As construction law experts, we assist in mitigating the risks associated with large-scale construction projects by drafting, reviewing, and negotiating contracts between the parties to minimise risks and ensure protection.
In addition, NSDV Law offers bespoke construction law services such as our Contract Management Service (CMS), which assists with the day-to-day management of the contract, helping avoid disputes, delays, defects, and budget overruns.
The type of projects we typically deal with are large-scale infrastructure developments, ranging from power stations, renewable energy projects, roads, rail and ports infrastructure, plus processing plants and infrastructure projects for large mines in South Africa, Africa, and abroad.

to building greatness
Our NSDV Law construction team predominantly services mining and construction companies including employers, contractors, subcontractors, engineers, consultants, and project managers in both large-scale, and smaller-scale construction projects both locally, across Africa and abroad.
We assist in drafting, reviewing, and negotiating bespoke EPC, EPCM, O&M, Design/Build, and Design, Build and Operate contracts. The team also has extensive experience in drafting and negotiating standard construction contracts, including NEC (NEC3 and NEC4), FIDIC, JBCC, and GCC contracts.
Our construction lawyers assist with disputes arising from construction contracts, whether it be adjudications, arbitrations, or litigation. And our in-house Environmental Assessment Practitioner together with our environmental team, supports the construction team with all environmental-related aspects of construction projects.
Construction law disputes typically arise from three things: time, money and quality of work. The NSDV Law construction team has significant experience in dealing with payment disputes and disputes arising from delays. In addition to these typical construction disputes, we often deal with disputes arising from termination of contracts and defects in relation to the Works on large construction projects.
Our team supports every phase of construction projects by offering both front-end and back-end legal services. We handle everything from drafting, negotiating, and reviewing the construction contracts that lay the foundation of any construction project, to managing legal proceedings in court, adjudications, and arbitrations, as disputes frequently arise throughout the lifecycle of construction projects.
Our bespoke construction contract management service helps commercially manage construction projects on an ad hoc basis. In addition, we offer construction contract training to equip teams with the knowledge to manage projects effectively and avoid disputes.
Our team will guide you through the complexities of construction law across Africa, offering strategic solutions for resolving disputes and navigating contract issues.
Whether through adjudication, arbitration, settlement agreements, or court proceedings, we specialise in resolving disputes related to FIDIC and NEC-based agreements. Our proactive approach ensures that you stay ahead of legal reforms and policy shifts, keeping you compliant and competitive in Africa’s dynamic market. Think of us as your travel buddy, guiding you through the African (legal) terrain.
