1. Introduction
These Terms of Service ("Terms") cover your use of and access to the websites, desktop or mobile applications, and related services and features (collectively, the "Services") provided by MOBIRISE ("Mobirise", "we", "us").
By using our Services, you are agreeing to these Terms. Please read them carefully.
2. Account
To use many of the Services, you must first create an account ("Account"). You agree to provide us with accurate, complete and updated information for your Account. We may need to use this information to contact you.
Please safeguard your Account and make sure others don't have access to your Account or password. You are solely responsible for any activity on your Account and for maintaining the confidentiality and security of your password.
The Services are not intended for and may not be used by children under the age of 16. By using the Services, you represent that you are at least 16.
3. Your Content
Some of our Services allow you to upload, submit, store, send or receive content, including without limitation text, photos, images, audio, video, code and any other materials. You retain ownership of any intellectual property rights that you hold in that content.
You represent and warrant that you own all rights to your content or otherwise have (and will continue to have) all rights and permissions to legally use, share, display, transfer and license your content via the Services. You represent and warrant that your content use will not infringe or violate the rights of any third party, including without limitation any copyrights, trademarks, privacy rights, publicity rights, contract rights, trade secrets or any other intellectual property or proprietary rights. Don't copy, upload, download or share content unless you have the right to do so.
When you upload, submit, store, send or receive content to or through our Services, you give us a worldwide license to use, host, store, reproduce, modify, create derivative works, communicate, publish, publicly perform, publicly display and distribute such content. The rights you grant in this license are for the limited purpose of operating, promoting, and improving our Services, and to develop new ones.
If you provide us with any suggestions, comments or other feedback, you acknowledge and agree that it may be used by us without any restriction or obligation to you, even after your Account is cancelled.
Where the Services make available third-party image, video, or other content libraries, such content is made available subject to the licence terms and conditions of the relevant third-party provider and is not licensed by us.
While third-party providers may describe their content as available for use under specified licence terms, we do not control, review, or independently verify the rights, ownership, licensing status, accuracy, or suitability of individual items. We cannot guarantee that any item is free from third-party rights, restrictions, or claims, including rights relating to copyright, trademarks, publicity, privacy, or the use of identifiable people, brands, products, or properties.
Before using any content obtained from a third-party library, you should review the applicable licence terms and ensure that your intended use complies with those terms and any additional requirements that may apply, including obtaining any necessary permissions, releases, consents, or clearances.
Third-party library content is provided on an "as is" basis. To the fullest extent permitted by applicable law, we make no representations or warranties regarding such content and disclaim all liability arising from or related to your access to, use of, or reliance on content obtained from third-party libraries.
4. Your Responsibilities
You represent and warrant that your use of the Services is not contrary to law, including without limitation, laws regarding online conduct and acceptable content, applicable export or import controls, regulations and sanctions.
You represent and warrant that you will not:
- copy, modify, create derivative works of, adapt, reverse engineer, emulate, migrate to another service, translate, decompile or disassemble the Services;
- sell, sublicense, lease, rent, or loan the Services;
- upload, post, transmit or otherwise make available any content that is unlawful, malicious, harmful, threatening, defamatory, abusive, obscene, harassing, tortious, vulgar, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable;
- use any illegal action to collect login data and passwords for other websites, third parties, software or services;
- phish, collect, upload, or otherwise make available credit card information or other forms of financial data used for collecting payments, unless done in accordance with any applicable law, including with the PCI DSS standard when applicable;
- use any "robot", "spider" or other automatic device, program, script, or any similar or equivalent manual process, to access, acquire, copy, or monitor the Services;
- act in a manner which might be perceived as damaging to Mobirise's reputation and goodwill or which may bring Mobirise into disrepute or harm;
- purchase domains and ads that use Mobirise and variations and misspellings thereof;
- breach or otherwise bypass any security or authentication measures;
- upload to the Services any virus, worm, Trojan Horse, time bomb, web bug, spyware, malware, or any other computer code, file, or program that may or is intended to damage or hijack the operation of any hardware, software, or telecommunications equipment, or any other actually or potentially harmful, disruptive, or invasive code or component;
- take any action that imposes an unreasonable or disproportionately large load on the infrastructure of the Services or networks connected to the Services;
- use any of the Services in connection with any form of spam, unsolicited mail, fraud, scam, phishing, "chain letters", "pyramid schemes" or similar conduct, or otherwise engage in unethical marketing or advertising;
- access the Services through any means or technology, other than our publicly supported interfaces;
- remove or alter any copyright notices, watermarks, restrictions and signs indicating proprietary rights;
- upload files for the sole purpose of having them hosted by the Services and for use outside of the Services;
- upload, post or otherwise transmit any content that is adult in nature, such as any nudity in a sexual context;
- resell websites created with the Services as templates to an unlimited number of customers, rather than providing them to end users.
You acknowledge and agree that your failure to abide by any of the foregoing or any misrepresentation made by you herein may result in the immediate termination of your Account and any Services provided to you – with or without further notice to you, and without any refund of amounts paid on account of any such Services.
5. Our Rights
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Services, including the Mobirise application and any themes, extensions or other add-ons you obtain, to create websites for yourself or for your clients. The scope of the license for Paid Services is as described on the relevant product or pricing page at the time of purchase. Websites you export and publish on your own hosting are standard files that continue to work independently of the Services, including after your Paid Services end; however, you may lose the ability to edit them using premium themes, extensions or features that require an active subscription. Certain components of the Services are provided under open-source or third-party licenses, which apply to those components.
The Services are protected by copyright, trademark and other US and foreign laws. Except for the license granted above, these Terms do not grant you any right, title or interest in the Services, others' user content, our trademarks, logos or other brand features or intellectual property or trade secrets or others' content in the Services. You agree not to change, translate or otherwise create derivative works of the Services or others' user content.
We reserve the right, at our sole discretion and without liability or prior notice (except where prohibited by applicable law), to:
- (a) change parts or all of the Services and their functionality;
- (b) suspend or discontinue parts or all of the Services;
- (c) terminate, suspend, restrict or disable your access to or use of parts or all of the Services;
- (d) terminate, suspend, restrict or disable access to your Account or parts, some or all of your sites;
- (e) change our eligibility criteria to use the Services (and if such eligibility criteria changes are prohibited by law where you live, we may revoke your right to use the Services in that jurisdiction).
6. Privacy and Copyright
Our Privacy Policy explains what data we process, how we process it, the purposes for which we process it, how you may request deletion of that data, and how we protect your privacy when you use our Services. By using our Services, you acknowledge that we process such data as described in our Privacy Policy.
Where we process personal data on your behalf — for example, content of websites we host for you or submissions collected through Formoid (Mobirise Forms) — our Data Processing Addendum applies and forms part of these Terms. The third-party providers we engage for such processing are listed on our Sub-processors page.
The Services utilise the YouTube API to search and display YouTube videos, and you agree to be bound by the YouTube Terms of Service and Google Privacy Policy when engaging YouTube content through the Services.
The Services utilise the Unsplash and Pixabay APIs to search for and display images in the Free Image Library. We also use the ElectricBlaze API for the functionality of widget extensions. By using these features, you agree to comply with the respective terms of service and privacy policies of Unsplash, Pixabay, and ElectricBlaze.
We respond to notices of alleged copyright infringement if they comply with the law. We reserve the right to delete or disable content alleged to be infringing, and to terminate Accounts of repeat infringers without any refunds.
If you believe that any content hosted through the Services is illegal or violates these Terms, please report it to support@mobirise.com. Your report should include the URL of the content, an explanation of why you consider it illegal, your name and email address, and a statement that you believe the information in your report is accurate and complete. We will confirm receipt, review the report, and inform you of our decision, and we may remove or disable access to the content. This email address is also our point of contact for users and authorities under the EU Digital Services Act; communication is in English.
7. Paid Services
You can access certain portions of the Services by submitting a fee payment (such additional services, "Paid Services"). Paid Services will remain in effect until cancelled or terminated in accordance with these Terms. You may cancel Paid Services at any time via the Services. If you don't pay for Paid Services on time, we reserve the right to suspend or cancel your access to the Paid Services. Transaction fees and additional fees may also apply to certain portions of the Services.
The features, usage limits (such as the number of sites, storage, or form submissions) and term of each Paid Service, including hosting and Formoid (Mobirise Forms), are as described on the relevant product or pricing page at the time of purchase. We may restrict or suspend Services that exceed those limits or impose an unreasonable load on our infrastructure. When a Paid Service ends, websites hosted by us and related form submissions may be removed in accordance with our Privacy Policy and Data Processing Addendum; you are responsible for keeping your own copies of your content.
All fees are exclusive of applicable national, provincial, state, local or other taxes, unless explicitly stated otherwise. You are responsible for all applicable taxes, and we will charge taxes in addition to the fees for the Services when required to do so.
To ensure uninterrupted service, we will automatically bill you for certain Paid Services from the date you submit your initial payment and on each renewal period afterwards until cancellation. Your renewal period will be equal in time to the renewal period of your current subscription. We will automatically charge you the applicable amount using the payment method you have on file with us. You can disable auto-renewal at any time via https://secure.2co.com/myaccount/.
If you are not satisfied with Paid Services, you can receive a refund within 14 days of first order. The refund is applicable only to the initial purchase of Services. The refund is not applicable to any additional purchases, upgrades, modifications or renewals of Services. Certain services may be non-refundable. These include third party services such as domains, business tools and applications.
8. Cancellation
You may discontinue use and cancel your Account and Services at any time via the Services. The effective date for the cancellation will be the date on which you have completed the cancellation process via the Services, and the effective date for cancellation of Paid Services will be at the end of such Paid Services' subscription period. We reserve the right to change, suspend, discontinue, cancel, restrict or disable your use of or access to, parts or all of the Services or their functionality at any time at our sole discretion and without notice. For example, we may suspend or cancel your Account if you are violating these Terms.

9.3 Ownership and Rights
AI Content cannot be exclusively owned by any individual User, as similar content may be generated for others. Users may use AI Content freely, subject to compliance with applicable laws. Mobirise retains the right to store and use AI Content for service improvement, demonstration, and promotional purposes. We may use AI Content and AI Design to demonstrate the Services' capabilities and for promotional purposes.
AI Design generated by Mobirise AI utilises an AI model that is based on and trained with Mobirise themes and templates. AI Design can be used for both non-profit and commercial purposes. This includes creating websites for your personal use or for client projects. However, you may not sell or distribute the AI Design in any reusable form, including but not limited to website themes or templates.
9.4 Data Collection and Privacy
We store user prompts anonymously for research, quality control, and service improvements without linking them to identifiable individuals.
9.5 Prohibited Uses
Users must not use Mobirise AI for any unlawful or prohibited activities, including but not limited to:
- inputting personally identifiable information in AI prompts, such as names, addresses, financial data, or medical records;
- generating, requesting, or distributing content that: promotes violence, hate speech, or discrimination; supports terrorist activities or illegal conduct; includes child exploitation, abuse, or harmful material; defames, misleads, or promotes fraud;

- attempting to bypass, reverse-engineer, or manipulate Mobirise AI's technical restrictions;
- using automated scripts, bots, or hacking techniques to access or disrupt the Services.
9.6 Limitation of Liability
Section 11 (Limitation of Liability) applies to Mobirise AI. In addition, to the fullest extent permitted by law:
- Users assume full responsibility for the accuracy, legality, and consequences of AI-generated content;
- Mobirise does not guarantee that AI-generated websites will meet legal, regulatory, or business requirements.
10. Disclaimer of Warranties
We provide the Services on an "as is" and "as available" basis, without any warranties of any kind, including any implied warranties or conditions of merchantability, fitness for a particular purpose, workmanlike effort, non-infringement, or any other warranty – all to the fullest extent permitted by law. We specifically do not represent or warrant that the Services are complete, accurate, of any certain quality, reliable or secure in any way, suitable for or compatible with any of your contemplated activities, devices, operating systems, browsers, software or tools, or comply with any laws applicable to you (including in any jurisdiction in which you operate), or that their operation will be free of any viruses, bugs or other harmful components or program limitations.
We may release products and features that we are still testing and evaluating. Those Services will be marked as beta, preview or early access, and may still contain software bugs, suffer disruptions and not operate as intended or designated.
11. Limitation of Liability
To the fullest extent permitted by law in each applicable jurisdiction, Mobirise, its officers, directors, shareholders, employees, affiliates and/or agents shall not be liable to you for any indirect, incidental, special, punitive, exemplary or consequential damages, or for any loss of profits, revenue, business, goodwill or data, including any such damages resulting from:
- (1) errors, mistakes, or inaccuracies of or in any content;
- (2) any unauthorised access to or use of our servers and/or any personal information and/or other information stored therein;
- (3) any interruption or cessation of transmission to or from the Services;
- (4) the use or display of any content or user content posted, emailed, transmitted, or otherwise made available via the Services;
- (5) events beyond the reasonable control of Mobirise, including any internet failures, equipment failures, electrical power failures, strikes, labor disputes, riots, insurrections, civil disturbances, shortages of labor or materials, fires, floods, storms, earthquakes, explosions, acts of God, epidemics, war, terrorism, governmental actions, orders of courts, agencies or tribunals, or non-performance of third parties;
- (6) loss of use, data, profits, goodwill, or other intangible losses, resulting from the use or the inability to use any or all of the Services.
Our total liability to you for all claims arising out of or relating to these Terms or the Services, whether in contract, tort (including negligence) or otherwise, shall not exceed the greater of the amounts you paid us for the Services in the twelve (12) months preceding the event giving rise to the claim, or US $100. If you use the Services for business purposes, you acknowledge that these limitations are reasonable, having regard to the price of the Services and the availability of free versions of the Services.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law. If you are a consumer, nothing in these Terms affects your statutory rights.
12. Indemnity
You agree to indemnify and hold harmless Mobirise, its officers, directors, employees and agents from any third-party claims, losses, damages, costs and expenses (including reasonable legal fees) to the extent arising from your content (including content published on websites you create or host with the Services), personal data you collect through the Services (including through Formoid), your breach of these Terms or applicable law, or your infringement of any third party's rights. We will notify you promptly of any such claim and reasonably cooperate in its defence. If you are a consumer, this Section applies only to the extent the loss was caused by your breach of these Terms or applicable law.
13. General
We may update these Terms from time to time by publishing a new version on our websites. We encourage you to check back periodically to review these Terms for any changes since your last visit. By continuing to use or access the Services after any modifications come into effect, you agree to be bound by the modified Terms and price changes.
If you disagree with our changes, then you should stop using the Services and cancel all Paid Services.
