Canada has announced new counter-tariffs of 15%, 25% and 50% on $27.6 billion in U.S.-origin goods. The measures take effect on September 8, 2026 and apply to hundreds of tariff classifications, including products in steel and aluminum, dairy, seafood, appliances, agricultural equipment, pulp and paper, electronics, furniture, clothing and other categories. Businesses importing U.S. goods should review the detailed tariff list and assess upcoming shipments before the effective date.

CUSMA
CUSMA Compliance and Additional Tariffs

CUSMA remains in effect and continues to provide preferential tariff treatment for qualifying goods traded between Canada, the United States and Mexico.

However, CUSMA eligibility does not necessarily exempt a product from all additional U.S. or Canadian tariff measures. Businesses should complete two separate assessments:

  • Determine whether the product qualifies for preferential treatment under CUSMA
  • Determine whether the product appears on an additional tariff or surtax list.

A qualifying product may receive CUSMA treatment for the regular customs duty and still be subject to a separate additional tariff.

Step-by-step guide to CUSMA Compliance

The following is a list of steps that Canadian businesses could take to support a claim for preferential tariff treatment under the CUSMA. For a detailed guide, visit the Government of Canada’s website.

Step 1: Understand the basics of the CUSMA
Step 2: Classify your product in the Harmonized Commodity Description and Coding System (HS)
Step 3: Determine if your product meets the CUSMA rules of origin
Step 4: Certification of origin
Step 5: Provide certification to the importer and be ready for a verification
Step 6: Keep your records
Step 7: Check for additional tariffs or surtaxes

After determining CUSMA eligibility, search the applicable Canadian and U.S. tariff schedules using the product’s tariff classification. Do not assume that CUSMA compliance automatically eliminates an additional tariff.
