DSTYPE Font Software End User License Agreement for Web Font Licenses. Read this document carefully and we recommend that you keep a copy for further reference.

1. Agreement

This End User License Agreement (hereafter the “License Agreement”) becomes a binding contract between you (the User) and DSType Unipessoal Lda, a company registered in Conservatória do Registo Comercial do Porto on 02-07-2007, with a capital of 5000 Euros, and the VAT number PT508223326, with corporate headquarters at Rua da Devesa 106, 4910-188 Dem, Caminha (hereafter “DSType”), when you install a Font Software for use on any Workstation. If you do not wish to be bound by the Agreement, you cannot access, use, or download the Font Software. Please read all of the Agreement before you agree to be bound by its terms and conditions.

2. License

DSType Unipessoal Lda grants the User, upon payment in full, a non-exclusive, non-assignable, non- transferable license to access the Font Software only for your Personal or Internal Business Use, and subject to all of the terms and conditions of the Agreement. The license varies according to the needs and choices of the User, from a list of available options, each with its authorizations and specifications (Desktop, Webfonts, Broadcasting, Apps/Mobile App, Electronic Documents/Epub). In any of the available licenses, the User has no rights to the font software other than as expressly outlined in the Agreement. You agree that DSType Unipessoal Lda owns all rights, title, and interest in and to the font software, its structure, organization, code, and related files, including all property rights therein, such as copyright, design, and trademark rights. You agree that the font software, structure, organization, code, and related files are valuable property of DSType Unipessoal Lda and that any intentional Use of the Font Software not expressly permitted by the Agreement constitutes a theft of valuable property. All rights not expressly granted in the Agreement, are reserved to DSType Unipessoal Lda.

3. Web License

The Basic Web License allows the use of the Font Software in ONE (1) Domain, for Self-hosting and up to TWO MILLION (2.000.000) Page Views per Month. The User can obtain a License Extension to use the Font Software on each additional domain not covered by the Basic Web License. This license Extension
is available for up to 50 Domains. Web License gives the right to print elements displayed on the screen containing the Typeface and generated based on and/or deriving from the Font Software. The editing of dynamic text by a third party is authorized. The User must always ensure that the installed Font Software is protected against any means of unauthorized access or unauthorized use.

4. Back-Up and Third-Parties

The User may make ONE (1) backup copy of the Font Software beyond the licensed copies, solely for the archiving process, and agrees to protect and control such copy. The User can provide a digitized copy of the font software used for a particular document to a commercial printer or service bureau for printing such document. The service bureau must destroy any copies of the Font Software upon completion of its work. In case of termination of the License Agreement, the User must immediately destroy the original and all copies of the Font Software under the conditions set in this agreement.

5. Copyright

The User may not redistribute the font software as part of any commercial product without obtaining a License Extension from DSType Unipessoal Lda authorizing you to do so. The User may not rent, lease, sublicense, give, lend, or further distribute the font software or any copy thereof, except as expressly provided herein. If you are unsure whether your use is permitted or not, contact DSType Unipessoal Lda for further information.

6. Modifications and Derivative Work

The User may not adapt, modify font spacing and kerning, create additional weights, modify existing characters, delete existing characters, or otherwise change the font software, or create derivative works from the font software or any portion thereof in exchange for a separate fee or other consideration without first obtaining written permission from DSType Unipessoal Lda.

7. Embedding

The User may encode the font software in a secure electronic document for Previewing and Printing use only. As long as the fonts are in one domain, that domain can allow the font software may be used to create web documents in which the font software, or any part thereof, is embedded, regardless if the document is in a format that permits editing and alterations by the recipient of such document. The User undertakes to make all reasonable efforts to prevent the extraction of the Font Software, and in particular the setting up of links to the Font Software.

8. Pricing

DSType Unipessoal Lda may, from time to time, update the Product. Product upgrade pricing may apply.

9. Disclaimer and Limited Warranty

DSType Unipessoal Lda warrants the font software to be free from defects under regular use for 30 days from the delivery date, as shown on your receipt. DSType Unipessoal Lda shall have no responsibility to replace the product or refund the purchase if the failure results from an accident, abuse, misapplication, or other damage. DSType Unipessoal Lda does not grant further warranties than the liability of the font software and in no event be liable for any damages, including any lost profits or lost savings.

10. Termination

The Agreement shall automatically terminate upon failure by you or any of your authorized agents to comply with its terms. Upon termination, ALL copies of the font software, including backup copies, must be destroyed.
