Terms of Use — 321cuckold.com & 321cuckoldchat.com
Introduction & Scope.
These Terms of Use (“Terms”, “Agreement”) govern your access to and use of 321cuckold.com and 321cuckoldchat.com (collectively, “321C”, “Site”, or “Platform”), including all content, features, and services offered on or through the Platform. By using 321C, you agree to these Terms and all applicable laws. If you do not agree, you must not access or use the Site. Your continued use constitutes acceptance of any updates posted here.
1) Website Disclaimer.
Your use of the Platform is entirely at your own risk. Information is transmitted through systems that may be beyond our control. 321C is not responsible for delays, failures, interruptions, or corruption of any data during transmission.
The Platform and all content are provided “as is” and “as available.” 321C, its licensors, and suppliers expressly disclaim all warranties, including implied warranties of merchantability, non-infringement, and fitness for a particular purpose. We make no representations regarding the accuracy, completeness, or reliability of any information, software, text, graphics, links, or communications on the Platform.
In no event shall 321C or any associated party be liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages arising from use or inability to use the Platform. Users accept full responsibility for any risk resulting from their use of the Service.
2) Agreement to Terms.
By registering for or using the Platform (“Service”), you agree to these Terms and any changes made from time to time. The Service may modify, suspend, or discontinue any feature at any time without notice. If you disagree with any modification, you must stop using the Service.
3) Right to Use.
Your right to use the Service is personal, limited, revocable, and non-transferable. We may restrict access, change eligibility requirements, or discontinue any function or database at our discretion, without liability.
4) Adults Only.
The Service is for consenting adults only. You represent that you are at least 18 years old or the age of majority in your jurisdiction, whichever is higher. Minors are strictly prohibited. You may not role-play or pretend to be a minor. Accounts suspected of underage use may be terminated and reported to authorities.
If you suspect a minor’s presence, report immediately through the in-chat flag or to [email protected]. All reports are reviewed promptly.
5) Zero-Tolerance Policy.
321C enforces a strict zero-tolerance policy against illegal or harmful material. This includes:
(a) any depiction of minors or child sexual abuse material (CSAM);
(b) revenge pornography or intimate imagery shared without consent;
(c) solicitation or distribution of illegal content;
(d) bestiality, human trafficking, or coercion;
(e) deepfakes or AI-generated sexual images that realistically depict real persons without consent;
(f) any act that promotes, describes, or normalizes sexual activity with minors or non-consenting persons.
Violations will result in permanent bans and may be reported to relevant law enforcement. False reports made in bad faith may themselves lead to suspension.
6) Non-Consensual Content.
321C strictly prohibits uploading, posting, or transmitting any image, video, audio, or text depicting a real identifiable person in a state of nudity or sexual activity without that person’s explicit consent. Examples include leaked private images, hidden-camera recordings, secretly captured screenshots, revenge pornography, or digitally altered images (deepfakes).
Consent must be verifiable and freely given. “Implied” consent through online availability does not qualify.
Upon receiving notice or credible suspicion of non-consensual content, we will disable access and may preserve evidence for investigation. Accounts found responsible are permanently banned. We cooperate fully with police and cybercrime units where applicable.
You agree to report any such material immediately using the in-chat report tool or by contacting [email protected].
7) Code of Conduct.
Users must behave respectfully and within local laws. You agree to:
(a) Post only lawful, non-infringing, consensual material;
(b) Refrain from harassment, hate speech, doxxing, or targeted abuse;
(c) Respect privacy—no screenshots or reposting of private conversations without consent;
(d) Avoid sharing links, advertisements, or spam;
(e) Not impersonate another person or falsely represent yourself.
You are solely responsible for what you post or transmit. 321C may remove or restrict any material violating these Terms or community standards.
8) Illegal Activity vs. Rule Violations.
Illegal activities (such as CSAM, non-consensual content, or threats) are reported to law enforcement and hosting providers.
Non-criminal rule violations (spam, disrespect, or off-topic posting) may result in warnings, temporary mutes, or bans.
Enforcement is discretionary and may vary by severity, repetition, or intent.
9) Examples of Prohibited Material.
Without limitation, prohibited materials include: images of minors; incest or familial sexual themes; depictions of blood, feces, vomit, or urine in a sexual context; glorification of violence, torture, or coercion; references to rape fantasies, self-harm, or erotic asphyxiation; use or promotion of illegal drugs; sexual acts with animals; or offers of prostitution or escort services.
Content that humiliates, exploits, or misrepresents others is also prohibited.
10) Privacy and Information Use.
All personal data is processed per our Privacy Policy (see /privacy.php). We collect minimal necessary data and never sell or share personal information beyond lawful compliance.
Private messages are confidential; however, see “Monitoring & Safety” for limited automated scanning obligations.
11) User Content and Copyright.
You retain ownership of materials you upload (“User Content”). By posting, you grant 321C a non-exclusive, worldwide, royalty-free license to host and display such content for operating the Service.
You affirm that you own or have permission to post any uploaded material.
If you post copyrighted work without authorization, you assume all liability.
321C acts only as a neutral intermediary service provider and is not the “publisher” of User Content.
Upon valid notice of infringement, 321C removes the material promptly.
12) DMCA and Counter-Notice Procedure.
If you believe your copyright has been infringed, send notice to [email protected] including:
1. Signature of rights holder or agent;
2. Description of the protected work;
3. Location (URL or post ID) of infringing material;
4. Contact information;
5. Statement of good faith belief;
6. Statement under penalty of perjury that information is accurate.
If your content was removed and you believe this was a mistake, you may send a counter-notice including your signature and statement consenting to jurisdiction of Dutch courts. 321C will restore content only where legally appropriate.
13) Monitoring and Safety.
Private messages are not manually monitored. Automated tools may flag content containing keywords or patterns associated with underage material, non-consensual imagery, or threats. Only the owner may review flagged matches to confirm or dismiss results.
321C may access private content only:
(a) upon user report of illegal activity or harassment;
(b) when required by law; or
(c) when automated scans detect high-risk material.
We value privacy and use the least intrusive means necessary.
321C shall not be liable for any offensive or illegal content transmitted by users, including unauthorized use by hackers or impersonators.
14) Reporting, Takedown, and Appeals.
Users must promptly report any illegal or non-consensual content via the flag icon or email. All reports are reviewed in under one business day whenever feasible.
If your content or account is removed, you may file an appeal by emailing [email protected] with subject “Appeal.” Include your username, approximate date, and explanation.
Appeals are reviewed within seven (7) days. Repeated or vexatious appeals may be ignored.
321C maintains transparency logs of all takedown actions to comply with EU Digital Services Act requirements.
15) Security and Account Responsibility.
Accounts are personal and may not be shared or transferred. You are responsible for maintaining confidentiality of your credentials and for all activity under your account. Notify us immediately of unauthorized access.
Unauthorized use, hacking attempts, or exploiting vulnerabilities may result in immediate suspension and potential legal referral.
16) External Links.
The Platform may contain links to third-party websites. 321C does not endorse or control these sites and is not responsible for their content or privacy practices. Sharing outside links in chat is prohibited unless explicitly allowed by moderators.
17) On- or Off-Site Interactions.
321C does not facilitate real-world meetings. Users choosing to meet others do so at their own risk. The Platform disclaims all liability arising from off-site communications or encounters.
Always meet in public places, inform a friend, and never share financial or personal details.
18) Donations, VIP Status, and Refunds.
Donations are voluntary and non-refundable. Donations do not constitute a sale, membership, or entitlement. VIP or premium recognition is symbolic and may be revoked upon rule violation.
No refund shall be issued for bans, suspension, or voluntary departure.
19) Termination and Suspension.
321C may terminate or suspend accounts, with or without notice, for violations of these Terms, legal risk, or system abuse. If terminated, you may not re-register without written consent.
321C is not liable for damages resulting from suspension or loss of data.
20) Post-Termination Data.
Upon termination, access to your account, messages, and uploaded materials is removed. We may retain limited information as required by law or for recordkeeping. Deleted data cannot be recovered once purged.
21) Verification and Identity Protection.
To protect individuals depicted, 321C may request verification from profiles suspected of using third-party images. Refusal to verify may result in suspension.
Verification never involves ID documents; methods are described on our verification page.
22) Double-Account Policy.
Users may hold one account per role (e.g., one “Bull” and one “Cuck”). Additional accounts require written approval.
Creating duplicate accounts to bypass restrictions, or transferring assets between self-owned accounts, is forbidden.
Each account must represent one real person. Detection of multi-account abuse may result in permanent bans.
23) Non-Deletable User Account Policy.
Standard “User” ranks cannot delete accounts to avoid rule enforcement. They may instead self-ban their profile, which blocks login and IP.
“Verified” or higher ranks may request deletion with a mandatory 7-day cooldown.
Users requesting removal of their email may contact [email protected] citing their username.
24) Indemnification and Liability.
You agree to indemnify, defend, and hold harmless 321C, its owners, agents, employees, and affiliates from any claims, damages, or expenses (including attorneys’ fees) arising from:
(a) any content you post;
(b) any misuse of the Service;
(c) your breach of these Terms; or
(d) violations of local, national, or international law.
321C acts solely as an intermediary hosting service and shall not be considered the publisher of user-generated material.
We remove illegal content upon notice, but are not responsible for user statements, uploads, or opinions.
25) Limitation of Liability.
To the maximum extent permitted by applicable law, 321C disclaims all liability for any kind of damages or losses (including direct, indirect, incidental, consequential, special, punitive, exemplary, or reputational harms), whether in contract, tort, or otherwise, arising out of or related to the Service, your use, or your inability to use the Service.
Where liability cannot be fully excluded under mandatory law (e.g., for willful misconduct or gross negligence), 321C’s total aggregate liability shall be limited to the lowest amount permitted by law (which may be €0; if a positive minimum is required, then €1).
26) Transparency and Moderation Policy.
321C maintains transparency in moderation actions. Users are notified upon removal or suspension unless doing so would obstruct law enforcement.
We may issue community updates summarizing volume of reports and actions, consistent with EU DSA transparency obligations.
27) Modifications.
We may modify these Terms at any time. Notice of changes will appear here or via email. Continued use after modification constitutes acceptance.
28) Communications.
By using the Platform, you consent to receive service emails regarding updates, policy changes, or safety alerts. Marketing emails are sent only with opt-in consent.
29) Registration and Accuracy.
You must provide accurate, up-to-date information when registering and maintain it throughout use. 321C may revoke usernames deemed impersonating, offensive, or misleading.
30) Severability.
If any clause is found invalid or unenforceable, the remainder remains in full force. Invalid clauses will be replaced with legally valid equivalents reflecting the same intent.
31) Governing Law, Venue, and Arbitration.
These Terms are governed by Dutch law. Disputes shall be resolved under Dutch jurisdiction. Where arbitration is required, proceedings occur in the Netherlands under Dutch procedural rules.
321C reserves the right to cooperate with law enforcement globally under applicable treaties.
32) Operator and Contact.
