<p>The new <a href="https://www.hsa.ie/eng/publications_and_forms/publications/codes_of_practice/code_of_practice_safe_use_of_industrial_trucks.112982.shortcut.html" target="_blank" rel="noreferrer noopener">Code of Practice</a> for industrial trucks came into force on September 12, 2025. This isn&#8217;t just an update: it&#8217;s a new legal benchmark that could leave your business exposed to significant fines, costly damages, and even criminal proceedings. If you&#8217;re not compliant, you&#8217;re not protected.</p>



<h2 class="wp-block-heading"><strong>What Are The Risks And Why Update?</strong></h2>



<p>industry vehicles such as forklifts and heavy machinery can be extremely hazardous. They are heavy, powerful, and sometimes unpredictable. Since the creation of the initial code of practice, vehicles have evolved and improved drastically, but code of practice stayed the same, hence the update and change.</p>



<p>Some of the key statistics HSA shared.</p>



<ul class="wp-block-list">
<li>Between 2010 and 2019 44% of total fatalities involved vehicles and heavy machinery.</li>



<li>Just forklifts have contributed to 6% of total deaths.</li>
</ul>



<p>It&#8217;s also important to mention that incidents where personal injuries didn&#8217;t occur, still can be extremely costly when considering damages to vehicles, structures, and goods.</p>



<h2 class="wp-block-heading"><strong>Key Changes You Should Be Aware Of</strong></h2>



<p>The new code of practice brings new changes everyone should be aware of, and follow to stay compliant with the law and avoid legal and financial complications.</p>

<p>The new code of practice now requires that employers make sure that staff is properly trained, assessed, and given written permission to work. Additionally, supervisors now also must receive appropriate training.</p>

<li><strong>Mandatory Written Risk Assessments</strong></li>
</ul>



<p>Employers are now legally required to conduct a specific,&nbsp;written risk assessment&nbsp;for all industrial truck operations. This marks a critical shift from reactive management to a proactive, documented safety system. The assessment must go beyond the basics, meticulously identifying hazards, evaluating risks, and outlining specific control measures for your unique workplace &#8211; from traffic flow and pedestrian segregation to floor conditions and vehicle maintenance. This new requirement puts a clear responsibility on management team to formally plan and document a robust safety strategy, providing an auditable record that demonstrates due diligence and compliance</p>

<p>Medical fitness should now be considered for every employee. If an employee has a medical condition that may affect their ability to operate a vehicle/machinery, an occupational health assessment is recommended.</p>

<p>Employees should now be authorised in writing, by their employers to only operate those vehicles that they have been trained on.</p>

<h2 class="wp-block-heading"><strong>Introduction</strong></h2>



<p>It is no secret that most of us find Health &amp; Safety boring and sometimes we might even overlook its importance, compliance, and benefits to not only the business, but its employees. Compliance with Health &amp; Safety standards are essential to running successful business, not just because it&#8217;s a legislation, but also because it can save your business thousands of euro in potential fines and lawsuits. In this blog we will cover the most recent examples where businesses pay the price and how it could&#8217;ve been avoided.</p>



<h2 class="wp-block-heading"><strong>Examples #1</strong></h2>



<p>On March 19th 2024, Dublin Circuit Criminal Court finalised the case, where the accused pleaded to one charge, leading to fine of €600,000.</p>



<p>On October 28, 2021 at Behan&#8217;s Quarry, Co Dublin, person in control of a non-domestic place of work, failed to ensure that said place of work was safe and without risk to health. In there, that there was no adequate lighting for working outside of daylight hours, there was no traffic marshal in place during the refuelling process, there was no proper segregation of people.  plant, and machinery, and there was a failure to switch off plant &amp; machinery during the process of refuelling. Failure to put all those safety measured in place led to a person suffering personal injuries and dying.</p>



<h4 class="wp-block-heading"><strong>How could this have been avoided?</strong></h4>



<p>It is clear that this could have been prevented with basic, well-established safety controls. Everything from adequate lighting to traffic marshal controlling plant &amp; machinery should have been included in Safety Statements and followed by the staff.</p>

<h2 class="wp-block-heading"><strong>Example #2</strong></h2>



<p>On May 8th 2024, in Naas Circuit Court case was finalised where accused pleaded guilty to one charge, leading to a fine of €125,000.</p>



<p>On March 25, 2019 at Barrowford, Monasterevin Road, Athy, Co Kildare, the person in control of a non-domestic place of work failed to ensure the workplace was safe and without risk to health. The work at height platform system provided, which consisted of a forklift truck, improvised scaffolding towers and ladders. This was extremely unsafe, as it lacked sufficient edge protection and the wooden handrail on the top platform was defective and broke. As a result, a worker fell from height, sustained serious injuries, and later died.</p>



<h4 class="wp-block-heading"><strong>How could this have been avoided?</strong></h4>



<p>This incident was totally preventable, with adequate equipment, training, safety gear, and supervision this fatal fall would not have happened. This is another incident that shows how a proper risk assessments, safety controls, and compliance can prevent not only deer fines, but also safe lives. </p>

<h2 class="wp-block-heading"><strong>Example #3</strong></h2>



<p>On May 13th 2024, In Wexford Circuit Court, accused (the employer) has pleaded guilty to six charges, resulting in fine of €350,000.</p>



<p>On or around October 11, 2019 at Raheen, New Ross, Co Kilkenny, the employer failed to ensure that non-employees at the workplace were not exposed to risks to their safety, health, or welfare. Within the bagging and palletising plant, moving parts of machinery were not fitted with adequate guards or protective devices to prevent access to danger zones or to stop the machinery before contact could occur. As a result, an individual was exposed to the dangerous moving parts, sustained serious injuries, and died</p>



<h4 class="wp-block-heading"><strong>How could this have been avoided?</strong></h4>



<p>This tragedy could have been avoided if proper risk assessments had been carried out and reflected in the site’s Safety Statement. Such an assessment would have identified the need for fixed guards around moving parts, interlocked access doors to stop machinery when opened, and protection devices like light curtains, trip bars, or pressure-sensitive mats to prevent entry into danger zones.</p>

<h2 class="wp-block-heading"><strong>Common Pattern</strong></h2>



<p>Have you noticed the common pattern in all three accidents? Simple answer is &#8211; lack of compliance in all three cases</p>



<p>In all three cases the accidents and fines could&#8217;ve been avoided if company had proper risk assessments, safety statements, staff training, and equipment in place. In Ireland, for a business to be compliant with <a href="https://www.hsa.ie/eng/topics/managing_health_and_safety/safety,_health_and_welfare_at_work_act_2005/" target="_blank" rel="noopener">Health &amp; Safety legislation</a> it need to have the following: Safety Statement, Risk Assessments, Safe Systems of Work, Training, Safety Equipment, Record Keeping, and Monitoring. If you can&#8217;t show those things on paper and in practice &#8211; you&#8217;re not compliant.</p>

<p>For sprains, strains, or swelling, instant cold packs are a must. These cold compresses help reduce swelling and numb the area, providing immediate relief from pain after an injury. If cold pack is not available in your first aid kit, consider putting affected area under cold stream of water, or other alternatives.</p>

<p>By using this Risk Matrix, we can define the likelihood and severity of the hazard. To define its value, we first need to take how likely it is to occur, and then multiply by how severe it is. Meaning that, if the likelihood of the hazard is at 4, and its severity is 2, it gives us a value of 8, which puts it at medium risk. <h2 class="wp-block-heading"><strong>4. Choose and Apply Controls</strong></h2>



<p>Work through the Hierarchy of Controls in order &#8211; don’t jump straight to PPE:</p>

<li><strong>Substitution:</strong>&nbsp;If not can it be replace with a safer alternative?</li>

<li><strong>Administrative Controls:</strong>&nbsp;Introduce safe work procedures, training, and supervision.</li>

<p>Personal Protective Equipment, also known as “PPE”. It is also referred to protective clothing for your head, eyes, hands, ears, hands, feet, body, and your respiratory system.</p>



<p>PPE serves as a last resort to protect you from injuries when other engineering and administrative controls have failed, and is used to protect you and people around you from severe and minor injuries in the workplace.</p>

<p>PPE Safety is a practice of ensuring the proper use of PPE to minimise the risk exposure to workplace hazards and prevent injuries. Safety is one of the most important aspect to any business across industries. <h2 class="wp-block-heading"><strong>Introduction </strong></h2>



<p>During the Asbestos Awareness Week we try to educate and spread awareness on how dangerous exposure to Asbestos is. Back in the days, Asbestos was widely used in construction and manufacturing industries, but in 2004 it was banned in Ireland and Europe as it was proven to be a serious health hazard to people who are exposed to it.&nbsp;Prolonged exposure to asbestos fibres can lead to severe respiratory diseases, including asbestosis, lung cancer, and mesothelioma. Raising awareness can help prevent unnecessary exposure and protect lives.</p>



<h2 class="wp-block-heading"><strong>What Asbestos is?&nbsp;</strong></h2>



<p>Asbestos is a group of natural materials. They are known for their heat resistance, strength, and good insulating properties. Because of that, they were widely used in countless industries, ranging from construction and manufacturing, all the way to being used to make automotive parts and industrial applications. However, when disturbed, asbestos releases microscopic fibres that can be inhaled, causing long-term damage to the lungs.</p>

<p>Despite the fact that Asbestos was officially banned over 20 years ago, you can still find it in a lot of older buildings or products. People who work in construction, demolishing or renovation are at much higher risk of coming into the contact with materials that can contain asbestos. According to International Commission on Occupational Health (<a href="https://www.eea.europa.eu/publications/environmental-burden-of-cancer/asbestos#:~:text=According%20to%20the%20International%20Commission,cancers%20(EC%2C%202019).&amp;text=All%20use%20of%20asbestos%20has,asbestos%20bans%20well%20before%20then." target="_blank" rel="noopener">ICOH</a>) Asbestos related diseases can claim nearly 90,000 deaths in Europe alone, accounting for 55-85% of occupational lung cancers </p>

<p>While asbestos exposure can affect anyone, certain professions face a higher risk, including:</p>

<li><strong>Construction workers</strong>&nbsp;– Due to the presence of asbestos in older buildings.</li>



<li><strong>Electricians and plumbers</strong>&nbsp;– Who may disturb asbestos materials while carrying out repairs.</li>



<li><strong>Firefighters</strong>&nbsp;– Who are exposed to burning or damaged asbestos materials.</li>



<li><strong>Home renovators</strong>&nbsp;– DIY enthusiasts who unknowingly disturb asbestos-containing materials.</li>

<h2 class="wp-block-heading"><strong>How to Stay Safe</strong></h2>

<li><strong>Identify Asbestos-Containing Materials (ACMs)</strong> – Before starting any works, determine whether asbestos is present by determining buildings age. Buildings before 2000s are likely to contain Asbestos. Look for common ACMs, assess material condition, and seek professional opinion if needed.</li>



<li><strong>Do Not Disturb</strong>&nbsp;– If asbestos is found, do not touch or disturb it. Inhaling airborne fibres is the primary cause of asbestos-related diseases.</li>



<li><strong>Hire Professionals</strong>&nbsp;– Asbestos removal should be handled by licensed professionals who follow proper safety procedures.</li>



<li><strong>Use Protective Equipment</strong> – If you must work near asbestos, wear appropriate personal protective equipment (PPE), including respiratory masks and safety gloves.</li>

Lifting, carrying, pushing, or pulling heavy loads can cause serious injuries, especially to your back and shoulders. By following simple steps and <strong>Principles of Manual Handling</strong>, you can protect yourself and stay safe on the job.</p>



<h2 class="wp-block-heading"><strong><mark style="background-color:rgba(0, 0, 0, 0);color:#1db954" class="has-inline-color">1. Assess the Risk</mark></strong></h2>



<p>Before you even think of lifting or moving something, take a minute to look around you and spot any potential hazards. Ask yourself the following questions:</p>



<ul class="wp-block-list">
<li>Is the load heavy, bulky, or hard to hold?</li>



<li>Is the environment safe?</li>



<li>Are there any obstacles or slippery floors?</li>



<li>Do you feel physically capable of handling it? (Consider your own health and fitness.)</li>

<p>Example: If you work in the warehouse environment, and need to move an object from A to B, assess the area around you, make sure the path is clear and you have enough space so that you won&#8217;t have to twist your body. If the object is heavy, ask for help or consider using trolley or forklift if you are certified.</p>

<p>Example: if working in healthcare, and you’re helping a patient move from a wheelchair to the bed, make sure that the brakes are on, the area is clear, and any equipment you need is within your reach. This will help you avoid awkward movements and unnecessary strains.</p>

<p>Your feet is your foundation. Stand with your feet shoulder width apart, doing so will give you strong and stable base. Position them in the direction you&#8217;ll be moving to make the task easier and prevent unwanted twisting.</p>



<p>Example: When lifting a box, place your dominant foot slightly in front of the other, pointing in the direction you’re going. This helps you stay balanced and allows you to pivot smoothly</p>



<h2 class="wp-block-heading"><strong><mark style="background-color:rgba(0, 0, 0, 0);color:#1db954" class="has-inline-color">4. Get a Good Grip</mark></strong></h2>



<p>Make sure to have a solid grip on the object you&#8217;re about to move. Solid grip will help you control the load, give you more stability, and reduce the risk of it slipping out of your hands.</p>



<p>Example<strong>:</strong>&nbsp;If you’re carrying a stack of files in the office, grip them securely with both hands and keep them close to your body for better control.</p>

<p>Try and keep the load as close as possible to your body, this will reduce the strain on your back, and keep your centre of gravity nice and steady.</p>



<p>Example<strong data-start="2600" data-end="2612" style="white-space: normal;">:</strong><span style="white-space: normal;">&nbsp;If you’re unloading supplies from a delivery van, don’t stretch out your arms. Instead, bring each box close to your torso before moving it</span></p>



<h2 class="wp-block-heading"><strong><mark style="background-color:rgba(0, 0, 0, 0);color:#1db954" class="has-inline-color">6. Keep Your Posture Straight</mark></strong></h2>



<p>Good posture is a key to safe Manual Handling. Try and keep your back straight, pull your shoulders back, and keep your head up. Brace your abdominal muscles to support your spine. Avoid twisting or bending sideways.</p>



<p>Example:&nbsp;If you’re stacking items on a shelf, adjust the height so you don’t have to bend or reach awkwardly. This keeps your spine in a neutral position.</p>



<h2 class="wp-block-heading"><strong><mark style="background-color:rgba(0, 0, 0, 0);color:#1db954" class="has-inline-color">7. Use Your Leg Muscles </mark></strong></h2>



<p>Never use your back as a main driver. Your legs are much stronger than your back, so use them! Bend at your hips and knees, keeping your back straight. Push through your legs to lift the load</p>



<p>Example<strong>:</strong>&nbsp;Think of it like doing a squat at the gym. Whether lifting a bag of cement or a heavy office box, power the movement with your legs, not your back.</p>

<p>Timing and momentum can make manual handling tasks much easier. Coordinate the movement smoothly, avoiding sudden jitters and twists. If working as a team, communicate clearly, like counting to three before lifting.</p>



<p>Example<strong>:</strong>&nbsp;If you’re moving a couch with a friend, agree on the timing and direction before the lift off. This avoids any surprises and ensures a nice and smooth move.</p>



<h2 class="wp-block-heading"><strong><mark style="background-color:rgba(0, 0, 0, 0);color:#1db954" class="has-inline-color">Good Posture Matters More Than You Think</mark></strong></h2>



<p>Good posture isn’t just about standing up straight. It’s about positioning your body to put the least amount of strain on your joints and muscles. This reduces fatigue and the risk of injury significantly.</p>



<p><li data-start="4152" data-end="4218" style="white-space: normal;"><strong data-start="4154" data-end="4172">When standing:</strong> Distribute your weight evenly on both legs.</li></p>



<p><li data-start="4152" data-end="4218" style="white-space: normal;"><strong data-start="4221" data-end="4238">When sitting:</strong> Keep your hips and knees at 90 degrees and maintain the natural curve of your back.</li></p>



<p><li data-start="4152" data-end="4218" style="white-space: normal;"><strong data-start="4327" data-end="4339">At work:</strong> Pay attention to your posture during routine tasks like pushing trolleys or lifting boxes.</li></p>
