EULA
End User License Agreement ("Agreement")
Preamble: This Agreement governs the relationship between You, a natural person or a legal entity who you act on its behalf, and Superluminal, a company residing at Israel (Hereinafter: Licensor). This Agreement sets the terms, rights, restrictions and obligations on using Software created and owned by Licensor, as detailed herein.
Refusal: Should you refuse to accept this Agreement, you may not install Software, use it or convey it to any 3rd party, even if such party agrees to the terms set in this Agreement.
Trial and Adequacy: Other than when obtaining a license to a Trial Version of Software, You hereby state that you inspected Software thoroughly and found it satisfactory and adequate to Your needs, that it does not interfere with Your regular operation and that it does meet the standards and scope of Your computer systems and architecture. You hereby waive any claims regarding Software's incompatibility, performance, results and features, and warrant that You inspected the Software.
About Software:
License: Licensor hereby grants You a limited, personal, revocable, non-exclusive and royalty free license to use software in Your regular course of business and to process data, all with accordance to this Agreement and other legal restrictions set forth in 3rd party software used while running Software.
Use: You may use Software in one (1) graphic and compositing Application (hereinafter: 3rd Party Application), provided that it does not violate such application's end user license agreement. You shall solely possess any title, copyright or other legal right to any creation or work created by Software.
Revocation: This Agreement shall automatically be revoked and You shall not use, distribute, modify, or otherwise convey software, in any of the following cases:
Amendments or Modifications: Should you amend or modify Software, including creating any application that interacts with software in any other manner than its regular API, create a derivative work or otherwise add any code that may cause Software to act in a different manner than originally intended or add new features to it.
Decompiling or Disassembling: Should you decompile, disassemble or otherwise reverse-engineer Software in any other mean than as permitted under law.
Distribution: Should you distribute Software, including any piece of Software code or any derivative works thereof.
Lease: You may not lease, rent or otherwise allow 3rd parties to use software, or any portions thereof, nor you may allow 3rd parties to operate Software as a service, web-based application, leased product or any other mean where they are not entitled to do so under law.
3rd Party Adherence: Should You violate the 3rd Party Application's End User License Agreement, or otherwise perform any action that may cause 3rd Party Application's License revocation.
Keys: Licensor shall grant You an alphanumeric code that shall act as Your personal Key (hereinafter: Key). This Key shall be personal, non-transferable, revocable and limited to Your Adherence to this Agreement and to the Product purchased from Licensor, including number of Cores, CPUs, machines, clusters or processing time and time limit for using the software.
Right of First Sale: Nothing in this Agreement shall limit Your right to sell Software, under the terms of this Agreement, as long as You notify Licensor about the sell and reimburse Licensor for the cost of issuing a new Key.
Licenses: With respect of the terms and conditions herein, Your license shall include the following rights and obligations, all with accordance to the terms setforth to each type of license.
Trial: You may use Trial License of Software for (i) a limited time; (ii) the purpose of inspecting Software's adequacy to Your requirements; (iii) evaluating Software's performance.
Use: Your use of Trial Licensed Software is limited; You may not use the output of Trial Licenses of Software in order to create works that shall be sold, provided or conveyed to any 3rd party.
Insignias: You acknowledge that works created with Trial Licensed Software of Software may contain watermarks or other insignias in order to limit the use of Trial Version and the terms of this Agreement. You may not circumvent or otherwise amend works created under Trial Version to remove watermarks or insignias.
Limit: You may use Trial Licensed Software on 1 (one) CPU and unlimited number of cores, not including render-only computers or other services, and you may not use Trial Licensed Software to create Works compiled under Render Only Licenses.
Commercial: You may use a Commercial License for Software for (i) a limited time, or unlimited time, as allowed by your Key; (ii) to create works using 3rd party Applications; (iii) on a specified number of CPUs, CPU cores and systems as detailed in the Key purchased; (iv) on 2 additional render-only nodes per machines licensed under subsection (iii), which located on the same local network as the CPU and CPU cores stated in subsection (iii) .
Academic: You may use Software as detailed under the terms of a Commercial License, as long as it is solely used for Academic Purposes and no works created using Software are sold, created for or otherwise conveyed to any person apart from an Educational Institute as a part of a learning programme or to Yourself. You may use Software for academic research and publication, as long as Software and Licensor are properly credited.
Render-Only License: You may use Software as detailed under this EULA only on a Render-Only node, and with other licensed Software, where each license is for one node.
Non-Refundable: Licensor grants You a non-refundable license. You may not be refunded, under the extent permitted by law, should You refrain from using Software, terminate this Agreement under any terms, including termination or revocation by Licensor, or should it contain any defects. As Software is constructed from intangible goods, it may not be refunded for or returned to manufacturer.
Patents, Trademarks and Open Source: Software is protected by Patents and Patent Applications as detailed herein;
Patents: Licensor hereby grants you a limited and restricted license to use Patents contained in software solely during the use of Software. No license, neither implied or direct, is granted to use Patents for any other reason, software, work or licensed application.
Trademarks: Licensor retains his trademarks in all and any trademarks and tradenames contained, including Software's names, logos, and all other intellectual property. Unless specifically stated in this Agreement, no license shall be made to use, associate or affiliate Software with Yourself in any manner.
Open Source: You agree and warrant that without Licensor's prior written consent, You shall not use Software as a plug-in to any GPL Licensed Software or any software distributes under a similar license requiring that any amendment or modification to the software, including dynamic linking, shall be distributed or released under a license different from this Agreement.
Updates: Licensor may provide you, from time to time, with Upgrades, Updates or Fixes, as detailed herein. You hereby warrant to keep software up-to-date and install all relevant Updates and Fixes, and you may, at Your sole discretion, purchase Upgrades, according to the rates set by Licensor. Licensor shall provide any Update or Fix free of charge; however, nothing in this Agreement shall require Licensor to provide Updates or Fixes.
Upgrades: for the purpose of this Agreement, an Upgrade shall be a material amendment in Software, which contains new features and or major performance improvements and shall be marked as a new version number. For example, Should you purchase Software under version 1.X.X, an Upgrade shall commence under number 2.0.0.
Updates: for the purpose of this Agreement, an Update shall be a minor amendment in Software, which may contain new features or minor improvements and shall be marked as a new sub-version number. For example, Should you purchase Software under version 1.1.X, an Upgrade shall commence under number 1.2.0.
Fix: for the purpose of this Agreement, a Fix shall be a minor amendment in Software, intended to remove bugs or alter minor features which impair the Software's functionality. A Fix shall be marked as a new sub-sub-version number. For example, Should you purchase Software under version 1.1.1, an Upgrade shall commence under number 1.1.2.
Costs: Unless otherwise decided by Licensor, all Updates and Fixes shall be provided free-of-charge and without any additional costs; Upgrades shall be provided under Terms and costs solely decided by Licensor.
Support: Software is provided under an AS-IS basis and without any support or maintanance. Nothing in this Agreement shall require Licensor to provide You with support to any bug, failure, misperformance or other defect in Software. You may acquire Support and Maintenance from 3rd Parties specifically licensed by Licensor to provide such services; provided, however, that no liability shall be incurred on Licensor as a result of such transaction.
Bug Notification: You shall provide Licensor of details to any bug, defect or failure in Software promptly and with no delay from such event; You shall comply with Licensor's request for information regarding bugs, defects or failures and furnish him with information, screenshots and try to reproduce such bugs, defects or failures. Reporting shall be made either through the Software's “Report Bug” feature or through Licensor's appropriate page in website.
Feature Request:You may request additional features in Software, provided, however, that (i) You shall waive any claim or right in such feature should feature be developed by Licensor; (ii) You shall be prohibited from developing the feature by Yourself, or disclose such feature request, or feature, to any 3rd party directly competing with Licensor or any 3rd party which may be, following the development of such feature, in direct competition with Licensor; (iii) You warrant that feature does not infringe any 3rd party patent, trademark, trade-secret or any other intellectual property right; and (iv) You developed, envisioned or created the feature solely by Yourself.
Beta Testing: Upon Licensor's sole discretion, he may provide You with an option to participate in Software's Beta Testing (hereinafter: Beta). Should you Participate in Beta, You hereby warrant to keep all information in strict confidentiality, refrain from disclosing it to any 3rd party or use it in any manner, especially in manners directly competing with Licensor. You shall furnish Licensor with information relating to the Beta and Software's features, and remove all Software upon Licensor's request.
Liability: To the extent permitted under Israeli Law, the software is provided under an AS-IS basis. Licensor shall never, and without any limit, be liable for any damage, cost, expense or any other payment incurred by You as a result of Software, Software's failure, Software's bugs and/or any other interaction between Software and Your end-equipment, computers, other software or any 3rd party services.
Warranty: Software is provided without any warranty; Licensor hereby disclaims any warranty that the Software shall be error free, without defects or code which may cause damage to Your computers or to You, and that the Software shall be functional. Licensor hereby warrants that the software does not violate or infringe any 3rd party claims in regards to intellectual property, patents and/or trademarks and that to the best of its knowledge no legal action has been taken against it for any infringement or violation of any 3rd party intellectual property rights.
Indemnification: You hereby warrant to hold Licensor harmless and indemnify licensor for any lawsuit brought against it in regards to Your use of Software in means that violate, breach or otherwise circumvent this Agreement, Licensor's intellectual property rights or Licensor's title in Software. Licensor shall promptly notify you in case of such legal action and request Your consent prior to any settlement in relation to such lawsuit or claim.
Termination: Licensor may terminate this Agreement, including Your license in the case where You (i) became insolvent or otherwise entered into any liquidation process; or (ii) exported Software to any jurisdiction where licensor may not enforce his rights under this agreements in; or (iii) You were in breach of any of this Agreement's terms and conditions and such breach was not cured, immediately upon notification; or (iv) You were in breach of any of the terms of clause 2 (License) to this Agreement; or (v) You otherwise entered into any arrangement which caused licensor to be unable to enforce his rights under this Agreement.
Governing Law, Jurisdiction: This Agreement shall be solely governed by the Laws of the State of Israel, and any dispute arising from it shall be brought only to the competent courts of the Tel Aviv district. You hereby agree not to initiate class-action lawsuits against Licensor in relation to this Agreement and to compensate Licensor for any legal fees, cots or attorney fees should any claim brought by You against Licensor be denied, in part or in full.

We, at Superluminal, respect your privacy and are committed to protecting your personal data.
We believe that you have a right to know our practices regarding the data we may collect and use about you when you use our service.
Please read the following carefully to understand our views and practices regarding your personal data and regarding how we treat it.
In summary, when using the service, we may collect some personal data, all in order to provide you with the services and to improve it. We may also send you out questionnaires to improve the services; you are not obligated to answer those questionnaires.
We may use third party services to run the service; they have access to some of your personal data under a confidentiality obligation.

As an Israeli entity, we are GDPR compliant. About this Privacy Policy
This privacy policy was set up to let you know what personal data is collected. When we say Personal Data we mean personal data as defined in the GDPR, which is the EU Directive for data protection. While we are not based in the EU, we decided to grant all our users the best protections available under law, which provide them equal rights to the persons residing in the EU, even if they are not residents of the EU. Also, we’ve done our best to adhere to the California Consumer Privacy Act of 2018, and therefore we do not sell your data; and we give you Californian rights even if you do not reside in California.
Who Are We?
Superluminal LTD is the legal entity operating the service. It is located at 20 Amos St., Tel-Aviv.
Your Acknowledgment of this Policy
You are not legally required to provide us with any personal data. This means that if you provide us with data, you are doing so out of your own volition and consent; we cannot force you to provide any personal data, but without your personal data we cannot provide you with the services.
We can only collect personal data when you are connected to the internet. If you do not want us to collect personal data, please use the software and services on a machine which is not connected.You have the right to withdraw from this consent at any time, and in such case request that we either cease processing your personal data, or that we delete whatever personal data is no longer required to retain under law. However, in such a case we will need to terminate your license.
Which Personal Data Do We Collect About You?
We collect these types of personal data:
Non-personally identifiable Data. The first type is non-personally-identifiable data and statistical information. Non-personally identifiable data that is being gathered consists of technical information and behavioral information that does not pertain to a specific individual (“Non-Personal Data”). This includes your product ID and version, your license status, your approximate geolocation, your host data (software that you use), your host version, whether it is a full version or just a rendering node, and the number of nodes.
Technical Data that might be de-anonymized. Technical information is also collected. This includes your operating system type and version, your CPU type, speed and the number of processors, your RAM size, electricity consumption and list of GPUs. While it is not specifically personally identifiable, it may be reverse-engineered to be identifiable and therefore is considered personal data.
Usage Data. Usage data that may include your search queries performed in the Superluminal preset browser and the presets used, and your activities on the services and additional information of a similar nature. This data is not stored in a manner that relates to your user ID or other identifier, but is attached to a random identifier that is reset at every run of the service.
Personally Identifiable Data. The other type of data we collect is individually identifiable data. To put it simply, this data identifies an individual or is of a private and/or sensitive nature, such as your contact information, including: (i) Personal Data that is provided by you voluntarily, such as your username, email address and other data you filled when signing up or when answering our questionnaires; and (ii) Personal Data we learn from your use of the services; including your IP address, your hashed computer ID and MAC, your license number and type.
Website Related Data. When using our website we may retain personal data relating to your usage of the website, including: (i) personal data that is submitted in the forms, such as your name and email address; (ii) personal data relating to the use of the websites. Payment is made via a third party processor.
We may collect additional personal data in our questionnaire, which is provided to you in respect to your participation in our promotional activities.
How Do We Collect Personal Data?
Personal data is collected from your use of the services and by filling out forms and questionnaires. We do not buy personal data from third parties and do not collect it in any other way.
What Are The Purposes of the Collection and Processing of Data?
The purposes of collecting and processing the data are to provide you with the services. Meaning, we use your data to answer your queries, verify your license and ensure no fraud takes place, understand what computer resources are needed and how to allocate them and similar issues.
Moreover, we may use the personal data to improve the services. This means that we use aggregated understandings of how our users interacted with our services to obtain insights that lead to the improvement of future versions, bug reports, and feature requests.
We may also use your email address to send you information relating to our services and promotional material.
How Can We Contact You?
If you registered to our newsletter, or if you purchased a license or a trial version, we may contact you with periodic updates relating to the service and promotional email messages. You may opt out of these at any time.
Your Personal Data Rights
Right of Access and Rectification
You have the right to know what personal data we collect about you and to ensure that such data is accurate and relevant for the purposes for which we collected it. You can receive a copy of your personal data, and to rectify such personal data if it is not accurate, complete, or updated. However, we may first ask you to provide us with certain credentials to permit us to identify you before rectifying, deleting, or reviewing.
Right to Delete Personal Data or Restrict Processing
Right to Withdraw Consent.
You have the right to withdraw your consent to the processing of your personal data. Exercising this right will not affect the lawfulness of processing your personal data based on your consent before its withdrawal. Please note that in most cases, withdrawal of your consent would most likely cause us to delete your personal data rather than cease processing.
You have the right to delete your personal data or restrict its processing by ourselves and third parties. We may postpone or deny your request if your personal data is in current use for the purposes for which it was collected or for other legitimate purposes such as compliance with legal obligations.
Right of Data Portability.

The Right to Lodge a Complaint
You also have the right to lodge a complaint with a data protection supervisory authority regarding the processing of your personal data.
Your California Privacy Rights and Do Not Track Notices
We do not convey your personal data to third parties for direct marketing purposes.
However, if we did, then the California Civil Code Section 1798.83 permits our customers who are California residents to request certain information regarding its disclosure of personal data to third parties for their direct marketing purposes.
To make such a request, please send an email to [email protected] , and we will let you know that none of your personal data was shared. We are only required to respond to one request per customer each calendar year.
We respond to “Do Not Track” signals.
If you do not wish your browser to allow us to use trackers, please use your browser’s “Do Not Track” option.
Exercising Your Rights
We acknowledge you have the right to access and change the Personal Data we collect and process. If you wish to access or to correct, amend, or delete Personal Data, please send us an email to: [email protected] and we will respond within a reasonable timeframe, but in any event no later than permitted by applicable law.
Additionally, please note that in order to ensure that you have as much control over your Personal Data and other information as possible, you may modify certain parts of your information by yourself in the service.
Sharing Personal Data with Third Parties
We respect your privacy and will not disclose, share, rent, or sell your Personal Data to any third party.
The sharing of your Personal Data is made upon your specific, explicit, request.
Moreover, in order to operate the service, we need to share your personal data with third parties, which are our hosting companies. Our servers are hosted on GoDaddy’s secure cloud and operate in accordance with their data processing agreement, available here.
When using our website, we may use Google Analytics to better understand our users, and payment gateways. Each of these has their own respective privacy policy and is required to keep your personal data secure. We also use Facebook’s advertising services and implement their tracking pixel.
Postmark and MailChimp are used to send our customers with license information and periodic mailings.
Location of Your Data
The personal data collected from you, as detailed in this Privacy Policy, may be transferred to, and stored at, servers that may be located in countries outside of your jurisdiction and in a country that is not considered to offer an adequate level of protection under your local laws.
It may also be processed by us and our suppliers, service providers or partners' staff operating outside your country.
We are committed to protecting your Personal Data and will take appropriate steps to ensure that your Personal Data is processed and stored securely and in accordance with applicable privacy laws, as detailed in this Privacy Policy. Such steps include putting in place data transfer agreements or ensuring our third-party service providers comply with our data transfer protection measures.
We will ensure the confidentiality, integrity and availability of your Personal Data by Transferring your personal data only to (i) countries approved by the European Commission as having adequate data protection laws; (ii) entities that executed standard contracts that have been approved by the European Commission and which provide an adequate level of high-quality protection, with the recipients of your Personal Data; and (iii) Transferring your Personal Data to organizations that are Privacy Shield Scheme certified, as approved by the European Commission.
By submitting your personal data through the service, you acknowledge, and agree, in jurisdiction where such consent is required, to such transfer, storing and/or processing of personal data.
Minors / Children
The service is intended for users over the age of eighteen, or children over sixteen who obtained parental consent.
Therefore, we do not intend and do not knowingly collect directly Personal Data from children under the age of sixteen (16) and do not wish to do so.
We reserve the right to request proof of age at any stage so that we can verify that minors under the age of sixteen (16) are not using the service.
If we learn that we collected Personal Data from minors under the age of thirteen (13) we will delete that data as quickly as possible.
If you have reasons to suspect that we collected Personal Data from minors under the age of sixteen (16), please notify us at [email protected] , and we will delete that personal data as quickly as possible.
Third-Party Service Providers and Third-Party Software
While using the services we may be using third-party service providers, who may collect, store and/or process your personal data, as detailed in this Privacy Policy.
Note that we collect, hold and/or manage your Personal Data through our authorized third parties whom are vendors of certain products or services (such as hosting cloud services) (including, as applicable, their affiliates) solely and limited to providing us with such requested services, and not for any other purposes.
Security
We take appropriate measures to maintain the security and integrity of our service and prevent unauthorized access to it or use thereof through generally accepted industry standard technologies and internal procedures.
Please note, however, that there are inherent risks in transmission of information over the Internet or other methods of electronic storage and we cannot guarantee that unauthorized access or use will never occur.
We will comply with applicable law in the event of any breach of the security, confidentiality, or integrity of your Personal Data and will inform you of such breach if required by applicable law.
To the extent that we implemented the required security measures under applicable law, we shall not be responsible or liable for unauthorized access, hacking, or other security intrusions or failure to store or the theft, deletion, corruption, destruction, damage, or loss of any data or information included in the personal data.
Data Retention
We will retain the Personal Data for as long as we believe that it is accurate and can be relied upon. Personal Data that is no longer required for the purpose for which it was initially collected will be deleted unless we have a valid justification to retain it that is permitted under applicable law, such as to resolve disputes or comply with our legal obligations.
Data Breach Notification
We comply with local authorities in data breach notifications. In any case where a severe data breach occurred, we will also notify data subjects after such breach, and cooperate with the legal authorities to reduce the exposure of personal data.
Complaints and Arbitration.
If you feel or believe that your personal data rights were harmed in any way or form, you may contact our data protection officer at [email protected] and lodge a complaint. Such complaints shall include how and why you believe your personal data rights were harmed, and the required evidence. Our data protection officer will respond to most complaints within 14 days, and shall offer the required remedies.
We will resolve all complaints according to applicable regulations. We also agree to resolve all complaints and deal with disputes with the local data protection authorities.
This section does not limit your right to lodge a complaint with your respective data protection authority.
Updates to the Privacy Policy
We reserve the right to amend this Privacy Policy at any time; we will provide you with updates on any change, and such updates shall not have a retroactive effect.

Integrating the world renowned openVDB technology seamlessly into Stardust, Volume objects can easily be created. Convert entire particle systems and models to volumes, and manipulate the result with various tools such as booleans, filters, noise and more.

Render 3D Models

Particles
