Terms & Conditions

 

1.SCOPE

These Terms and Conditions (“Terms”) apply to the contractual relationship of Embodiments, headquartered in Erlenbach ZH, Switzerland and the customer. The applicable version is the one at the time of the conclusion of the contract.

The company owns and operates the website Embodiments, offering online services and products (Purchase Law provisions) as well as offline coaching- and other services (Contract Law provisions) in the areas of behavioural change, fitness, nutrition and well-being in general.

These terms and conditions are an integral part of the contract and apply to the above-mentioned areas and other services that the company provides directly and indirectly to the customers. Exceptions shall only be valid if they have been expressly agreed upon in writing between Embodiments and the customer.

By accessing the Embodiments website you accept these terms and conditions. Do not continue to use Embodiments if you do not agree to take all of the terms and conditions stated on this page.

 

COACHING PROGRAMS

Embodiments provides content, courses, workshops, and resources to help customers create healthier habits and support in behavioral change. The customer agrees to abide by all policies and procedures outlined in this Agreement as a condition of their participation in any of our programs.

 

DISCLAIMER

As customer you understand that Embodiments is not an employee, agent, doctor, manager, therapist, registered dietician, or psychotherapist. By participatng in Embodiments resources and program will not treat or diagnose any disease, illness, or ailment and if they should experience any such issues they should see their registered physician or other practitioner as determined by their own judgment. Client understands that neither Embodiments or Chanel Rufli, has not promised, nor shall be obligated to the success in results and health of Client and that client has full responsibility for taking action and for own self-responsibility.

 

2.SALES OF GOOD    

2.1 CONCLUSION OF CONTRACT

By ordering any of our freebies, products or services, you agree to be bound by these terms & conditions. A sales contract between the parties is concluded as soon as the customer receives the order confirmation from Embodiments.

 

2.2 OBJECT OF PURCHASE

The object of purchase shall be the items ordered by the customer. Minor deviations from the objects shown in the online store or in brochures/inserts may apply.

Embodiments has the right to change the products, scope, price, etc. of the online offer at any time.

 

2.3 PURCHASE PRICES

All prices are in Swiss Francs (CHF) and applicable as in the online store at time of the order, excluding VAT. The total amount to be paid by the customer is listed at checkout. It consists of the purchase price, any shipping costs and value-added tax (VAT) if applicable.

 

2.4 PAYMENT

The customer is obliged to pay the invoiced amount before shipment or receipt of the purchased item via Paypal, credit card, bank transfer or cash. 

For shipments abroad, the shipping costs are not listed and are additional if not stated otherwise. In addition, the customer may incur customs duties and import duties of the destination country. 

 

2.5 SHIPPING AND DELIVERY

As a rule, the physical goods shall be shipped by parcel post to the address specified by the customer. The use and risk of the purchased goods shall pass to the customer at the time of delivery to the post office.

As a rule, the goods are dispatched within 5 working days of the order. Embodiments is not liable for any delay in delivery.

 

3. CONTRACTUAL TERMS 

3.1 OBLIGATIONS OF THE COMPANY

Embodiments cannot guarantee the success of a coaching, but commits itself to a careful and professional execution. Unless otherwise agreed, the Company will fulfil its obligation by providing the agreed services as was published online at the time of purchase.

 

3.2 OBLIGATIONS OF THE CUSTOMER  

3.2.1. CLIENT RESPONSIBILITY

Products developed by Embodiments are for strictly educational purposes ONLY. Client accepts and agrees that Client is 100% responsible for their progress and results from products developed by Embodiments. Embodiments makes no representations, warranties, or guarantees verbally or in writing. Client understands that because of the nature of products developed by Embodiments and their extent, the results experienced by each Client may significantly vary. Client acknowledges that, as with any business endeavor, there is an inherent risk of loss of capital and there is no guarantee that Client will reach their goals as a result of participation in products developed by Embodiments.

Embodiments programs and information is intended for a general audience and does not purport to be, nor should it be construed as, specific advice tailored to any individual. Embodiments assumes no responsibility for errors or omissions that may appear in any program materials.

The customer is obliged to exercise the rights of use only to the extent granted. The customer is fully responsible for the secure storage of his access data and passwords. The customer is responsible for the content of the collected data and information.

 

3.2.2. OTHER DUTIES

The company is entitled to check on the behavior of the customers in connection with the use of the companie’s internet platform. Embodiments only welcomes well-spirited, honest behavior in our community and as customers. Embodiments has the right to cancel any service or subscription linked to the practice of ageism, racism, sexism or any form of hate or behavior inflicting the well-being of other customers. Refunds will not be paid out.

 

3.3 SERVICE FEE

By using coaching or other services of Embodiments, the Customer agrees to pay the agreed fee. The fee for the coaching and the terms of payment are as agreed upon individually with the customer in advance. Unless otherwise stated, the fee does not include value-added tax.

 

4. WARRANTY, REFUNDS AND DEFECTS

4.1 DEFECTS

The Customer shall inspect the physical object of purchase immediately after delivery and, if he finds any defects, shall notify Embodiments thereof in writing within 7 days after delivery. Upon Embodiments’ request, the Customer shall return the defective object of purchase to Embodiments. A general right of return (without the presence of defects) is excluded, unless agreed in writing with Embodiments. 

 

4.2 REFUNDS

In general, we DO NOT offer refunds on our Embodiments programs unless stated otherwise.

Please note: If you opted for a payment plan, you are required by law to complete your payment plan. We reserve the right to seek recovery of any monies remaining unpaid via our Collection Agency.

 

4.3 CONDITIONAL GUARANTEE

We offer a 30-day Conditional Guarantee. We do not offer refunds. 

To request consideration for the Guarantee, Clients are required to complete the course, attend the coaching calls (or watch the replays), and submit a debrief from any of the strategies taught in Embodiments.

As mentioned above, all returns are discretionary. If you just downloaded the Training Material (PDFs, audios, videos, additional workbooks, and/or etc.), and then promptly asked for a return, we reserve the right to deny your request. Why? Because the point of the policy is to give people the chance to try the system, and if it doesn’t work, they can get their money back. It wasn’t designed to enable people to steal the Training Material.

 

4.4. DELIVERY WARRANTY

The company strives for a good availability of and takes reasonable precautions to protect from interventions by third parties.  However, it cannot guarantee the uninterrupted and trouble-free functioning of online platforms and online services offered. During the time of a possible repair, the customer has no claim to a replacement product.

 

5. INTELLECTUAL PROPERTY RIGHTS 

5.1 USE

Training materials provided by Embodiments are intended for personal use by the customer only. These rights of use are non-exclusive, non-transferable and limited to use by the customer. Any transfer to third parties and any other use, commercial or otherwise is prohibited. Any further use, publication and making available of information, images, texts or otherwise which the customer receives from Embodiments is prohibited, unless it is explicitly approved by the company.

If the customer uses contents, texts or pictorial material in connection with the company to which third parties have a protective right, the customer has to ensure that no third-party property rights are infringed.

 

5.2 RIGHTS

All documents are the exclusive property of Embodiments. Full or partial reproduction, transmission, modification, linking or use as well as transfer to third parties requires the prior written consent of Embodiments. Embodiments may make the use dependent on the payment of a license fee.

7. PERSONAL INFORMATION

All personal information you provide us with or that we obtain will be handled by Embodiments and their companies only. The personal information you provide will be used to ensure deliveries to you, to provide offers and information on our products and services to you. The information you provide is only available to Embodiments and will not be shared with other third parties.

You always have the right to inspect the information held about you or request to delete or correct the information. By accepting Embodiments terms, you agree to the above.

 

8. LIMITATION OF LIABILITY

Client agrees they used Embodiment’s services at their own risk and that the online offerings are an educational service being provided. 

Embodiments is not liable for any direct or indirect damages caused by the access or use of their products and services. Embodiments disclaims all liability for breach of duty or other forms of negligence as permitted by law. The liability for all indirect and direct damages and consequential damages is completely excluded. Client agrees that Company will not be held liable for any damages of any kind resulting or arising from including but not limited to; direct, indirect, incidental, special, negligent, consequential, or exemplary damages happening from the use or misuse of Company’s services or enrollment in the Program. Company assumes no responsibility for errors or omissions that may appear in any of the program materials.

By participating in physical exercise or training activities the customer agrees to be in good physical condition, is voluntarily participating in the online challenges and is doing so entirely at her own risks of injury or illness. Any recommendation for changes in diet including the use of food supplements are entirely the responsibility of the customer.

The customer acknowledges to have carefully read this “waiver and release” and fully understands that it is a release of liability.

 

9. CHANGES IN TERMS

The company may change the terms and conditions without prior notice at any time. The new version comes into effect by publication on the company’s website.

Unless the customer has agreed to a newer version of the terms and conditions, the version of the online terms & conditions at time of the purchase is valid and applies to the customers. 

 

10. APPLICABLE LAW / JURISDICTION

These terms and conditions are subject to Swiss law, to the exclusion of the UN Convention on Contracts for the International Sale of Goods. Unless otherwise stipulated in the individual contract between the parties or in these General Terms and Conditions, the provisions of the law of obligations (purchase contract: Art. 184 et seq., order: Art. 394 et seq.) shall apply.

For all disputes in connection with the contractual relationship between the parties, the exclusive place of jurisdiction shall be Erlenbach ZH, to the extent permitted by law.

 

11. TAKING EFFECT

These terms take effect on January 1, 2023.

Future changes and additions are possible at any time.

This Shop Policy provides information and guidelines for the purchase of physical products from our website.

SHIPPING FEES  

If shipping fee is not mentioned or not included, the Swiss Post shipping fees are valied within Switzerland.

For International fees please see the “International Shipping” Policies.

 

SHIPPING CARRIER

We use the regular Swiss Postal Service.

If you request different shipping, please contact us at hello(at)embodiments.ch prior to your order.  

 

DELIVERY 

You can expect your Embodiments physical pack to be delivered within a week in Switzerland, 1-2 weeks in Europe, and 2-4 weeks Internationally, depending on location. If on stock – it will be dispatched within 1-5 business days. It is sent with A-Post to the address given in the order by the client.

In case of loss of goods during shipping, the provider can not be made liable. 

 

INTERNATIONAL SHIPPING

International postal fees will apply if not included in the mentioned price. Currently we ship Delivery Duties Unpaid (DDU), and duties and taxes will not be displayed at checkout. Once the order lands in the destination country, payment of taxes and duties may be required to release the order from customs.

International Shipping flat rates are as follows:

EU CHF 19.- / International CHF 30.-

 

RETURN & REFUND

Physical products: The Customer shall inspect the physical object of purchase immediately after delivery and, if he finds any defects, shall notify Embodiments thereof in writing within 7 days after delivery. Upon Embodiments’ request, the Customer shall return the defective object of purchase to Embodiments. A general right of return (without the presence of defects) is excluded, unless agreed in writing with Embodiments. MODIFICATION OR CANCELLATION
