Die Pipe Networks GmbH betreibt das Portal unter „pipehost.net" und „panel.pipehost.net". Kunden können Serverdienstleistungen mieten. Registrierung ist kostenlos, es werden Name, E-Mail, Passwort und zuletzt genutzte IP-Adresse gespeichert.Pipe Networks GmbH operates the portal at "pipehost.net" and "panel.pipehost.net." Customers may rent server services. Registration is free and requires name, email, password, and stores only the last used IP address.

§ II. Registrierung§ II. Registration
Teilnahmeberechtigt sind voll geschäftsfähige Personen und Unternehmen. Minderjährige benötigen die Einwilligung der Erziehungsberechtigten; PipeHost kann diese nachweisen lassen oder den Zugang einschränken.Available to fully capable individuals and legal entities. Minors require parental consent; PipeHost may verify or restrict access if necessary.

§ III. Leistungen§ III. Services
Gegen Gebühr stellt PipeHost Serverdienstleistungen mit frei wählbarer Laufzeit (mind. 30 Tage) bereit. Verfügbarkeitszusagen und Gutschriften bei deren Unterschreitung richten sich nach dem Service Level Agreement (SLA); zwingende gesetzliche Ansprüche bleiben unberührt.PipeHost provides paid server services with a minimum term of 30 days. Availability commitments and the credits for falling short of them are governed by the Service Level Agreement (SLA); mandatory statutory rights remain unaffected.

§ IV. Vertragsschluss und Zahlung§ IV. Contract Formation & Payment
Angebote im Portal sind unverbindlich. Der Vertrag entsteht erst mit Registrierung und Buchung. Preise gelten zum Bestellzeitpunkt. Informationen werden per E-Mail übermittelt. Laufzeiten verlängern sich automatisch, wenn nicht gekündigt.Portal listings are non-binding. Contract begins upon registration and booking. Prices at time of order apply. Details sent via email. § V. Guthaben§ V. Credit
Kunden können Guthaben in Euro aufladen, das sofort verfügbar ist. Auszahlungen sind ausgeschlossen; Guthaben verfällt nicht.Customers may top up euro credit, which is available immediately. Withdrawals are not possible; credit does not expire.

§ VI. Bezahlung§ VI. Payment
Zahlungen erfolgen über das Portal per angebotener Methode oder über Guthaben. Transaktionsnachweise stehen im Portal und per E-Mail zur Verfügung.Payments via portal using provided methods or existing credit. Transaction receipts available in portal and via email.

§ VII. Nutzungsbedingungen§ VII. Usage Rules
Missbräuchliche Ressourcennutzung (z. B. Mining, DDoS, Spam) ist untersagt und kann zur Sperrung oder fristlosen Kündigung führen. Die Fair Use Policy ist Bestandteil des Vertrags.Abusive resource use (e.g. mining, DDoS, spam) is prohibited and may result in suspension or immediate termination. § VIII. Haftung§ VIII. Liability
PipeHost haftet für Vorsatz und grobe Fahrlässigkeit unbeschränkt, bei einfacher Fahrlässigkeit nur für vorhersehbare Schäden. Haftung für entgangenen Gewinn ist ausgeschlossen.PipeHost's liability for intent and gross negligence is unlimited; for simple negligence limited to foreseeable damages. No liability for lost profits.

§ IX. Konto-Kündigung§ IX. Account Cancellation
Kunden können ihr Konto jederzeit zum Ende der Laufzeit kündigen. Bei Vertragsverstößen kann PipeHost das Nutzungsrecht entziehen. Daten werden auf Wunsch gelöscht.Customers may cancel their account at any time to the end of the term. PipeHost may revoke access for breaches. Data is deleted upon request.

Fair Use Policy

This Fair Use Policy ("Policy") ensures all PipeHost customers enjoy reliable, high-performance service by preventing excessive resource consumption and network abuse. Included traffic volumes are fair-use thresholds, not hard caps: services are never disconnected for exceeding them, and permanently higher requirements can be covered at any time by an individually agreed traffic commit or traffic package.

Dedicated Servers: the traffic volume stated on the respective server's order page (currently 50–100 TB/month depending on the configuration)

2. Resource Usage Guidelines

CPU: Sustained usage above 80% for 24–48 hours that impacts host stability is prohibited.
Memory & Disk I/O: Continuous 100% RAM or I/O saturation will be flagged for review.
Network Throughput: Full-port utilization (e.g. constant 3 Gbps) is only allowed if explicitly ordered.
Abuse: DDoS attacks, spamming, crypto-mining, or any activity harming other customers is forbidden.

3. Exceeding the Included Traffic

Warnings first: For cloud servers, usage warnings are shown in the customer panel as consumption approaches the included volume.
Cloud servers: If the included volume is exceeded, the network speed of the affected service is reduced until the end of the billing month. The service itself is not interrupted.
Dedicated servers: Traffic is not throttled. If a server repeatedly exceeds its included volume, we will contact you to agree on a traffic commit or traffic package.
Traffic commits: Customers with permanently higher requirements can agree an individual traffic commit or package with us at any time — before or after reaching the threshold.

Suspension or termination under this Policy applies only to violations of Section 2 (abuse), never to mere traffic overuse.

4. Port 25 (SMTP)

Outbound port 25 is blocked by default on all services to combat mail spam. If you need it, open a support ticket: our system automatically asks a few questions about your use case in the ticket, a staff member reviews the answers, and we open the port if everything is legitimate. This keeps our IP ranges clean, which benefits every customer who sends mail.

Service Level Agreement (SLA)

This SLA applies to cloud servers and dedicated servers ordered at pipehost.net and forms part of the contract. It defines the availability we commit to, what happens when we miss it, and how to claim. Colocation SLAs are agreed individually per contract.

1. Availability Targets

Network (PipeHost core network and upstream connectivity, measured at our network edge): 99.99% per calendar month
Cloud servers (host system including compute and storage): 99.9% per calendar month
Dedicated servers (power, network port and PipeHost-owned hardware): 99.9% per calendar month

Availability is calculated per affected service and calendar month: (total minutes − downtime minutes) ÷ total minutes.

2. What Counts as Downtime

Downtime is any period in which a service is fully unreachable or unusable for reasons within PipeHost's responsibility. It starts at the earlier of our monitoring detecting the failure or your support ticket, and ends when the service is restored.

Speed reduction under the Fair Use Policy is not downtime.
Partial degradation that leaves the service usable is not downtime.
Measurement reference is our network edge — problems inside your ISP or on transit paths outside our control do not count.

3. Hardware Replacement (Dedicated Servers)

If a PipeHost-owned hardware component fails, we begin the replacement within 4 hours of fault diagnosis, around the clock. Restoring data from backups is the customer's responsibility; RAID rebuild and OS reinstallation times are not downtime once the hardware is functional again.

4. Exclusions

The following do not count as downtime:

Announced maintenance (Section 6) and urgent emergency maintenance kept as short as possible
Failures caused by the customer: configuration, operating system, software, resource exhaustion, or actions of third parties using the customer's access
Suspensions under the Terms of Service or Fair Use Policy (abuse, non-payment)
Attacks that exceed the capacity of our DDoS mitigation despite its correct operation
Force majeure, including large-scale failures of power or carrier infrastructure outside our facilities' redundancy

5. Service Credits

If the monthly availability of a service falls below its target, you are entitled to a credit on that service's monthly fee:

Below target, at or above 99.0%: 10%
Below 99.0%, at or above 95.0%: 25%
Below 95.0%: 50%

Credits apply to the affected service only and are capped at 50% of its monthly fee per month.
Credits are applied to your next invoice; payout in cash is excluded.
For availability shortfalls, service credits are the exclusive remedy to the extent legally permissible. Mandatory statutory rights, in particular of consumers, remain unaffected.

6. Maintenance

Planned maintenance is announced at least 48 hours in advance and scheduled in the window 22:00–06:00 CET where possible. Emergency maintenance to avert immediate risks (security, imminent hardware failure) may be performed without notice and is kept as short as possible.

7. Claiming a Credit

Open a support ticket within 30 days of the end of the incident, naming the affected service and the time window. We verify against our monitoring and apply the credit to your next invoice.

When you contact us via our website's contact form or by email, the data you provide is stored for six months for the purpose of processing your inquiry or any follow-up questions. Your data will not be shared without consent.

Data storage

To facilitate the purchase process and for subsequent contract execution, the webshop operator stores the connection holder's IP address, name, email address, postal address, telephone number, and IP addresses in cookies.

For contract processing, we also store: name, postal address, telephone number, and IP addresses.

The data you provide are necessary for contract performance and pre-contractual measures. A contract cannot be concluded without them. Data are not transferred to third parties except for:

Payment data (credit card information) to banks/payment providers
Data to the shipping company commissioned for delivery
Data to our tax advisor for fulfilling tax obligations

If you cancel the purchase process, we delete the stored data. If a contract is concluded, all data are retained for the statutory tax retention period (7 years). Name, address, purchased goods, and purchase date are further stored until the end of product liability (10 years). Processing is based on § 96 (3) TKG and Art. 6 (1)(a) (consent) and/or (b) (contract performance) GDPR.
