SWEEPSTAKES OFFICIAL RULES

This sweepstakes promotion “POWERSCHOOL TEACHER APPRECIATION WEEK” shall be subject to these official rules (the “Official Rules”), and by entering, you (Participant) agree to be bound by the terms and conditions herein.  Certain restrictions may apply.

NO PURCHASE NECESSARY TO ENTER OR WIN. PARTICIPANTS MUST HAVE INTERNET ACCESS PRIOR TO THE START DATE OF THE SWEEPSTAKES. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING. ODDS OF WINNING WILL DEPEND ON THE TOTAL NUMBER OF ENTRIES RECEIVED.

PowerSchool is offering a sweepstakes on its official third-party social media pages, such as Twitter, Instagram, and Facebook (collectively, the “Social Media Sites”). This sweepstakes is referred to as the “Social Media Giveaway” or “Giveaway” or “Sweepstakes.” The Social Media Post setting forth the method of entry for each Social Media Giveaway is referred to as a “Giveaway Social Media Post.” Please read these Official Rules before entering the Social Media Giveaway. The Social Media Giveaway is created and sponsored by PowerSchool Group, LLC (“PowerSchool” or “Sweepstakes Provider”), 150 Parkshore Dr., Folsom, CA 95630.

ELIGIBILITY:  The Sweepstakes is open to legal residents of the United States who are eighteen (18) years or older at the time of entry. However, the Sweepstakes is void in any jurisdiction where it is prohibited or restricted by law.  All federal, state, and local rules and regulations apply.

PowerSchool’s officers, directors, employees, contractors, agents, and any of their immediate family and/or household members are not eligible to win.

HOW TO ENTER:  Enter online via a Social Media Site, following all instructions below, and observe all posted deadlines (see DEADLINES below).  UNLIMITED ENTRIES PER PERSON FOR THE DURATION OF THE SWEEPSTAKES.

You may enter by completing ALL of the below steps:

1. Following PowerSchool on any Social Media Site,
2. Liking the Sweepstakes post, and
3. And tagging one (1) additional account in the comments

WINNER SELECTION; PRIZE: (40) potential winners will be randomly drawn from all of the Entries submitted to and received by PowerSchool on the Social Media Sites; each winner will receive one $50.00 Amazon Gift Card (the “Prize”).

Limit one (1) Prize per person, household or address. Gift card terms and conditions apply.

DEADLINES:  The Sweepstakes begins at 5:00 p.m. PST on Thursday, April 28, 2022 and ends at 9:00 a.m. PST on Friday, May 6, 2022.

No submissions will be accepted after the deadline for any reason.

No responsibility is assumed by Sweepstakes Provider, their respective subsidiaries, parents, partners, or other Sweepstakes sponsors for any computer, online, telephone or technical malfunctions that may occur. Entries will be declared made by the authorized account holder of the e-mail address submitted at the time of entry. “Authorized account holder” is defined as the natural person who is assigned to a social media profile by an Internet Access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. All entries become the property of Sweepstakes Provider and will not be returned to the Participant. All entries must be submitted from a valid e-mail account that may be identified with a natural person by appropriate independent means, including, without limitation, reverse domain name search. Potential winner may be requested to provide Sweepstakes Provider with proof that the potential winner is the authorized account holder of the e-mail address associated with the winning entry.

ODDS OF WINNING: Odds of winning depend on the number of eligible entries received.

PRIZES:

The following prize(s) will be awarded:

Prizes are non-transferable and may not be redeemed for cash except as set out above; substitutions may not be requested.  Prizes are subject to availability. By participating in this Sweepstakes and accepting a prize, participants and winner will be deemed to have agreed to these Official Rules.  Winner is responsible for all applicable federal, state, and local income and any other taxes, fees and surcharges. Sweepstakes Provider reserve the right to substitute a prize of equal or greater value.

WINNER SELECTION:  Winner selection shall take place on May 6, 2022.  The winner will be selected by a random drawing from all qualified entries received by the deadline. Winner selection will be made by Sweepstakes Provider, whose decision shall be final. The winner will be notified by direct message on the applicable Social Media Site account on or near date specified above. If a winner is unreachable after two (2) business days or if a winner refuses the Prize, an alternate winner will be selected by a random drawing from the remaining qualified entries.  In order to be named a winner, potential winners may be required to execute and return an Affidavit of Eligibility/Prize Acceptance Form/Release of liability upon accepting a prize, which must be returned within ten (10) days of date of personal delivery or date of postmark.  Failure to sign and return the affidavit or release within ten (10) days, or to comply with any term or condition of these Official Rules will result in disqualification and an alternate winner will be selected.

USE OF SWEEPSTAKES INFORMATION:  Notwithstanding any contrary provision in any of Sweepstakes Provider’ respective privacy policies, Participants grant to Sweepstakes Provider, and Sweepstakes Provider reserve, the right to use any and all information related to the Sweepstakes, including information provided by Participants in connection with the Sweepstakes, for marketing purposes or any other purpose, unless prohibited by law. Participants may be required to sign a release, which grants to Sweepstakes Provider the right to use and publish their proper name and state of residence online or in any other media in connection with the Sweepstakes.  By accepting a prize, winner(s) may be required to sign a release that grants permission to Sweepstakes Provider to use his or her name, photograph, likeness, voice, prize information and/or biographical information for publicity and promotional purposes without future compensation unless prohibited by law.  By entering, participants release and hold harmless Sweepstakes Provider, their respective parents, subsidiaries, affiliates, directors, officers, employees, and agents from any and all liability for any injuries, loss or damages of any kind arising from or in connection with the Sweepstakes or any prize won. Restrictions, conditions and limitations apply.

CONDUCT:  By entering the Sweepstakes, Participants agree to be bound by these Official Rules.  Participants further agree to be bound by the decisions of the Sweepstakes Provider, which shall be final and binding in all respects. Sweepstakes Provider reserve the right at their sole discretion to disqualify any individual they find to be tampering with the entry process or the operation of the Web site; or to be acting in violation of the Official Rules.

By participating in the Sweepstakes, Participant acknowledge and agree to PowerSchool’s Privacy Policy https://www1.powerschool.com/privacy/, and any other relevant rules, policies or regulations.

Participants agree that in their participation in the Sweepstakes they will not use obscene, libelous or slanderous language, or language that infringes upon a third party’s trademark, trade name or other intellectual property right or right of privacy. Participants agree to indemnify and hold harmless Sweepstakes Provider, its respective subsidiaries, parents, partners, and other Sweepstakes sponsors, officers, consultants, agents, and employees against and from all claims, damages liabilities, costs and expenses asserted by third parties alleging that the Sweepstakes includes obscenity, libel, slander, or infringes upon the third party’s intellectual property or privacy rights, as a direct result of their actions or omissions in connection with the Sweepstakes or otherwise relating to  their acts or omissions in connection with the Sweepstakes, including, without limitation, their negligence, gross negligence, or willful misconduct. Participants further agree to not knowingly damage or cause interruption of the Sweepstakes or to prevent others’ participation in the Sweepstakes.

CAUTION: ANY ATTEMPT BY A PARTICIPANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE POWERSCHOOL WEB SITES OR TO UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SWEEPSTAKES PROVIDER RESERVE THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PARTICIPANT TO THE FULLEST EXTENT PERMITTED BY LAW.

LIMITATIONS OF LIABILITY:  Winners assume liability for losses or injuries caused or claimed to be caused by participating in the Sweepstakes, or by the acceptance, possession, use of, or failure to receive any prize.  Sweepstakes Provider is not responsible: (i) for any lost, late, illegible, incomplete, or misdirected entries; or (ii) for any incorrect or inaccurate information in the Sweepstakes Rules or by any technical or human error that may occur in the processing of submissions in the Sweepstakes. Sweepstakes Provider assumes no responsibility for an error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction of authorized access to, or alteration of, entries. Sweepstakes Provider is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of e-mail or players on account of technical problems or traffic congestion on the Internet or at any Web site or combination thereof, including injury or damage to participants or to any other person’s computer related to or resulting from participating or downloading materials in the Sweepstakes. If the Sweepstakes is not capable of running as planned for any reason, including legal restrictions, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sweepstakes Provider that corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes, Sweepstakes Provider reserves the right to cancel, terminate, modify or suspend the Sweepstakes.

RULES / WINNERS LIST:  Official Rules and the name of the winner may be obtained by sending a self-addressed, stamped #10 envelope to: PowerSchool Group LLC, 150 Parkshore Dr., Folsom, CA 95630. Indicate “Teacher Appreciation Week Sweepstakes Rules Request” or “Teacher Appreciation Week Sweepstakes Winners List” on the outside of the envelope as applicable. Limit one (1) request per envelope. The request must include the name of the Sweepstakes. Winners List will be available 5 business days after the winners are confirmed. Copying or unauthorized use of any copyrighted material or trademarks without the express written consent of its owner is strictly prohibited.

CONSTRUCTION. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.
