Welcome to DivineAPI. These Terms of Service ("Terms") govern your access to and use of the DivineAPI website, APIs, plugins, widgets, documentation, and related services (collectively, the "Service") operated by DivineAPI ("DivineAPI", "we", "us", or "our").
By creating an account, subscribing to a paid plan, or accessing the Service in any manner, you ("you", "Customer", or "User") agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Definitions
"API" means the application programming interfaces provided by DivineAPI, including all endpoints, methods, plugins, widgets, and integrations.
"API-Generated Content" means any data, output, content, or response produced and delivered to you through the API, including but not limited to:
- Horoscopes (daily, weekly, monthly, yearly, and including personal, emotional, love, career, health, finance, and other thematic variants)
- Kundli and Janam Kundli readings
- Kundali matching reports
- Panchang and Hindu calendar data
- Numerology reports (Pythagorean and Chaldean systems)
- Natal charts, birth charts, and astrological wheels
- Tarot readings
- Vedic astrology calculations
- Western astrology calculations
- Lifestyle and entertainment astrological content
- Calculator outputs and report data
"Subscription" means an active, paid plan that grants you access to the Service.
"End User" means any individual or entity to whom you distribute, publish, or display API-Generated Content through your products or services.
"Enterprise Plan" means a custom subscription tier subject to a separate Master Service Agreement (MSA) executed between DivineAPI and Customer. Enterprise Plans may modify or supplement these Terms.
2. Your DivineAPI Account
To access the Service, you must create an account with accurate and complete information. You are responsible for:
- Maintaining the security and confidentiality of your account credentials and API keys
- All activities that occur under your account
- Notifying DivineAPI immediately of any unauthorized access or security breach
- Ensuring that the individual using the account is a human user (not an automated bot, except for legitimate API integrations)
- Being at least 18 years of age, or the age of majority in your jurisdiction, whichever is greater
You may not share your account credentials with third parties. Multiple individuals within your organization may access the Service under separate seats as permitted by your subscription plan.
3. Payment, Renewal, and Trials
3.1 Subscription Fees
Subscription fees are billed in advance on a monthly or annual basis, as selected at signup. All fees are non-refundable except as expressly provided in our Refund and Cancellation Policy.
3.2 Auto-Renewal
Subscriptions automatically renew at the end of each billing cycle at the then-current rates unless you cancel before the renewal date. You may cancel at any time through your account settings or by emailing admin@divineapi.com. For customers in California, we provide auto-renewal notices in accordance with California Civil Code §17602. For customers in the European Union and United Kingdom, additional consumer protection rights may apply under local law.
3.3 Free Trial and Auto-Conversion
Free trials are 14 days in duration and require a valid payment method at signup. At the end of the 14-day trial period, your payment method will be automatically charged for the paid plan you selected at signup, unless you cancel before the trial ends. By providing a payment method, you authorize this automatic charge.
3.4 Price Changes
DivineAPI may revise pricing with at least 30 days' prior notice. New pricing applies at the start of the next billing cycle after the notice period. Existing prepaid commitments are unaffected.
3.5 Taxes
All fees exclude applicable taxes (including GST, VAT, sales tax, withholding tax). You are responsible for paying all taxes associated with your subscription, except those based on DivineAPI's net income.
3.6 Disputed Charges
You agree to notify DivineAPI of any billing disputes within 60 days of the relevant invoice or charge. Failure to dispute within this period constitutes acceptance of the charge.
4. License Grant for API-Generated Content
Subject to your compliance with these Terms and the maintenance of an active paid Subscription, DivineAPI grants you a non-exclusive, non-transferable, worldwide license to:
- Publish API-Generated Content on any digital or print medium owned or operated by you, including websites, mobile applications, desktop applications, email newsletters, push notifications, SMS, and printed materials.
- Store, cache, and persist API-Generated Content in your own systems, databases, and infrastructure for the duration of your active Subscription.
- Distribute API-Generated Content to your End Users across all distribution channels, including web, mobile applications, email, push notifications, SMS, in-app messaging, and any other communication channel.
- White-label the API-Generated Content under your own brand, trade name, trademarks, and properties, without any requirement to attribute DivineAPI in user-facing materials.
- Translate, reformat, summarize, or adapt API-Generated Content for your specific use case, provided that adaptations do not materially misrepresent the substantive astrological output or DivineAPI's calculation methodology.
- Display API-Generated Content to your End Users through your platform. This grant does not include the right to sub-license the API or API-Generated Content to third parties for their independent commercial use outside your platform.
4.1 Multi-Brand and Multi-Property Use
Use of API-Generated Content across multiple distinct brands or properties owned or operated by Customer requires an Enterprise Plan and is governed by the executed MSA.
4.2 Post-Termination Rights
Upon termination, expiration, or non-renewal of your Subscription:
- You must immediately cease making new API calls
- You may retain copies of API-Generated Content previously published in fixed-form media (such as past blog posts, prior email newsletters already sent, or archived application states) prior to termination
- You may not generate, refresh, or publish new content, including new daily, weekly, monthly, or other cyclical content, using previously cached API outputs
- Continued operational use of dated content for ongoing publication cycles requires an active Subscription
5. Permitted Uses
The Service may be used for purposes including, but not limited to:
- Powering content on websites, mobile applications, and digital products
- Daily, weekly, monthly, and annual horoscope syndication via email newsletters and content platforms
- White-label content services delivered to your customers
- Multi-brand content deployments across properties you own or operate (Enterprise Plan)
- Internal business operations, analytics, and reporting
- Editorial and lifestyle publishing
- Matrimony, dating, and relationship platforms
- E-commerce and retail integrations based on astrological data
- WordPress, Shopify, Wix, and other CMS plugin integrations via our official integrations
- Custom integrations via REST API, JSON endpoints, and webhooks
- Mobile app integrations (Android, iOS, cross-platform)
- Entertainment, gaming, and lifestyle applications
6. Restrictions
You may NOT:
- Resell, sublicense, or grant third parties direct access to DivineAPI API endpoints (the underlying API itself, as opposed to API-Generated Content which is licensed under Section 4)
- Reverse engineer, decompile, disassemble, or attempt to extract the source code, algorithms, or calculation methods of the Service
- Use DivineAPI's brand assets, trademarks, service marks, logos, or trade names in your white-label deployment without explicit prior written permission
- Make new API calls or generate new content after Subscription termination or expiration
- Use the Service to generate content that is unlawful, defamatory, fraudulent, hateful, discriminatory, or that infringes third-party rights
- Use the Service for any unauthorized, illegal, harmful, or abusive purposes
- Attempt to circumvent rate limits, security measures, authentication mechanisms, or usage quotas
- Misrepresent API-Generated Content as having been independently calculated by you for academic, scientific, or expert attribution purposes
- Use automated bots, scrapers, or scripts to abuse the Service beyond the legitimate scope of your API integration
- Use the Service to create content competing directly with DivineAPI as an API service for resale (i.e., you may not re-package the API as your own API product)
7. Intellectual Property
7.1 DivineAPI Property
DivineAPI retains ownership of all platform intellectual property, including but not limited to: source code, algorithms, calculation engines (including Swiss Ephemeris implementations), API endpoint structures, technical documentation, brand assets, trademarks, service marks, trade names, and underlying technical infrastructure.
7.2 API-Generated Content
API-Generated Content delivered to you via the Service is governed by the License Grant set out in Section 4. This license provides you with broad rights to publish, store, distribute, white-label, and monetize such content during your active paid Subscription.
7.3 Your Rights
Nothing in these Terms restricts your right to:
- Use API-Generated Content in your products and services as permitted by Section 4
- Apply your own branding to API-Generated Content
- Distribute API-Generated Content to End Users without attribution to DivineAPI in user-facing materials
- Build commercial products and services on top of API-Generated Content
- Monetize products and services that incorporate API-Generated Content
7.4 Customer Data
You retain all rights to data you submit to the Service (such as End Users' birth date, time, and location used for chart calculations). DivineAPI processes this input solely to generate API responses and does not claim ownership of customer-submitted data. You represent that you have obtained all necessary consents from End Users to submit their personal data to the Service.
7.5 Trademark Use
You may not use any DivineAPI trademark, service mark, logo, or trade name without express prior written permission, except for factual reference (e.g., listing DivineAPI as a vendor in your internal procurement records, case studies you have explicitly authorized, or factual product comparisons).
7.6 Feedback
If you provide feedback, suggestions, or recommendations regarding the Service, you grant DivineAPI a perpetual, royalty-free license to use such feedback to improve the Service. This does not transfer ownership of confidential business information or proprietary data.
8. Support and Service Levels
8.1 Standard Support
Standard support is provided via email at admin@divineapi.com. Response times depend on your Subscription tier:
- Free Trial: Best-effort response within 48 business hours
- Standard Paid Plans: Response within 24 business hours
Support hours: Monday through Friday, 9:00 AM to 6:00 PM IST, excluding Indian public holidays.
8.2 Enterprise Support
Enterprise Plan customers receive:
- Response within 4 business hours during support hours
- A named, dedicated account manager with direct phone contact
- Priority queue placement for technical and commercial inquiries
- Custom SLA terms as specified in the executed MSA
8.3 Uptime Commitment
DivineAPI targets 99.9% uptime for the Service, measured monthly. The following are excluded from uptime calculations:
- Scheduled maintenance windows (notified at least 48 hours in advance for Enterprise customers)
- Force majeure events
- Third-party infrastructure failures outside DivineAPI's reasonable control
- Customer's own infrastructure or network issues
- Issues caused by Customer's misuse or breach of these Terms
Enterprise Plan customers may receive contractual SLA guarantees and service credits as specified in their MSA. Service credits are the sole and exclusive remedy for SLA breach under standard plans.
9. Privacy and Data Protection
9.1 Privacy Policy
Your use of the Service is governed by our Privacy Policy, available at divineapi.com/privacy-policy, which is incorporated into these Terms by reference.
9.2 Data Processing
DivineAPI processes personal data in accordance with applicable data protection laws, including the Indian Digital Personal Data Protection Act (DPDPA), the EU General Data Protection Regulation (GDPR), and the California Consumer Privacy Act (CCPA), as applicable.
9.3 Data Residency
API-Generated Content and customer-submitted input data are processed in DivineAPI's cloud infrastructure, primarily located in Asia-Pacific regions. Enterprise customers requiring specific data residency commitments (e.g., EU-only processing, US-only processing) may negotiate such terms in the MSA.
9.4 Data Processing Addendum (DPA)
For customers subject to GDPR, DPDPA, or other data protection laws requiring a written data processing agreement, DivineAPI offers a DPA upon request to admin@divineapi.com.
9.5 Customer Responsibilities
You represent and warrant that you have obtained all necessary consents from End Users before submitting their personal data (birth date, time, location) to the Service.
10. Copyright Infringement
If you believe that any content on the Service infringes your copyright, please send a notice of infringement to admin@divineapi.com containing:
- Description of the copyrighted work
- Location of the alleged infringing material
- Your contact information
- A statement under penalty of perjury that the information is accurate and that you are authorized to act on behalf of the copyright owner
- Your physical or electronic signature
11. Confidentiality
Each party agrees to protect the other's confidential information (including API keys, pricing terms, technical specifications, and non-public business information) with the same degree of care it uses to protect its own confidential information, and not less than reasonable care.
Confidential information does not include information that is:
- Publicly available through no breach of these Terms
- Independently developed without reference to the other party's confidential information
- Rightfully received from a third party without confidentiality obligation
- Required to be disclosed by law, court order, or regulatory authority (with prior notice to the other party where legally permitted)
12. Warranties and Disclaimers
12.1 DivineAPI's Warranties
We warrant that the Service will perform substantially in accordance with the documentation available at developers.divineapi.com during your active Subscription.
12.2 Disclaimer of Other Warranties
EXCEPT AS EXPRESSLY STATED IN THESE TERMS, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". DIVINEAPI DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.
12.3 Nature of Astrological Content
API-Generated Content is provided for informational, entertainment, content-syndication, and lifestyle purposes only. DivineAPI does not guarantee astrological predictions, outcomes, or interpretations.
ASTROLOGICAL CONTENT SHOULD NOT BE USED AS A SUBSTITUTE FOR PROFESSIONAL MEDICAL, LEGAL, FINANCIAL, PSYCHOLOGICAL, OR OTHER QUALIFIED ADVICE. NEITHER DIVINEAPI NOR ITS LICENSORS ARE LIABLE FOR ANY DECISIONS MADE OR ACTIONS TAKEN BY YOU OR YOUR END USERS IN RELIANCE ON API-GENERATED CONTENT.
You agree to include appropriate disclaimers in your products and services to advise End Users that astrological content is for entertainment and informational purposes only and does not constitute professional advice.
13. Limitation of Liability
13.1 Liability Cap
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DIVINEAPI'S TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE, WHETHER IN CONTRACT, TORT, OR OTHERWISE, WILL NOT EXCEED THE GREATER OF:
- The total fees paid by you to DivineAPI in the twelve (12) months preceding the event giving rise to liability, OR
- ONE HUNDRED US DOLLARS (USD $100)
13.2 Exclusion of Indirect Damages
IN NO EVENT WILL DIVINEAPI BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOST PROFITS, LOST DATA, LOSS OF BUSINESS, OR LOSS OF GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
13.3 Exceptions
The limitations in Sections 13.1 and 13.2 do not apply to:
- Either party's indemnification obligations
- Customer's payment obligations
- Either party's breach of confidentiality
- Damages caused by gross negligence, willful misconduct, or fraud
14. Indemnification
14.1 Customer Indemnification
You agree to indemnify, defend, and hold harmless DivineAPI, its affiliates, officers, directors, employees, and agents from any third-party claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to:
- Your breach of these Terms
- Your use of API-Generated Content in violation of applicable law
- Your products and services that incorporate API-Generated Content (except to the extent caused by DivineAPI's own breach or by the API-Generated Content as delivered)
- Your modification of API-Generated Content under Section 4(e)
- Your collection, processing, or transmission of End User data
- Any claim that your branding, marks, or content infringes third-party rights
14.2 DivineAPI Indemnification
DivineAPI will indemnify, defend, and hold harmless Customer from third-party claims that API-Generated Content, as delivered through the Service and used in accordance with these Terms, infringes a third-party intellectual property right (excluding patents).
DivineAPI's obligation under this Section 14.2 is subject to:
- The liability cap in Section 13.1
- Customer providing prompt written notice of the claim
- DivineAPI having sole control of defense and settlement
- Customer reasonably cooperating with the defense
14.3 Mitigation
If DivineAPI determines API-Generated Content infringes third-party rights, DivineAPI may, at its option:
- Procure the right for Customer to continue use
- Modify the Service to remove the infringement
- Terminate the affected portion of the Service and refund prepaid fees for the unused portion
15. Termination
15.1 By You
You may terminate your Subscription at any time through your account settings or by emailing admin@divineapi.com. Termination takes effect at the end of the current billing cycle.
15.2 By DivineAPI
We may suspend or terminate your access immediately for:
- Material breach of these Terms
- Non-payment of fees beyond 30 days
- Activity that creates legal risk for DivineAPI
- Activity that risks harm to DivineAPI, other customers, or third parties
- Reverse engineering, scraping, or abuse of the Service
15.3 Effect of Termination
On termination:
- All licenses granted under Section 4 terminate, except your right to retain previously published fixed-form content per Section 4.2
- You must immediately cease making new API calls
- All outstanding fees become immediately due
- Sections 6, 7, 11, 12, 13, 14, 17, and other provisions that by their nature should survive termination, will survive
16. Force Majeure
Neither party will be liable for any failure or delay in performance (except payment obligations) caused by circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, pandemic, government action, internet or telecommunications failures, third-party cloud infrastructure outages, or cyberattacks.
17. Governing Law and Dispute Resolution
17.1 Governing Law
These Terms are governed by the laws of India, without regard to its conflict-of-laws principles.
17.2 Arbitration
Any disputes arising out of or relating to these Terms or the Service that cannot be resolved through good-faith negotiation within 30 days will be resolved through binding arbitration in Delhi, India, under the Arbitration and Conciliation Act, 1996. The arbitration will be conducted in English. The decision of the arbitrator(s) will be final and binding.
17.3 Enterprise Carve-Out
For Enterprise customers, the governing law, venue, and dispute resolution provisions in this Section 17 may be modified by the executed MSA to align with mutual commercial preferences (e.g., governing law of England and Wales, or arbitration under the rules of the Singapore International Arbitration Centre for international parties).
17.4 Injunctive Relief
Notwithstanding the above, either party may seek injunctive relief in a court of competent jurisdiction to protect its intellectual property or confidential information.
18. General Provisions
18.1 Entire Agreement
These Terms (together with the Privacy Policy, Refund Policy, and any executed MSA) constitute the entire agreement between the parties and supersede all prior agreements and understandings.
18.2 Order of Precedence
In case of conflict between documents:
- Executed MSA (Enterprise customers only) prevails over Terms of Service
- Terms of Service prevails over website marketing content
- Specific provisions prevail over general provisions
18.3 Assignment
You may not assign these Terms without DivineAPI's prior written consent. DivineAPI may assign these Terms in connection with a merger, acquisition, or sale of assets.
18.4 Severability
If any provision of these Terms is held unenforceable, the remaining provisions remain in full force and effect.
18.5 Waiver
Failure to enforce any provision is not a waiver of future enforcement.
18.6 Notices
Notices to DivineAPI must be sent to admin@divineapi.com. Notices to you will be sent to the email address on file in your account.
18.7 Independent Contractors
The parties are independent contractors. Nothing in these Terms creates a partnership, joint venture, agency, or employment relationship.
18.8 Changes to These Terms
We may update these Terms periodically. Material changes will be notified via email and/or a notice on the Service at least 30 days before taking effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
