Apache problem

I am having a problem with Apache on Debian 4.0 and I hope this is an okay place to ask about it.
For background, I am trying to get an installation of the LJ code working on my server.
I am running Apache 1.3.34 when I try to restart apache I get the following error:
Well I get that when I try to start it. It will start successfully (or so it says) but when I try to stop it I get that message. Now I've gone through every file I could find to make sure that the PID file location was the same but I am obviously missing something. Any help would be greatly appreciated.

/usr/sbin/apachectl stop: httpd (no pid file) not running
Well I get that when I try to start it. It will start successfully (or so it says) but when I try to stop it I get that message.
