Authorization to Process Personal Data

1. PARTY RESPONSIBLE FOR THE PROCESSING OF PERSONAL DATA:

1.1. Procesadora Nacional de Alimentos C.A. PRONACA (hereinafter “PRONACA”) with address at Av. de los Naranjos 4415 and Av. Granados, in accordance with the provisions of the Organic Law on Personal Data Protection and the Regulations to the law, is responsible for the processing of my personal data.

1.2. PRONACA has issued this authorization for the utilization of my personal data, thereby enabling the processing of such data in the context of maintaining a business relationship with PRONACA, with the purpose of guaranteeing my right to the protection of my personal data and consenting to its processing in terms detailed in this instrument.

2. PERSONAL DATA PROTECTION NOTICE:

2.1. In compliance with the Organic Law on Personal Data Protection of Ecuador and the Regulations to the law, I am fully aware that PRONACA will process my personal data in connection with: a) the transactionality of the sale of products: PRONACA will process my personal data for the purpose of achieving the transactionality of the sale of its products, including the administration and issuance of commercial reports, b) the generation of commercial reports: PRONACA will process my personal data for the purpose of generating commercial reports for managerial and operational use of the organization, c) access to credit: PRONACA will process my personal data for the purpose of offering, granting credit, formalizing and legalizing it, its management, rescheduling and the granting and underwriting of guarantees, d) customer loyalty: PRONACA will process my personal data for the purpose of maintaining my business relationship with the organization, with the aim of providing exclusive benefits, e) the management of refrigeration equipment: PRONACA will process my personal data for the purpose of managing the placement of internal and external brand visibility material on refrigeration equipment. This processing of personal data is based on the fulfillment of pre-contractual, contractual and commercial obligations generated between the parties, as well as the legitimate interest of PRONACA. For product communication management, PRONACA will process my personal data for the purpose of communicating with me about new products, recipes, promotions, product handling, and relevant product information in order to encourage consumption, as well as for the analysis of my data for the design of commercial strategies, campaigns, and benefits, including individualized ones, aimed at customers, I give my free, unequivocal, and specific consent for the stated purposes. 2.2. I acknowledge that my personal data may be and will be disclosed to government agencies when necessary, when required by law, or as part of administrative or judicial proceedings. PRONACA will not transfer or disclose my data to third parties unless legally required to do so or with my consent.

2.3. I acknowledge that I can make inquiries or exercise my rights by sending an email to adminclientesdc@pronaca.com.

2.4. I acknowledge that PRONACA is committed to protecting the privacy and security of my personal data, treating it with the utmost care and in accordance with the legislation in force.

3. PROCESSING OF PERSONAL DATA:

3.1. PRONACA acknowledges that, in the exercise of its duties, it will have access to my personal data as detailed below:

3.2. I have been informed about PRONACA’s data protection practices and notice regarding the use of personal data.

3.3. In accordance with the Ecuadorian Personal Data Protection Law, PRONACA undertakes to maintain strict confidentiality and not to disclose, transmit, distribute, copy or use the information to which it has access in any way, except for the exclusive purposes detailed in the personal data protection notice.

4. CONFIDENTIALITY OBLIGATIONS:

4.1. I acknowledge and accept my obligations with the data of PRONACA’s representatives, administrators and employees and contractors, committing to comply with the Organic Law on Personal Data Protection and other applicable regulations.

5. STATEMENTS:

5.1. I state that I have been duly informed about PRONACA’s customer data protection policy, which details the processing of personal data that will be carried out in the context of the provision of services. I understand that this processing includes, but is not limited to, the collection, storage, use, transfer and deletion of my personal data. I hereby give my consent for PRONACA to process my personal data in accordance with the provisions of its data protection policy, its data protection notice and in accordance with the Organic Law on Personal Data Protection of Ecuador and the Regulations to the law.

5.2. I undertake to maintain the strictest confidentiality with respect to all personal information to which I have access in the performance of my duties. I acknowledge that this confidentiality obligation is essential to protect the privacy and data protection rights of the holders of such personal data. I agree not to disclose, copy, distribute or allow access to such data to third parties, except as permitted by law or PRONACA.

5.3. I agree and undertake to comply with all rules, policies, and procedures established by PRONACA regarding personal data protection, as well as with the provisions of applicable Ecuadorian regulations in this area. I acknowledge that any breach of these obligations may result in legal action.

5.4. This consent and confidentiality agreement shall remain in effect for the duration of my relationship with PRONACA and after the termination of such relationship, with regard to the confidentiality of personal data.

6. NON-COMPLIANCE WITH THE AGREEMENT:

6.1. I acknowledge that PRONACA reserves the right to take appropriate legal action in the event that I violate the confidentiality provisions set forth in this agreement and the Organic Law on Personal Data Protection and its implementing Regulations.
