When it comes to IEEPA refunds, filing a CAPE claim is just the beginning. Once a claim is accepted, CBP will generally take about 60 to 90 days to distribute refunds—and an accepted claim doesn’t guarantee a timely refund. This week in global logistics: guidance on Post Summary Corrections (PSCs) for CAPE claims; new tariff adjustment procedures for eligible Canadian and Mexican steel and aluminum; a cargo rush on the TPEB; ongoing blanks on the FEWB and TAWB; and rate volatility on ex-Asia air routes. ⚠️ CBP Issues Guidance on PSCs for CAPE Submissions: CBP has indicated that entries that are accepted and attached to a CAPE claim are not eligible for PSCs. Importers should identify all errors before submitting a refund request in CAPE. Flexport’s Trade Advisory team can help importers correct their entries prior to CAPE submission and assist with the entire filing process. 📌 Other CAPE Developments: CBP launched CAPE Phase 1, the first version of its CAPE system for IEEPA refunds, on April 20. CAPE is accessible via a new tab in the ACE Portal. Expected refund timelines vary: unliquidated entries or those liquidated within the past 80 days can expect refunds roughly 60 to 90 days after CAPE acceptance. Entries with suspended, extended, or under-review status, along with warehouse entries, will receive refunds once the entry liquidates. ⚙️ New Tariff Adjustment Procedures for Canadian and Mexican Steel and Aluminum: On April 22, the Department of Commerce published procedures for requesting a reduced 25% Section 232 tariff on Canadian- and Mexican-origin steel and aluminum. Entries that are accepted and attached to a CAPE claim are ineligible for Post Summary Corrections (PSCs). This makes it even more critical to audit your entries before submitting a refund request in CAPE. Flexport found an average error rate of 20% in entries filed by other customs brokers—meaning some importers are leaving 20% of their total refund on the table, while also exposing those entries to potential punitive action from CBP.
