Terms & Conditions

Acceptance of Terms

By using Yibzer At The Table (the "Application"), these Terms and Conditions automatically apply to you. Please read them carefully before using the Application.

You are not permitted to copy, modify, reproduce, distribute, reverse engineer, or create derivative works based on the Application, any part of the Application, or any associated trademarks, logos, or intellectual property.

You may not attempt to extract the source code of the Application or otherwise interfere with its operation.

The Application and all related trademarks, copyrights, database rights, and intellectual property rights remain the exclusive property of YCS PR CORP.

Modifications to the Application

YCS PR CORP is committed to keeping the Application useful, secure, and efficient.

We reserve the right to modify, update, suspend, or discontinue any part of the Application at any time and for any reason.

We will not charge users for services without clearly disclosing any applicable fees before they are incurred.

Information, Orders, and Payment Processing

Yibzer At The Table does not require users to create accounts in order to use the Application.

To place orders and complete transactions, users may provide information including:

  • Customer name or identifier;

  • Order information;

  • Table or location information;

  • Any other information necessary to complete the transaction.

Information associated with orders and transactions may be retained by YCS PR CORP and shared with the merchant operating the location where the order is placed solely for purposes related to:

  • Order processing and fulfillment;

  • Customer service;

  • Dispute resolution;

  • Accounting and financial reconciliation;

  • Fraud prevention;

  • Compliance with legal and regulatory obligations.

Payments are processed through third-party payment providers.

Currently, payments are processed through:

  • VISA Cybersource – Unified Checkout

Payment providers may collect personal or financial information directly from users as required to complete secure payment transactions.

YCS PR CORP does not store complete payment card numbers, CVV codes, PINs, or other sensitive payment credentials.

YCS PR CORP may retain limited transaction information provided by payment processors, including transaction identifiers, payment status, authorization numbers, card brands, masked payment information, and other non-sensitive information necessary for operational, accounting, support, and compliance purposes.

Device Security

Users are responsible for maintaining the security of their devices and access to the Application.

We strongly recommend that users do not jailbreak or root their devices. Doing so may:

  • Remove important security protections;

  • Increase vulnerability to malware and viruses;

  • Affect the performance of the Application;

  • Prevent certain features from functioning properly.

YCS PR CORP is not responsible for issues arising from modifications made to a user's device.

Third-Party Services

The Application uses third-party services that operate under their own terms, conditions, and privacy policies.

Your use of those services may be subject to additional terms established by the applicable provider.

Participating Merchants

Yibzer At The Table provides a technology platform that facilitates ordering and payment transactions between users and participating merchants.

YCS PR CORP is not responsible for:

  • Food or beverage preparation;

  • Product quality;

  • Merchant services;

  • Product availability;

  • Delivery or preparation times;

  • Pricing, taxes, or fees established by merchants;

  • Any dispute arising from products or services provided by merchants.

Any claim regarding products, services, quality, availability, or order fulfillment must be directed to the merchant responsible for the transaction.

Internet Connectivity

Certain features of the Application require an active Internet connection.

The connection may be provided through Wi-Fi or a mobile network provider.

YCS PR CORP is not responsible for any interruption, limitation, or failure of the Application resulting from:

  • Lack of Internet access;

  • Poor network coverage;

  • Data plan limitations;

  • Network outages;

  • Service interruptions caused by third-party providers.

Mobile Data and Roaming Charges

When using the Application through a mobile network, your mobile service provider's charges and terms may apply.

You are solely responsible for any:

  • Mobile data charges;

  • Roaming charges;

  • International usage charges;

  • Other fees imposed by your provider.

If you are not the account holder responsible for the device being used, we assume that you have obtained authorization from the account holder.

User Responsibilities

Users are responsible for ensuring that their devices remain operational and adequately charged while using the Application.

YCS PR CORP is not responsible for service interruptions resulting from:

  • Battery depletion;

  • Device malfunctions;

  • User configuration errors;

  • Third-party hardware or software issues.

Limitation of Liability

While YCS PR CORP makes reasonable efforts to ensure that the Application operates correctly and that information made available through the Application is accurate, current, and reliable, some information may be provided by third parties.

To the maximum extent permitted by law, YCS PR CORP shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising from:

  • Use of the Application;

  • Inability to use the Application;

  • Reliance on information provided through the Application;

  • Actions or omissions of merchants or third-party providers;

  • Service interruptions or technical failures.

Changes to These Terms and Conditions

YCS PR CORP may revise these Terms and Conditions from time to time.

Updated versions will be posted within the Application or on related websites and will become effective upon publication.

Continued use of the Application after such changes constitutes acceptance of the revised Terms and Conditions.

Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Puerto Rico and applicable federal laws of the United States, without regard to conflict of law principles.

By downloading or using the app, these terms will automatically apply to you - you should make sure therefore that you read them carefully before using the app. You're not allowed to copy or modify the app, any part of the app, or our trademarks in any way. You're not allowed to attempt to extract the source code of the app, and you also shouldn't try to translate the app into other languages or make derivative versions. The app itself, and all the trademarks, copyright, database rights and other intellectual property rights related to it, still belong to YCS PR Corp.

YCS PR Corp is committed to ensuring that the app is as useful and efficient as possible. For that reason, we reserve the right to make changes to the app or to charge for its services, at any time and for any reason. We will never charge you for the app or its services without making it very clear to you exactly what you're paying for.

The Yibzer app stores and processes personal data that you have provided to us, in order to provide our Service. It's your responsibility to keep your phone and access to the app secure. We, therefore, recommend that you do not jailbreak or root your phone, which is the process of removing software restrictions and limitations imposed by the official operating system of your device. It could make your phone vulnerable to malware / viruses / malicious programs, compromise your phone's security features and it could mean that the Yibzer app won't work properly or at all.

The app does use third party services that declare their own Terms and Conditions.

You should be aware that there are certain things that YCS PR Corp will not take responsibility for. Certain functions of the app will require the app to have an active internet connection. The connection can be Wi-Fi or provided by your mobile network provider, but YCS PR Corp cannot take responsibility for the app not working at full functionality if you don't have access to Wi-Fi, and you don't have any of your data allowance left.

 

If you're using the app outside of an area with Wi-Fi, you should remember that your terms of the agreement with your mobile network provider will still apply. As a result, you may be charged by your mobile provider for the cost of data for the duration of the connection while accessing the app, or other third party charges. In using the app, you're accepting responsibility for any such charges, including roaming data charges if you use the app outside of your home territory (ie region or country) without turning off data roaming. If you are not the bill payer for the device on which you're using the app, please be aware that we assume that you have received permission from the bill payer for using the app.

Along the same lines, YCS PR Corp cannot always take responsibility for the way you use the app ie You need to make sure that your device stays charged - if it runs out of battery and you can't turn it on to avail the Service, YCS PR Corp cannot accept responsibility.

With respect to YCS PR Corp's responsibility for your use of the app, when you're using the app, it's important to bear in mind that although we endeavor to ensure that it is updated and correct at all times, we do rely on third parties to provide information to us so that we can make it available to you. YCS PR Corp accepts no liability for any loss, direct or indirect, you experience as a result of relying wholly on this functionality of the app.

At some point, we may wish to update the app. The app is currently available on Android & iOS - the requirements for both systems (and for any additional systems we decide to extend the availability of the app to) may change, and you'll need to download the updates if you want to keep using the app. YCS PR Corp does not promise that it will always update the app so that it is relevant to you and / or works with the Android & iOS version that you have installed on your device. However, you promise to always accept updates to the application when offered to you, We may also wish to stop providing the app, and may terminate use of it at any time without giving notice of termination to you. Unless we tell you otherwise, upon any termination, (a) the rights and licenses granted to you in these terms will end; (b) you must stop using the app, and (if needed) delete it from your device.

Changes to This Terms and Conditions

 

we may update our Terms and Conditions from time to time. Thus, you are advised to review this page periodically for any changes. we will notify you of any changes by posting the new Terms and Conditions on this page.

These terms and conditions are effective as of 2020-05-20.
