Virusdie LLC, provides this website located at Virusdie.com ("Virusdie.com" or "Virusdie"), all the content under this domain, certain related software, and its services to you subject to the following terms and conditions. By using Virusdie.com you agree to be bound by the latest amended versions of this Agreement ("Terms of Service", "Terms of Use", "Service Terms") and Virusdie's Privacy and Security Policy (see "Modifications" below).

Section 1: Accepting the terms

By using the information, tools, features and functionality located on Virusdie.com, through any Virusdie APIs, or through any software or other websites that interface with Virusdie.com or its APIs (collectively the "Service"), you agree to be bound by this Agreement, whether you are a "Visitor" (meaning you merely browse the Virusdie.com) or you are a "Member" (meaning you have registered with Virusdie). The term "you" or "User" refers to a Visitor or a Member. If you wish to become a Member and make use of the Service you must read this Agreement and indicate your acceptance during the Registration process. If you accept this Agreement, you represent that you have the capacity to be bound by it or, if you are acting on behalf of a company or entity, that you have the authority to bind such entity.

By accessing Service's materials User is bound to full and unconditional acceptance of this Public Offer Agreement and its Terms and Condition.

Section 2: Copyrights

All content included on Virusdie.com, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, as well as the compilation of that content into one, coherent website, is the property of Virusdie and protected by international copyright laws. Reproduction of the content of Virusdie.com without the written permission of Virusdie is prohibited.

Section 3: Trademarks and Servicemarks

The Virusdie logo, and other Virusdie graphics, logos, page headers, button icons, scripts, and service names are trademarks, certification marks, service marks, or other trade dress of Virusdie or its subsidiaries. Virusdie's trademarks, certification marks, service marks, and trade dress have inherent meaning and substantial value because of their restricted use. They may not be used in connection with any product or service that is not Virusdie's, in any manner without Virusdie's permission. All other trademarks not owned by Virusdie or its subsidiaries that appear on Virusdie.com are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by Virusdie or its subsidiaries.

Section 4: License to access Virusdie.com and services

In consideration for accessing Virusdie.com and the Service, Virusdie grants you a limited license to access and make personal use of the Website or/and grants you a limited, non-exclusive, non-transferable, non-sublicensable license to use the Service during the term for which you have purchased a plan ("Plan" shall mean a collection of manual services or/and automatic services along detailed descriptions available on URL's: https://virusdie.com and https://virusdie.com/tools/) to use the Service for the websites included in such plan (the "Covered Websites"). For purposes of this Agreement, a "Covered Website" shall mean a collection of files and documents used to display content via the Internet to those who access its Uniform Resource Locator ("URL"). This license prohibits your downloading (other than page caching) or modifying any portion of it, except with express, written consent of Virusdie. This license does not allow resale of Virusdie's services without Virusdie's written permission signed by Virusdie's Authorised Representative person in hard copies. You may not frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of Virusdie.com without express written consent of Virusdie. You may not use any meta tags or any other "hidden text" utilizing Virusdie's name or trademarks without the express written consent of Virusdie. Any unauthorized use automatically terminates the permission or license granted by Virusdie and may incur legal liabilities for any damages.

You are granted a limited, revocable, and nonexclusive right to create a hyperlink to any non-password protected directories. You may not use any of Virusdie's proprietary graphics or trademarks as part of the link without express written permission.

You (or/and User) do not have any rights to use the Service to include it in other software or a products and / or use Software to provide any services including to third parties, directly or indirectly, with or without profit extraction, without express written permission from Service.

Section 5: Accounts and Passwords

If you are issued an account, you are responsible for maintaining the confidentiality of your account and password, and you agree to accept responsibility for all activities that occur under your account or password. Virusdie reserves the right to, under its sole discretion, refuse service, suspend or terminate accounts, or otherwise restrict access to Virusdie.com and the Virusdie Service.

Section 6: Your content

You retain full copyrights in any materials served through Virusdie. Depending on the features you select, Virusdie may modify the content of your site. For example, Virusdie may detect any malicious or suspicious code in files and delete it or replace it with other code to keep it from blacklisted or to clean up it, or Virusdie may insert code to install Virusdie's WAF (Web Application Firewall) or provides other Virusdie's security services. Virusdie will make it clear whenever a feature will modify your content and, whenever possible, provide you a mechanism to allow you to disable the feature or restore modified files from backup.

Virusdie may but not required to save and keep and analyze all or a part of files were processed with Virusdie.com or Service, to use such files for any purpose. Virusdie.com and Service are not required to notify the User in any way about such use or processing or analysis and its results. The User does not have any direct or indirect rights to the results of such processing or analysis and any use thereof.

Section 7: Records of Virusdie.com visitor use and abuse

As a visitor to Virusdie.com and a user of the Virusdie Service, you consent to having your Internet Protocol address recorded and your activities monitored to prevent abuse.

Section 8: Records of your visitors

As part of the Virusdie Service, you may choose to protect and monitor the traffic to certain websites with Virusdie's WAF. In doing so, you acknowledge that Virusdie acts as your limited agent (and data processor in the EU context) to you for the purpose of providing Internet data and optimization services. You acknowledge that it is your responsibility to ensure that the use of Virusdie's Service is permitted under the laws of your jurisdiction and you agree to indemnify and hold Virusdie harmless if your use of the Service is in violation of local law. Where required by law, you agree to post a privacy policy on any that, at a minimum, discloses any and all uses of personal information that you collect from users including any information collected via the Service. You agree to indemnify and defend Virusdie from and against any and all claims stemming from your failure to comply with this provision and/or your failure or refusal to abide by the terms and provisions of any applicable privacy policies. You acknowledge that Virusdie may use this data to improve its service or enable other services (e.g., using visitor traffic logs or data posted through the service to detect threats so as to stop current or future attacks).

Section 9: Investigation

Virusdie reserves the right to investigate you, your business, and/or your owners, officers, directors, managers, and other principals, your sites, and the materials comprising the sites at any time. These investigations will be conducted solely for Virusdie's benefit, and not for your benefit or that of any third party. If the investigation reveals any information, act, or omission, which in Virusdie's sole opinion, constitutes a violation of any local, state, federal, or foreign law or regulation, this Agreement, or is otherwise deemed harm the Service, Virusdie may immediately shut down your access to the Service. You agree to waive any cause of action or claim you may have against Virusdie for such action, including but not limited to any disruption to your website. You acknowledge that Virusdie may, at its own discretion, reveal the information about your web server to alleged copyright holders or other complaintants who have filed complaints with us.

Section 10: Indemnity

You agree to indemnify and hold Virusdie, and its subsidiaries, affiliates, officers, agents, co-branders or other partners, and employees, harmless from any claim or demand, including reasonable attorneys' fees, arising out of your use of the Service, your connection to the Service, your violation of the Terms of Service, or your violation of any rights of another.

Section 11: Disclaimer of warranities and limitation of liability

VIRUSDIE.COM, THE VIRUSDIE SERVICE, AND DOWNLOADABLE SOFTWARE ARE PROVIDED BY VIRUSDIE ON AN "AS IS" AND "AS AVAILABLE" BASIS. VIRUSDIE MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF VIRUSDIE.COM, THE EFFECTIVENESS OF ITS SERVICES, OR THE INFORMATION, CONTENT, MATERIALS, OR PRODUCTS INCLUDED ON VIRUSDIE.COM. YOU EXPRESSLY AGREE THAT YOUR USE OF VIRUSDIE.COM, THE VIRUSDIE SERVICE, AND ANY DOWNLOADABLE SOFTWARE IS AT YOUR SOLE RISK. TO THE FULL EXTENT PERMISSIBLE BY APPLICABLE LAW, VIRUSDIE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT SHALL VIRUSDIE BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES (INCLUDING, BUT NOT LIMITED TO, PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES; LOSS OF USE, DATA, OR PROFITS; OR BUSINESS INTERRUPTION) HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY, WHETHER IN CONTRACT, STRICT LIABILITY, OR TORT (INCLUDING NEGLIGENCE OR OTHERWISE) ARISING IN ANY WAY OUT OF THE USE OF VIRUSDIE.COM, THE VIRUSDIE SERVICE, OR DOWNLOADABLE SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. VIRUSDIE MAKES REASONABLE EFFORTS, BUT DOES NOT WARRANT THAT VIRUSDIE.COM, THE VIRUSDIE SERVICE, ANY DOWNLOADABLE SOFTWARE, THE VIRUSDIE SERVERS, OR EMAIL SENT FROM ANY OF ITS DOMAINS ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. VIRUSDIE WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF THE VIRUSDIE.COM, THE VIRUSDIE SERVICE, OR VIRUSDIE DOWNLOADABLE SOFTWARE INCLUDING, BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, AND CONSEQUENTIAL DAMAGES. VIRUSDIE.COM NOT GUARANTEE SERVICE ACCESSIBILITY DURING ANY TIME. VIRUSDIE.COM CAN ADD AND DELETE SERVICES, PARTS OF THE SERVICE, FUNCTIONS OF THE SERVICE OR/AND ANY DOWNLOADABLE SOFTWARE WITHOUT USER NOTIFICATION WARNING AT ANY TIME.

You agree and understand that all your Premium plan purchases on Virusdie are NON-REFUNDABLE. If you purchase the Premium plan, then relevant amount to that plan will be charged from your balance monthly until your balance on Virusdie is enough for the next charge. After that, your account will be downgraded to the Free plan automatically.

Section 12: Termination and blocking policy

Virusdie's policy is to investigate violations of these Terms of Service and terminate repeat infringers. You agree that Virusdie may, under certain circumstances and without prior notice, immediately terminate your Virusdie account, any associated email address, and access to Virusdie.com and associated Services. Cause for such termination shall include, but not be limited to: (a) breaches or violations of the Terms of Service or other incorporated agreements or guidelines; (b) requests by law enforcement or other government agencies; (c) a request by you (self-initiated account deletions); (d) discontinuance or material modification to the Service (or any part thereof); (e) unexpected technical or security issues or problems; (f) extended periods of inactivity; (g) you have engaged or are reasonably suspected to be engaged in fraudulent or illegal activities; (h) having provided false information as part of your account; (i) having failed to keep your account complete, true, and accurate; (j) any use of the Service deemed at Virusdies sole discretion to be prohibited; (k) use of fraudulent payment methods; and/or (l) nonpayment of any fees owed by you in connection with Virusdie.com and associated Services. Further, you agree that all terminations for cause shall be made in Virusdie's sole discretion and that Virusdie shall not be liable to you or any third-party for any termination of your account, access to the Service, or any disruption to your services such a termination may cause. You expressly agree that in the case of a termination for cause you will not have any opportunity to cure. You further acknowledge and agree that notwithstanding any termination, your obligations to Virusdie set forth in Sections 2, 3, 4, 8, 9, 10, 11, 20, 21 and 22 shall survive such termination.

Examples of immediate account termination cases. You understand and agree that we reserve the right to block your account immediately with no refund if we found violations: (a) you cause harm to Virusdie due to reselling Virusdie' software or selling services backed with Virusdie less than the lower price available at Virusdie Pricing page directly to clients; (b) you offer, resell or sell LTDs (Life time deals or lifetime access) to Virusdie on your behalf without direct written permission with Virusdie; (c) you intergrate Virusdie into your own services or a software as a VAS (Value Additional Services) at dumped price (lower, than (the lower plan tier + 25%) available on Virusdie.com) without written permission with Virusdie; (d) you do not declare to your clients and/or partners that you use Virusdie to provide them your services if you use Virusdie for that. (e) you provide free of charge services (like website malware cleanup, security issues investigation, patch management, website protection) using Virusdie Tools (https://virusdie.com/tools/) to your clients or/and partners without written permission with Virusdie; (e) you simply resell Virusdie Tools (https://virusdie.com/tools/) at dumped price (lower, than the lower plan tier available on Virusdie.com) without written permission with Virusdie;

You understand and agree that if we find that you are using technical support requests to investigate incidents that are not related to your own websites (Own websites means websites that represent your own business in WEB), we reserve the right to block your account immediately. In this case, the funds in your account of Virusdie or any payments made by you at any time in favor of Virusdie will not be returned to you.

You will have thirty (30) days from the Service Commencement Date or any Renewal Commencement Date to cancel the Service (the "Cancellation Period"), in which case the Service will refund your Service Subscription Fee for the applicable Term provided that you have not submitted a Manual Malware Removal Request during the Cancellation Period or/and you have not sync ("Sync" means connect Covered Website to the Service when at least one of all automatic Service tools was available) your website with Service during the Cancellation Period. You agree that you will make any cancellation request by way of a general request ticket that you submit through the Service's ticketing system. Except as set forth above, your Service Subscription Fee shall be non-refundable.

Here at Virusdie, we believe that the purchase of a software license does not come with the right to treat Virusdie's employees and founders uncivilly under any circumstances, whether through Virusdie's technical support system or any other means of communication and distribution of information. For this reason, any user who communicates uncivilly (particularly when sending messages and replies to Virusdie technical support) will be warned that their conduct is inappropriate. Should a user continue to communicate with or treat Virusdie staff in an uncivil manner, that user may be immediately and permanently blocked. If this occurs, the user's software license will be immediately suspended, provision of all services to that user will be discontinued, and the user's site will be disconnected from Virusdie, including all features and options. All of the user's sites will be removed from their Virusdie panel. The user's technical support requests in our ticket system will be permanently locked. Neither the balance of the user's funds deposited with the service nor the user's referral program balance will be returned under any conditions. Decisions as to the particular communication or manner of speech deemed uncivil are made at the discretion of Virusdie staff communicating with the user, and blocking decisions are subjective. You can attempt to appeal a block by writing to [email protected].

Section 13: Modifications

Virusdie may modify this Agreement from time to time. Any and all changes to this Agreement will be posted on Virusdie.com. In addition, the Agreement will indicate the date it was last revised. You are deemed to accept and agree to be bound by any changes to the Agreement when you use the Service after those changes are posted.

Section 14: Links

The Service may provide links to other websites or resources. Because Virusdie has no control over such sites and resources, you acknowledge and agree that Virusdie is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any content, advertising, products, or other materials on or available from such sites or resources. You further acknowledge and agree that Virusdie shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content.

Section 15: Publicity

Virusdie shall be permitted to identify you as a customer, to use your website's name in connection with proposals to prospective customers, to hyperlink to your website's home page, to display your logo on the Virusdie's website, and to otherwise refer to you in print or electronic form for marketing or reference purposes.

Section 16: No third party beneficiaries

You agree that, except as otherwise expressly provided in this Terms of Service, there shall be no third party beneficiaries to this Agreement.

Section 17: Waiver

The failure of Virusdie to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision. If any provision of the Terms of Service is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the Terms of Service remain in full force and effect.

Section 18: Severability of terms

If any provision of the Terms of Service is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the Terms of Service remain in full force and effect.

Section 19: Non-transferabiliy of accounts

You agree that your Virusdie account is non-transferable except with the written consent of Virusdie.

Section 20: Applicable law

By visiting Virusdie.com, you agree that the laws of Georgia will govern these Conditions of Use and any dispute of any sort that might arise between you and Virusdie or its affiliates. Any dispute or claim arising out of or in connection with this Agreement shall be adjudicated in Tbilisi, Georgia.

Section 21: Fees and Payments

You agree that taking payments (payments for paid service) is provided by Paddle.com Market Limited ("Paddle")- is a company incorporated in England and Wales (company number 08172165). You agree with Paddle Terms of Use.

You agree that manual security issues investigation (Manual Malware Removal) services by Virusdie (to create automatic detection rules) available only on Premium plan and the same time available only if you have provided real evidence that a virus or malicious code is indeed present on your site and Virusdie do not detect it automatically. Such evidence may be: a list of absolute paths to files that contain viruses or malicious code; real malicicous activities on a site, such as a redirect to another site.

You understand and agree that Virusdie do not cover issues if malware or malicious code presence in your website' database - so not in website files. You can contact Virusdie technical support to fix this type of issues, but it is the right of Virusdie to investigate such issues or not. Virusdie can refuse to consider such requests.

You understand and agree that Virusdie do not provide any support for domain Blacklist investigation issues. This means that Virusdie do not accept any requests to tech support about blacklisted domains you may find by data provider. We understand that blacklisted domains may marked due many reasons by many data and service providers with some share of false-positive. And we believe that is not a malware issue, but reputation management and reputation risks not covered by Virusdie.

Section 22: Time limitations for claims

You agree that service offered free-of-charge (and/or offered for testing on a period; or offered for Free Trial period; or offered for Free Plan) are provided to User with no warranty and of a quality, in volume and with functions they possess in the Service. This principle implies that User shall not present claims, regarding availability, volume, quality or functions of the services offered free-of-charge and he/she takes all risks and responsibility for using these services.

You agree that paid service are considered to be fully complied with if the Service did not receive an extensive written claim within 5 (five) days after the end of the calendar month when the corresponding service was provided.

You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of Virusdie.com must be filed within one year after such claim or cause of action arose or be forever barred.

You agree that using Redemption codes (Activation codes or Redemption codes you may get from Virusdie or 3rd party providers or/and platforms or/and stores to use some types of Virusdie licenses (like Lifetime subscription, Annual subscription) with discounts or any benefits to a regular Virusdie pricingt or offerings) to Top Up balance on Virusdie and/or activate Premium plan or any paid plan in general for Virusdie, you cannot demand a refund in a larger amount than you actually paid real money, regardless of the amount of the balance on Virusdie. And the same time the maximum refund you can demand of only that amount from the funds actually paid by you that have not yet been charged from your balance on Virusdie.

You agree that Lifetime subscription means a subscription on Virusdie with autoprolongation at no additional cost if no changes on functions of the service or TMU; Annual subscription means a 1 year long subscription on Virusdie. And you agree Lifetime subscription and Annual subscription can be limited in terms of volume of your requests to Virusdie support or other services at the discretion of Virusdie and without your notice.

Section 23: Versions

The authoritative version of Virusdie's Terms of Service is available at: virusdie.com/rules/termsofuse/. While translations of these terms may be provided in multiple languages for your convenience, the English language version hosted at the link above is binding for all users of Virusdie.com, the Virusdie Service, and any Virusdie Downloadable Software.

Section 24: Communications

When you visit the Sites or send e-mails to us, you are communicating with us electronically. By doing this, you consent to receive communications from us electronically. We will communicate with you via e-mail or by posting notices on the Sites. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

Notwithstanding the foregoing, you understand and agree that e-mail communication is not secure, and therefore you agree that you will use the company's ticketing system to exchange all credentials, technical information and service specific support requests including but not limited to any malware removal requests for covered websites (each, a "malware removal request").

Section 25: Headings

The headings and section titles in the Terms of Service are for convenience only and have no legal or contractual effect.
