Privacy Policy
Mark Studios, LLC · Effective October 29, 2026
1. Who we are
This policy explains how Mark Studios, LLC, a Florida limited liability company (“Mark Studios”, “we”, “us”) handles personal information on markstudios.com, start.markstudios.com (our quoter, checkout and plans), strategy.markstudios.com (the Strategy Generator) and the client portal, and when you work with us. We are the controller of this information.
Email: contact@markstudios.com · Mail: Mark Studios, LLC, 7901 4th St N, Ste 300, St. Petersburg, FL 33702, USA. We have not appointed a Data Protection Officer or an EU/UK representative, because the law doesn’t require one for what we do.
2. What we collect
Information you give us
- Contact details: name, email, and phone if you give it, from our forms, the quoter, checkout, email and calls.
- Your project: your quoter answers (they are the brief), messages, links, and the footage, photos and files you upload or share.
- Orders and billing: what you bought, amounts, billing address and your typed signature on a proposal. Card details go directly to Stripe; we never see or store your full card number.
- Optional answers: “How did you find us?” and, if you paste it, the question you asked a search or chat assistant that suggested us.
- Strategy Generator: your YouTube channel link, competitor channels, goals and notes, and your email for delivery.
- Affiliates: name, email, referral code and payout address (PayPal or Wise), and any tax form we ask for before paying commissions.
- Email list: your email, if you sign up for updates, the newsletter or a free resource.
Information collected automatically
- IP address, browser and device details, and approximate location derived from your IP.
- Pages you view, the site that sent you, and campaign tags or ad click IDs in the link you used (such as utm_source or gclid).
- Cookies and similar storage, described in section 7.
Information from others
Marketplaces you hired us through (Fiverr, Upwork) share your order details with us. If an affiliate referred you, we learn their referral code. If you send us footage showing other people, we process their images and voices only to do the work you asked for, on your behalf.
Giving us your email is needed to send your quote or deliver an order; without it we can’t do the work. Everything else is optional.
3. Why we use it, and our legal bases
If you are in the EU, EEA, UK or Switzerland, the law requires a legal basis for each use. Here they are:
| What we do | Legal basis (GDPR / UK GDPR) |
|---|---|
| Price your quote, take payment, deliver the order or plan, run your portal account, support you | Contract, or steps you asked for before one (Art. 6(1)(b)) |
| Keep billing, tax and accounting records | Legal obligation (Art. 6(1)(c)) |
| Handle and confirm a withdrawal from a contract (EU, EEA, UK and Swiss consumers) | Legal obligation (Art. 6(1)(c)) |
| Send up to 3 reminders about a quote you started, answer questions you send us | Legitimate interests: following up on a request you made (Art. 6(1)(f)). You can object any time; every reminder has a one-click unsubscribe. |
| Security, spam and fraud checks, rate limits, server logs, defending legal claims | Legitimate interests: keeping our services safe and working (Art. 6(1)(f)) |
| Learn how people find us (first visit source, the optional “how did you find us” answer) | Legitimate interests: understanding which channels work (Art. 6(1)(f)) |
| Newsletter and marketing emails | Your consent (Art. 6(1)(a)); withdraw any time with the unsubscribe link |
| Google Analytics cookies and Google advertising features | Your consent (Art. 6(1)(a)), asked in our cookie banner |
| Showing finished work in our portfolio | Contract and your consent under our Terms; you can opt out any time |
| Paying affiliates and keeping their tax records | Contract (Art. 6(1)(b)) and legal obligation (Art. 6(1)(c)) |
We don’t make decisions about you based solely on automated processing that have legal or similarly significant effects. Our prices come from fixed pricing rules, and we set the price of individually quoted items.
4. Who processes it for us
We share personal information only with these kinds of service providers, who act on our behalf:
| Provider | What it does for us | What it receives |
|---|---|---|
| Payment processor (Stripe) | Payments, subscriptions, invoices, the billing portal, and our customer records | Contact details, quote summary and brief, order and payment data, first-visit source |
| Hosting and storage providers | Hosting our sites, storing uploads, drafts and order records, scheduled jobs, rate limits and logs | Everything sent to our sites, including uploaded files; IP address or email as a rate-limit key |
| Email delivery provider | Sending our emails (quotes, receipts, delivery, reminders, newsletter) and holding our email list | Name, email, email content |
| Analytics (Google Analytics) | Measuring how our sites are used | Usage data and cookie IDs |
| Business software and cloud services | Our email inbox, documents and files, and the software and cloud tools we use to make and deliver your project | Your emails, order details, and the files and briefs you send us |
| Automated text tools | The optional helper in our quoter that pre-fills answers from a sentence you type, and the Strategy Generator’s document writing | The text you type into that helper; public channel data and your notes for the Strategy Generator. Don’t include confidential information: some providers keep inputs under their own terms. |
| YouTube (Google) | Public channel data for the Strategy Generator (YouTube API Services), and embedded videos on some pages | The channel links you submit; viewing data when an embedded video plays |
| Content delivery and spam protection | Serving our example and portfolio videos, spam checks on our forms, and cookieless page-view counting when enabled | IP address, browser details |
| Call booking provider | Booking calls with us | Name, email and anything you add to a booking |
| Payout providers | Paying affiliate commissions; some client payments | Payee name, email and amount |
We also share information with marketplaces you hired us through, professional advisers (such as our accountant or lawyer), authorities when the law requires it, and a buyer or successor if our business is sold or reorganised. If an affiliate referred you, that affiliate can see your first name and the amounts you paid, so their commission can be tracked.
Other links: some links to Fiverr are affiliate links run through Fiverr’s partner platform (Impact). If you click one, Fiverr and Impact receive the click and may set their own cookies.
We do not sell personal information, including sensitive personal data, and we don’t share it for cross-context behavioural advertising.
Third-party tracking: on our sites, Google may collect information about your online activity over time and across different websites through Google Analytics cookies, but only after you accept them in the EU, EEA, UK and Switzerland, and you can turn them off anywhere with “Cookie settings” (section 7).
5. International transfers
We are based in the United States, and our providers process data in the US and other countries. When we transfer personal data from the EEA, UK or Switzerland, we rely on the EU-US Data Privacy Framework (and its UK and Swiss extensions) where the provider is certified, on the European Commission’s Standard Contractual Clauses (with the UK Addendum) in our providers’ data processing terms, or on an adequacy decision. Email us for a copy of the relevant safeguards.
6. How long we keep it
| Information | How long |
|---|---|
| Quotes and contact details of people who didn’t buy | 24 months after our last contact, then deleted |
| Saved quote drafts (cross-device resume links) | 90 days |
| Raw footage and working files you send us | 24 months after final delivery |
| Final deliverables | Up to 5 years, so we can re-send them and, where you allowed it, show them in our portfolio |
| Billing, invoice and tax records | 7 years |
| Records of your agreement to our terms, plan renewal consent and cookie choices | As long as we work together, plus 3 years |
| Free test edit requests (your name, email and the link you send) | 24 months after our last contact, then deleted |
| Withdrawal requests sent through our withdrawal form | 3 years, as a record of your request, then deleted |
| Newsletter and marketing list | Until you unsubscribe. We then keep your email on a do-not-send list so we never email you again |
| Server and application logs | Up to 30 days |
| Google Analytics data | 14 months |
| Affiliate records | While you are an affiliate, plus 7 years for payout and tax records |
You can ask us to delete project files or other information sooner. We keep what the law requires us to keep (such as tax records).
7. Cookies and similar technologies
We use three kinds:
- Necessary: sign-in, checkout, security, saving your quote in your browser, and remembering your cookie choice. These are always on.
- Analytics: Google Analytics, to see how the sites are used.
- Advertising: Google’s advertising features for Analytics (such as Google Signals, used on markstudios.com), which let Google measure our ads and link visits to signed-in Google accounts.
EU, EEA, UK and Swiss visitors: we load analytics and advertising only after you accept them in our cookie banner. Rejecting is as easy as accepting. Everyone: change your choice any time with the “Cookie settings” link at the bottom of our pages. We don’t load advertising tags on checkout, the client portal or quote forms, and we don’t use the Meta (Facebook) Pixel or session-replay tools.
| Name | Set by | Purpose | Lasts |
|---|---|---|---|
| ms_consent | Mark Studios | Remembers your cookie choice (necessary) | 6 months |
| ms_session | Mark Studios (start) | Keeps you signed in to the client portal (necessary) | 30 days |
| ms_thanks_session | Mark Studios (start) | Shows your receipt after checkout (necessary) | 1 day |
| ms_via | Mark Studios (start) | Remembers which affiliate referred you, so they can be paid | 90 days |
| Browser storage (ms_v3_*, ms.first_touch, ms.last_touch) | Mark Studios | Saves your quote in progress and how you first arrived (stays in your browser; sent to us with a quote) | Until cleared; visit source 90 days |
| _ga, _ga_<ID> | Google Analytics | Distinguishes visitors and sessions (analytics) | Up to 400 days |
| Turnstile | Cloudflare (markstudios.com forms, withdrawal form, free-edit form) | Spam check (necessary) | Session |
Embedded YouTube videos and Cal.com booking pages may set their own cookies when they load; see their policies.
Do Not Track and Global Privacy Control
Browsers’ “Do Not Track” signal has no common standard, so we don’t respond to it. We do honour Global Privacy Control (GPC): if your browser sends it, we don’t load advertising tags or advertising features, and we treat it as a request to opt out of any sharing for advertising.
8. Emails we send
- Order emails (quotes you ask for, receipts, delivery, plan notices) are part of the service.
- If you start a quote and leave your email, we may send up to 3 short reminders. Each one has a one-click unsubscribe, and opting out stops them for good. We don’t send these reminders to people in the EU, EEA, UK or Switzerland.
- Newsletters and marketing emails go only to people who signed up, and every one has an unsubscribe link.
9. Your rights
Everyone can ask us to access, correct or delete their personal information, and to stop marketing emails. If you are in the EU, EEA, UK or Switzerland, you also have the right to restrict processing, to data portability, to object to processing based on legitimate interests, and to withdraw consent at any time (this doesn’t affect processing before you withdrew).
YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO OUR USE OF YOUR DATA FOR DIRECT MARKETING, AND WE WILL STOP.
To make a request, email contact@markstudios.com from the address we know you by. We reply within one month and may ask you to confirm your identity. You can review your orders by signing in to the client portal. You can also complain to your local data protection authority (in the EU, see the list at edpb.europa.eu; in the UK, the ICO at ico.org.uk). Nevada residents: we don’t sell covered information, but you may still send an opt-out request to the same email and we’ll reply within 60 days.
10. Security
We protect your information with encryption in transit, access controls and other reasonable safeguards, and files you upload are kept in private storage. No system is perfectly secure. If a breach affects you, we’ll tell you as the law requires.
11. Children
Our services are for adults and businesses. They are not directed to children under 13 (under 16 in the EEA and UK), and we don’t knowingly collect their personal information. If you think a child has given us information, contact us and we’ll delete it. Footage showing minors is processed only for the client who sent it, who confirms they have a parent’s or guardian’s consent.
12. Changes
We’ll post any update here with a new effective date. For material changes we’ll also tell clients and subscribers by email, or with a notice on the site, before they take effect.
