of an adequacy decision that a state outside the European Union has a level of data protection equivalent to that of the EU. For the USA, the European Commission has determined that companies based there must also be certified under the so-called Trans-Atlantic Data Privacy Framework ("TADPF"). By certifying, the companies in question commit to complying with certain regulations specified by the TADPF, which ensure an appropriate level of data protection. Google LLC and all U.S. entities of Google are certified under the TADPF.
4. Subscription to, and use of, Timing
Timing is available as a web application via the browser, and as a MacOS app. If you want to use Timing, you can first make use of the app’s free trial version for 14 calendar days without providing us with any personal data.
If you want to subscribe to Timing, the conclusion of the contract will require you to provide your personal data, which are necessary for processing your order. Mandatory data for the processing of contracts are marked separately, while additional details are voluntary. The data you provide will be processed for handling your order. The legal basis for this is Art. 6 para. 1 p. 1 lit. b) GDPR, which allows personal data to be processed for the fulfillment of a contract.
4.1 Payment service provider reseller
We currently offer Timing via our website and via the “Setapp” platform of MacPaw Way Ltd., Cyprus. Depending on where you purchase a license for the use of Timing, the data required for the transaction will be transmitted to the respective payment service provider. The legal basis for the transmission is Art. 6 para. 1 p. 1 lit. b) GDPR, as the payment data are needed to process the contract with you.
4.1.1 Paddle
For the distribution of Timing via our website we use the reseller service “Paddle” of Paddle.com Market Limited, 15 Briery Close, Great Oakley, Corby, Northamptonshire, NN18 8JG, United Kingdom. Paddle acts as a “reseller”. After clicking the “subscribe” button on our website, a pop-up window will appear, which is provided by Paddle. There you can choose a payment option and complete the booking of the subscription.
Your personal data required for the conclusion of the contract (in particular name, address, e-mail address) will be transmitted directly to Paddle and stored there. We ourselves do not immediately have access to these data. Paddle will then transmit to us your e-mail address, your name and a transaction ID so that we can assign the booked subscription to you.
You can read Paddle’s privacy policy at https://paddle.com/privacy.
4.1.2 Setapp
If you obtain Timing via Setapp, the personal data required for the conclusion of the contract (in particular name, address, e-mail address) will be collected by Setapp only. Setapp merely transmits to us your e-mail address for the event that you would like to receive our e-mail newsletter and consent to the transmission of your e-mail address to us for this purpose.
4.1.3 PayPal
If you decide to use the payment method PayPal, your personal data will be transmitted from Paddle to PayPal. To use PayPal, you must create a PayPal account. With the use or creation of a PayPal account, you have to transmit, in particular, your name, address, telephone number and e-mail address to PayPal. The legal basis for the transmission of the data is Art. 6 para. 1 lit. a) GDPR (consent) and Art. 6 para. 1 lit b) GDPR (processing for the fulfillment of a contract).
The operator of the PayPal payment service is:
PayPal (Europe) S.à r.l. et Cie, S.C.A.
22-24 Boulevard Royal
L-2449 Luxembourg
E-Mail: [email protected]
By choosing the PayPal payment option, you consent to the transmission of personal data such as name, address, telephone number and e-mail address to PayPal. Any additional data collected by PayPal are determined by the respective privacy policy of PayPal. It can be found at: https://www.paypal.com/de/webapps/mpp/ua/privacy-full .
4.2 Use of Timing
In this section we inform you about the data processing that takes place when you actively use Timing.
At the start, the Timing app transmits your license information (including your license key, email address, computer name, and an anonymous unique identifier for your Mac) to us, for example in order to check your eligibility for discounted upgrades, to validate your license or your subscription, to search for available updates, or to display important information about the app.
4.3 Use of Timing Sync
We offer a service that allows you to synchronize your data recorded with Timing across multiple Macs, “Timing Sync”.
The use of Timing Sync is optional. If you choose not to use this data synchronization service, none of the activities recorded by Timing will be transmitted to us or to any third party. You may also opt out of this service at any time.
When you use Timing Sync, we will not share your sync data with third parties without your consent. Your sync data will only be used to provide this service, to improve it, and to provide you with support.
And because these are sensitive data, we have also taken extensive security measures to ensure that your data are adequately protected against third-party access. These include:
- Hashing of all passwords you provide to us for creating an account on our website, with optional two-factor authentication (2FA) for additional security;
- Using industry-standard TLS encryption for transmitting data between your device and our services;
- Having our cloud provider encrypt all data in our databases using AES-256 (encryption at the storage layer);
- Separately encrypting your app usage data, which we consider particularly sensitive, in an additional step before storing it in our database, using AES-256 with a user-specific key (encryption at the application layer);
- Logging of all application-layer encryption and decryption processes of this app usage data for auditing purposes;
- Choice of server location Frankfurt (Germany) with our hosting provider Google Cloud.
We also offer a service that allows you to access your data online via a web interface and a so-called API (application programming interface).
Note that, while we encrypt your data both in transit and at rest, it is not encrypted end-to-end, as that would preclude us from offering these web-based services.
In addition, we may send you periodic summaries of e.g. your weekly activities via email. While we try to transmit these emails over encrypted channels whenever possible, we have no influence on the level of security that your email provider offers, nor on how they process the data contained in these emails. If you do not feel comfortable with receiving this potentially sensitive data to your email inbox, you can opt out of these summary emails at any time.
If you choose to use Timing Sync, we will collect and store the following data (which will be retained until you opt out/unsubscribe from this service, and for up to 365 days thereafter, or until you request their deletion):
- Your e-mail address;
- Unique identifiers, as well as the names of your devices that you have determined in the system settings;
- Copies of all data you have stored in Timing;
- Icons of the apps you track time in with Timing, for display in email summaries and/or the Timing web app.
You can request deletion of your data at any time from within the Timing web app or by contacting us.
We use the “Postmark” service provided by AC PM LLC (ActiveCampaign), USA, to send you e-mails related to Timing Sync, for example messages about e-mail confirmation and password resetting.
4.4 Use of Timing for Teams
Timing for Teams is based on Timing Sync and collects the same type of information. With Timing for Teams, team administrations can view the manual time entries (“tasks) which the team members have added to the projects they share in the context of their membership on the team.
If you are a team member, the tasks you link to any of your team’s projects will be shared with (and be visible to) all administrators of your team.
If you use Timing for Teams, as a team administrator you are responsible for informing the team members about how using Timing for Teams impacts their privacy. You may need to conclude an agreement with the team members that regulates the use ofTiming for Teams in your organization. In this scenario, you are in charge of the data processing, not we.
4.5 AI-based Functionality
You can use AI-based features with Timing, such as creating summaries of your day.
We use language models for this purpose. Currently, these are models provided via Google's "Vertex AI Generative AI" service, which we use exclusively via servers located in the European Union (EU). The language models automatically create the corresponding content on Google's servers in the EU. When using this feature, metadata about your Mac usage is transferred to Google Cloud EMEA Ltd., based in Ireland. This includes, for example, the window title of the apps you use, your name, or your email address. The provider processes your data exclusively for the creation of this content and automatically deletes it after a short period. Your data is not used by the provider for training their AI models or other AI purposes. The legal basis for the transfer of data to the provider is Art. 6 para. 1 p. 1 lit. b) GDPR. The data transfer is necessary to provide you with the corresponding features within Timing.
As we only use Google's AI services hosted in the EU, data transfer to the USA does not occur for this specific purpose.
You can provide us with feedback on the quality of these summaries within Timing. After selecting the corresponding function, a support request is created, which contains the input and output data for the AI. You can edit this before sending. We use this data to improve the summaries. They are deleted after 30 days at the latest or earlier if we no longer need them.
If you send us such a support request, we may ask for permission to use the submitted data in anonymized form for training our AI models. If you explicitly agree to this, we will first anonymize your data. This is done by automatically replacing all personal data with fictional data of the same type, followed by a final review by an employee. They ensure that the anonymization was successful and complete. The legal basis for this processing is your consent according to Art. 6 para. 1 p. 1 lit. a) GDPR. The anonymized data is stored permanently for the purpose of AI training. Due to the anonymization, it is impossible to trace back to your person.
4.6 Cookie-like technologies
When you use Timing’s MacOS app, cookie-like technologies are used, which collect data in a manner analogous to the cookies that are set on our website. The above-mentioned statements on cookies therefore apply accordingly.
However, in this context we do not process any personal data but only anonymous user statistics, which allow us, for example, to track which sections of the app are used most or how long your Mac was switched on.
For example, Timing sends anonymous and therefore non-personal usage data to Sentry and Google BigQuery. These data are only used for counting the number of installs and collecting crash reports, for example. They are data about how you use Timing as such, but not about what Timing has recorded.
However, you have the option to deactivate the transmission of statistical data in the Timing app.
4.7 Storage duration
Should you wish to have your data deleted, you can send us an email to [email protected] at any time. Otherwise, we will delete your data as soon as we no longer need them, usually when your subscription has expired and you no longer use Timing.
Nevertheless, commercial and tax law requires us to store your address, payment and order data for a period of ten years. We will, however, restrict processing after two years, i. e. your data will then only be used to comply with legal obligations.
4.8 Transmission of data to Apple when using the Screen Time integration
If you use the Screen Time integration of Timing, Timing must retrieve information about the tracked iOS apps (in particular their title and icon) from the Apple App Store in order to display them in the app. For this purpose, Timing transmits the bundle identifier of all apps for which Timing is missing the above information via a secure connection to Apple's App Store servers. This transmission only takes place as long as the Screen Time integration function is active.
In addition, we believe that this transmission is not problematic given the fact that Apple can already determine which apps you have installed on your device via your iCloud account.
5. Newsletter
You will receive our newsletter if you register for it or if you have subscribed to Timing.
5.1 Registration
Should you wish to receive our newsletter without being a subscriber, we will ask you for your explicit consent that we may process your e-mail address and the other data provided. Your consent therefore forms the legal basis for this data processing, in accordance with Art. 6 para. 1 p. 1 lit. a) GDPR.
Mandatory entry for sending the newsletter is your e-mail address alone. The provision of further, separately marked data is voluntary and will be used for addressing you personally. After your confirmation, we will store your e-mail address for the purpose of sending the newsletter.
For the registration to our newsletter, we use the so-called double opt-in procedure. This means that after your registration we will send you an e-mail to the e-mail address you provided, in which we will ask you to confirm that you wish to receive the newsletter. If you do not confirm your registration within 24 hours, your information will be blocked and automatically deleted after one month. In addition, we will store your respective IP addresses used, as well as the times of registration and confirmation. The purpose of this procedure is to be able to prove your registration and, if necessary, to elucidate a possible misuse of your personal data.
You may revoke your consent to the sending of the newsletter at any time and hence unsubscribe from the newsletter. You can declare the cancellation by clicking on the link provided in every newsletter e-mail, or by sending an e-mail to [email protected].
5.2 Subscribers
If you subscribe to Timing, you will automatically receive our newsletter. You may opt out of receiving the newsletter at any time by using the “unsubscribe” link provided in every newsletter e-mail or by sending us an e-mail to [email protected].
6. General inquiries
If you contact us by mail, e-mail, contact form or telephone, your inquiry, including all personal data resulting from it will be stored by us for the purpose of processing your request. We will not pass on these data without your consent. The processing of these data is based on Art. 6 para. 1 p. 1 lit. b) GDPR, insofar as your inquiry is related to the fulfillment of a contract concluded with us or is required for the fulfillment of pre-contractual measures. Otherwise, the processing is based on Art. 6 para. 1 p. 1 lit. f) GDPR, since we have a legitimate interest in the effective processing of inquiries addressed to us. In addition, we may also be entitled under Art. 6 para. 1 p. 1 lit. c) GDPR to process the above-mentioned data, as we are legally obligated to enable fast electronic contact and direct communication with us.
Of course, your data will be used strictly for the purpose of processing and responding to your inquiry and will be deleted after final processing, unless there are legal obligations for us to retain the data.
7. Processors
As a matter of principle, we will not pass on your data to third parties without your explicit consent. However, like any modern company, we work together with processors, in order to provide you with an uninterrupted service of the best possible quality.
When we work with external service providers, order processing regularly takes place on the basis of Art. 28 GDPR. For this purpose, we conclude respective agreements with our partners in order to ensure the protection of your data. We only use carefully selected processors for the processing of your data. These are bound by our instruction and regularly monitored by us. We only commission external service providers who have ensured that all data processing procedures are carried out in accordance with the requirements of data protection law.
We currently work with the following processors:

In exceptional cases, personal data may be transferred to servers located in the USA. We will ask for your explicit consent in this regard. We would like to point out that the USA has been classified by the European Court of Justice (ECJ) as an unsafe third country, for which there exist no adequacy decision, no appropriate guarantees and no effective legal remedies to enforce your rights. In particular, it cannot be ruled out that state (surveillance) authorities may access and process your data even without any legal remedy options. The legal basis for the processing is Art. 6 para. 1 p. 1 lit. a) GDPR and Art. 49 para. 1 p. 1 lit. a) GDPR.
8. Children & adolescents
In principle, our offer is aimed at adults. Persons under the age of 18 should not transmit any personal data to us without the consent of their parents or legal guardians.
9. Provision obligation and profiling
There is no legal obligation to provide us with personal data. Automated decision-making in the sense of Art. 22 of the EU GDPR does not take place.
10. Your rights
In this section we inform you about your rights with regards to your personal data.
10.1 Revocation of consent
If your personal data is processed on the basis of consent which you have given us, you have the right to revoke your consent at any time. The revocation of consent does not affect the legality of the processing performed on the basis of the consent until the time of revocation.
You can contact us at any time to exercise your right to revoke consent.
10.2 Right to confirmation
You have the right to request confirmation from the controller that we are processing personal data concerning you. You can request this confirmation at any time using the contact details above.

a) the purposes of the processing
b) the categories of personal data being processed.
c) the recipients or categories of recipients to whom the personal data has been or is being disclosed, in particular in the case of recipients in third countries or international organizations.
d) if possible, the planned duration for which the personal data is stored or, if this is not possible, the criteria for determining this duration.
e) the existence of a right to rectification or erasure of the personal data concerning you, or to a restriction of processing by the controller or a right to object to such processing
f) the existence of a right to lodge a complaint with a supervisory authority
g) if the personal data is not collected from the data subject, all available information on the source of the data
h) the existence of automated decision-making, including profiling, in accordance with Article 22 (1) and (4) GDPR and, at least in these cases, meaningful information about the logic involved and the scope and intended impact of such processing on the data subject
If personal data is transferred to a third country or to an international organization, you have the right to be informed of the appropriate safeguards under Article 46 of the GDPR in connection with the transfer. We provide a copy of the personal data that is the subject of the processing. For any additional copies you request of a person, we may charge a reasonable fee based on our administrative costs. If your request is submitted electronically, the information must be provided in a standard electronic format, unless otherwise stated. The right to receive a copy under paragraph 3 shall not affect the rights and freedoms of others.
10.4 Right to rectification
You have the right to demand the immediate correction of incorrect personal data concerning you. Taking into account the purposes of processing, you have the right to request the completion of incomplete personal data, including by means of a supplementary statement.
10.5 Right to erasure (“right to be forgotten “)
You have the right to demand that the controller erase personal data concerning you without undue delay, and we are obligated to erase personal data without undue delay where one of the following grounds applies:
a) the personal data are no longer necessary in relation to the purposes for which they were collected or otherwise processed
b) the data subject withdraws the consent on which the processing is based according to point (a) of Article 6(1), or point (a) of Article 9(2), and there is no other legal ground for the processing
c) the data subject objects to the processing pursuant to Article 21(1) GDPR and there are no overriding legitimate grounds for the processing, or the data subject objects to the processing pursuant to Article 21(2) GDPR;
d) the personal data have been unlawfully processed
e) personal data must be erased for compliance with a legal obligation in Union or Member State law to which the controller is subject
f) the personal data was collected in relation to the offer of information society services referred to in Article 8(1) GDPR
If the controller has made the personal data public and is obliged pursuant to paragraph 1 to erase the personal data, the controller, taking account of available technology and the cost of implementation, shall take reasonable steps, including technical measures, to inform controllers which are processing the personal data that the data subject has requested the erasure by such controllers of any links to, or copy or replication of, that personal data. The right to erasure (“right to be forgotten “) does not apply to the extent that the processing is necessary:
a) to exercise the right of freedom of expression and information
b) for compliance with a legal obligation which requires processing by Union or Member State law to which the controller is subject or for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller

e) for the establishment, exercise, or defense of legal claims
10.6 Right to restriction of processing
You have the right to request that we restrict the processing of your personal data if any of the following conditions apply:
1. the accuracy of the personal data is contested by the data subject, for a period enabling the controller to verify the accuracy of the personal data
2. the processing is unlawful, and the data subject opposes the erasure of the personal data and requests the restriction of their use instead
3. the controller no longer needs the personal data for the purposes of the processing, but the data is required by the data subject for the establishment, exercise, or defense of legal claims, or
4. the data subject has objected to processing pursuant to Article 21(1) GDPR pending the verification whether the legitimate grounds of the controller override those of the data subject
In the event that processing has been restricted under the aforementioned conditions, this personal data shall – with the exception of storage – only be processed with the data subject’s consent or for the establishment, exercise or defense of legal claims or for the protection of the rights of another natural or legal person or for reasons of important public interest of the Union or of a Member State.
In order to exercise the right to restrict processing, the data subject may contact us at any time using the contact details provided above.
10.7 Right to data portability
You have the right to receive the personal data concerning you which you have provided to us in a structured, commonly used and machine-readable format and have the right to transmit that data to another controller without hindrance from the controller to which the personal data have been provided, to the extent that:
a) the processing is based on consent pursuant to point (a) of Article 6 (1) or point (a) of Article 9 (2) or on a contract pursuant to point (b) of Article 6 (1) GDPR and
b) the processing is carried out by automated means
In exercising your right to data portability pursuant to paragraph 1, you have the right to have the personal data transmitted directly from one controller to another, to the extent that this is technically feasible. The exercise of the right to data portability does not affect your right to erasure (“right to be forgotten”). That right shall not apply to processing necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller.
10.8 Right to object
You have the right to object, on grounds relating to your particular situation, at any time to processing of personal data which concerns you which is based on point (e) or (f) of Article 6 (1) GDPR, including profiling based on those provisions. If objection is made, the controller will no longer process the personal data unless the controller demonstrates compelling legitimate grounds for the processing which override the interests, rights, and freedoms of the data subject or for the establishment, exercise, or defense of legal claims.
In the event that personal data is processed for direct marketing purposes, you have the right to object at any time to processing of personal data concerning you for such marketing. This also applies to profiling to the extent that it is related to such direct marketing. If you object to processing for direct marketing purposes, your personal data shall no longer be processed for such purposes.
Regarding the use of information society services, and notwithstanding Directive 2002/58/EC, you can exercise your right to object by automated means using technical specifications.
Where personal data are processed for scientific or historical research purposes or statistical purposes pursuant to Article 89 (1), you, on grounds relating to your particular situation, have the right to object to processing of personal data concerning you, unless the processing is necessary for the performance of a task carried out for reasons of public interest.
The right of objection can be exercised at any time by contacting the respective controller.
10.9 Automated individual decision-making, including profiling
You have the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects for you or similarly significantly affects you. This does not apply if the decision:
a) is necessary for entering into, or performance of, a contract between the data subject and a data controller
b) is authorized by Union or Member State law to which the controller is subject and which also lays down suitable measures to safeguard the data subject’s rights and freedoms and legitimate interests, or
c) is based on the data subject’s explicit consent
d) The controller shall implement suitable measures to safeguard the data subject’s rights and freedoms and legitimate interests, at least the right to obtain human intervention on the part of the controller, to express his or her point of view and to contest the decision.
This right can be exercised by the data subject at any time by contacting the respective controller.
10.10 Right to lodge a complaint with a supervisory authority
You also have the right, without prejudice to any other administrative or judicial remedy, to lodge a complaint with a supervisory authority, in particular in the Member State of your habitual residence, place of work or place of the alleged infringement if you as data subject consider that the processing of personal data relating to you infringes this Regulation.
10.11 Right to effective judicial remedy
Without prejudice to any other available administrative or judicial remedy, including the right to lodge a complaint with a supervisory authority pursuant to Article 77 GDPR, you have the right to an effective judicial remedy if you consider that your rights under this Regulation have been infringed as a result of the processing of your personal data in breach of this Regulation.
