USER AGREEMENT
Terms and Definitions Used in This Agreement
"Game" — a competition organized by the Organizer at the Service Location, based on human physical activity, aimed at the physical and intellectual development of the person, improving motor skills, and promoting a healthy lifestyle. The Game meets the person’s need for active leisure and starts at the time indicated in the Organizer's schedule, taking place within a specified uninterrupted time frame in accordance with a scenario and conditions set by the Organizer, including the compliance with the Rules.
"Service Location" — a virtual reality location legally owned by the Organizer and selected by the User.
"Organizer" — the person providing the Service(s) to the User.
"Personal Data" — any information directly or indirectly related to a specific or identifiable individual (data subject).
"User" — an individual who has registered on the Website to book a Session and/or use the Organizer’s Services according to the terms of this Agreement.
"Rules" — mandatory requirements to be followed by each Participant while receiving Services, including but not limited to: age restrictions, participant composition and number of participants in the Game, health condition restrictions, and physical state of the Participant, etc., depending on the type of Service provided.
"Website" — the online resource located at warpoint.ru, providing information about the Services. The Website also allows the User to interact with the booking system to reserve a Game session at the desired time (Session), including available descriptions, images, availability, conditions, and session booking costs.
"Session" — a visit by the User to the virtual reality location, within a specific time frame, related to participation in the Game.
"Service(s)" — a set of activities carried out by the Organizer during the Game and other related activities as per the User’s, Participant’s (or their legal representative’s) request, or any other person wishing to participate in the Game personally or to ensure participation of another individual.
"Participant" — an individual receiving the Service(s) to participate in the Game.
1. General Provisions
1.1. This Agreement is a public offer under Articles 435 and 437 of the Civil Code of the Russian Federation and defines the terms of providing and receiving Services, as well as conditions for booking Services and using the Website. This Agreement is valid for the entire WARPOINT franchise network.
1.2. This Agreement enters into force from the moment the User and/or Participant (or their legal representative) expresses their consent to its terms in the manner defined in section 1.3 of this Agreement and remains in effect indefinitely until the Organizer and User and/or Participant have fulfilled their obligations or until this Agreement is terminated in accordance with the law.
1.3. By registering (by entering their Personal Data) on the Website, the User is considered to have fully reviewed and unconditionally accepted the terms of this Agreement in its entirety without limitations, in accordance with Article 438 of the Civil Code of the Russian Federation.
If the User does not fully agree or partially agrees with the terms of this Agreement, they are not allowed to use the materials and services of the Website or receive the Services.
1.4. The Organizer has the right to unilaterally make changes and/or additions to this Agreement at any time, without any special notice to Users, and to publish the updated version of the Agreement on the Website. The changes and/or additions, as well as the updated version of this Agreement, come into force upon publication on the Website. If the User does not fully or partially agree with the modified/added terms, or with the updated version of the Agreement, they are not allowed to use the materials and services of the Website or the Organizer’s Services.
1.5. If one or more provisions of this Agreement are found to be invalid due to changes in the applicable legislation of the Russian Federation or are declared invalid by a court decision, the invalidity of these provisions does not affect the validity of the other provisions of this Agreement.
1.6. The terms of use of the materials and services of the Website, as well as the Organizer's Services, are governed by this Agreement and other agreements (Policies, Rules) posted on the Website.
1.7. This Agreement is valid for individuals who acquire the right to receive the Organizer's Services either by using the Website or directly at the Service Location.
1.8. The current version of this Agreement is posted on the Website at https://warpoint.com/rules.
2. Service Provision Terms
2.1. To receive the Service, the User obtains Participant status as specified in section 4 of this Agreement and books a Session. A person wishing to receive Services can also contact the Organizer directly at the Service Location to participate in a Session at the nearest available time, subject to free spots.
2.2. Participation in the Game is allowed for Participants who meet the Game admission Rules as per section 4 of this Agreement, have booked, and fully paid for the Session.
2.3. The Organizer's working hours and the schedule of Games are posted on the Website and in the information zone at the Service Location.
2.4. The total number of Participants in the Game at the same time (during one Session) is at least 2 and no more than 10 people. The maximum number of participants may depend on the chosen Game. The duration of one Session is up to 60 minutes, including the preparation stage.
2.5. By paying for the Session, the User automatically confirms that they are ready to ensure the presence of Participants in the Game according to section 2.4 of this Agreement, who meet the admission requirements and other provisions of this Agreement.
2.6. To ensure the proper organization of the Game, the Organizer may provide additional Services. The terms, procedure, and cost of these Services are to be agreed upon by the Organizer and User/Participant separately.
2.7. The Organizer may organize various promotional activities to attract potential Participants to the Game (promotions, gift cards for participation, etc.). The terms and conditions of such promotional events will be communicated to the User through information posted on the Website, as well as through other methods determined by the Organizer. The Organizer’s loyalty programs (promotional events) are posted on the Website at https://warpoint.com/action.
2.8. The Organizer’s Website uses Cookies (small text files that store information about the User's actions on the Website and user settings. These files are stored on the User's computer or mobile device. The storage duration of each cookie depends on its type). By completing the registration procedure, the User agrees to the Website's use of cookies. The Organizer's cookie usage policy is posted on the Website at https://warpoint.com/cookie.
3. Booking and Payment of Services
3.1. The provision of Services to organize the Game is only possible with full prepayment in the amount and procedure defined by this Agreement.
3.2. When booking a Session through the Website, the User enters their data and registers the participation of all Participants in the Game. After the successful completion of the booking, the User receives an email from the booking system. The User is fully responsible for the accuracy of the data provided during the booking through the Website, necessary for identifying the User before the Session starts.
3.3. The User (Participants) pays the amount of the Session cost at the Service Location or through third-party payment services provided by the Organizer (for example, via online payment systems).
3.4. The Session can be booked no earlier than two weeks before the scheduled date (earlier if possible).
3.5. The cost of participating in the Game for the available Session is specified on the Website and includes the cost for one player. The total cost for all Participants is calculated based on the number specified by the User during the booking and in accordance with section 2.4 of this Agreement.
3.6. The payment for the Services can be made by the User or by another person on behalf of the User. The Session will be booked for the User whose data was provided during registration on the Website.
3.7. The Session booking may be rescheduled to another available date or canceled no later than 24 hours before the initially booked Session time.
4. Admission Rules for Participation in the Game
4.1. Participation in the Game is allowed for individuals aged 8 years and older.
4.2. Individuals aged between 8 and 13 years (inclusive) may only participate in the Game with written consent and in the presence of parents or legal guardians. The form of parental (legal guardian) consent for participation in the Game is available at request at any WARPOINT location.
4.3. Individuals aged between 14 and 17 years (inclusive) may participate in the Game without written consent from parents or legal guardians.
4.4. The physical and psychological condition of the Participant must meet the conditions and requirements for participation in the Game.
4.5. The following categories of individuals are prohibited from participating in the Game:

Prior to the Game, the Organizer conducts a briefing with the Participants and their legal representatives (if the Participant is under 14 years of age and the legal representative is present at the Service Location) to provide a detailed explanation of the rules of participation in the Game and to assess any potential risks of negative consequences for the Participants as outlined in sections 4.4 – 4.5 of this Agreement.
4.8. The Organizer reserves the unconditional right to refuse Services if there are doubts regarding the accuracy of the data provided by the Participant (or their legal representative) as specified in sections 4.1 – 4.3 of this Agreement, or if, following the briefing as per section 4.7 of this Agreement, the Organizer identifies any potential risks of negative consequences for the Participants.
4.9. The Participant and/or their legal representative have the right to voluntarily refuse participation in the Game at any time without providing reasons, subject to the conditions specified in section 3.7 of this Agreement.
4.10. If the Organizer refuses to provide Services before the start of the Session, no payment for Services will be charged, except in the case outlined in section 3.7 of this Agreement.
4.11. If the Participant violates the terms of the Agreement or provides false information as per sections 4.1 – 4.3 of this Agreement, which is disproven based on documents provided under section 4.6 or other evidence, or if the Participant or their legal representative voluntarily withdraws from the Game after paying for the Session, the Organizer will charge the User a penalty equivalent to the full cost of the Services that were to be provided.
4.12. The Participant must arrive at the Service Location no later than 15 minutes before the start of the booked Session. If the Participant is more than 10 minutes late, the Session will be canceled.
4.13. Before participating in the Game, the Participant must present an electronic ticket (e-mail or SMS notification with booking confirmation) if the Session was booked through the Website.
4.14. Participants under the age of 14 must be accompanied by their legal representative at the Service Location. If participation in the Game requires the Participant under 14 years old to be without supervision of legal representatives, they will not be allowed to participate, and the Organizer has the right to refuse Services without refund.
4.15. Participants aged 14 to 18 can arrive at the Service Location without their legal representatives.
4.16. Before participating in the Game, Participants must meet the Organizer's necessary organizational and hygiene requirements, as well as personal safety measures.
4.17. Smoking, eating, or drinking is prohibited during the Game. Participants who violate these requirements will not be allowed to participate.
5. Basic Safety Rules for Participation in the Game

6. Conditions for Using Website Materials and Services
6.1. The User must carefully read this Agreement.
6.2. The Organizer has the right to send Users informational and promotional messages (mailing lists) to the e-mail address and phone number specified in their Profile. The User may opt-out of receiving these messages by contacting the Organizer with a written request in any form.
6.3. The Organizer may unilaterally impose restrictions on the use of Website materials and services for all Users or for specific categories of Users.
6.4. The User is not permitted to use any devices, programs, procedures, algorithms, or methods, automatic devices, or equivalent manual processes to access, acquire, copy, or monitor Website content.
6.5. The User is prohibited from violating the security system or authentication procedures on the Website or any network related to the Website or Organizer.
6.6. The User is prohibited from using the Website or its content for any purposes prohibited by Russian Federation law or from inciting any illegal activity or activity that infringes upon the rights of the Organizer and/or others.
6.7. All objects available through the Website, including design elements, text, graphics, illustrations, videos, software, databases, music, sounds, and other objects posted on the Website (collectively referred to as "Content"), are the exclusive property of the Organizer and other rights holders. Any use of Content without the consent of its rightful owners is strictly prohibited.
7. Personal Data and Privacy Policy
7.1. The Organizer's Privacy Policy (Policy on Processing Personal Data) is posted on the Website at https://warpoint.com/privacy.
7.2. The Organizer does not conduct additional verification of the Personal Data provided by the User during registration on the Website, based on the principle of trust in the User.
7.3. The User bears full responsibility for any negative consequences resulting from the provision of inaccurate information during registration on the Organizer’s Website.
8. Responsibility. Limitation of Liability
8.1. The User, Participant, and their legal representative independently assess their ability and suitability for participation in the Game. The responsibility for any decisions made by the Participant or their legal representative regarding the receipt of Services, including the booking of a Session and/or participation (the right to participate) in the Game (including the submission of false documents, signatures, or other inaccurate information) is borne by the Participant and/or their legal representative.
8.2. Before booking a Session or paying for participation in the Game at the Service Location, the User, Participant, and/or their legal representative may request necessary information, clarifications, and comments from the Organizer regarding any issues related to the provision of Services, specific conditions for participation in the Game by certain individuals, or other essential conditions for providing and receiving Services.
8.3. The Organizer may refuse to answer any questions under section 8.2 of this Agreement if they are not related to the User, Participant, or their legal representative obtaining information as consumers, and if the questions are intended to gather information about the Organizer's business activities that is not required to be disclosed under applicable legislation.
8.4. All actions taken by Participants during the Game are carried out independently, under the full responsibility of the Participants or their authorized representatives.
8.5. In the event of damage to the Organizer's property or any third-party property used during the Game, the Participant or their legal representative agrees to immediately compensate for the cost of the damaged property.
8.6. All materials and services on the Website are provided "as is," with no guarantees of completeness or timeliness, and without any other express or implied warranties. Access to the Website and use of its materials and services are at the User's own discretion and risk.
8.7. The Organizer is not responsible for any errors, typos, or inaccuracies that may be found in the materials available on the Website.
8.8. Some links on the Website lead to external resources. These links are provided for the convenience of the Users and do not imply that the Organizer endorses the content of other websites or encourages the actions of their owners. Additionally, the Organizer is not responsible for the availability of these resources or their content. This statement applies to all links presented on the Website and materials of all websites accessible through banners and links on the Website.
8.9. The Organizer is not responsible for any illegal actions by the User or Participant towards third parties, or by third parties towards the User or Participant during the provision of Services or as a result of their provision.
8.10. The Organizer is not responsible for any damages, losses, or expenses (real or potential) arising from the Website, its use or inability to use, or for incomplete, inaccurate, or incorrect information provided by the User during registration.
8.11. The Organizer is not responsible for any delays or failures in the provision of Services or any part of them caused by force majeure, as well as any malfunctions in telecommunications, computer, electrical, and other related systems.
8.12. The Organizer is not responsible for the actions of payment systems, banks, or transfer systems, and for delays related to their operation if payment for Services involves such systems or structures.
8.13. In the case of any doubts about who is the proper recipient of the Services, the final decision is made by the Organizer.
8.14. The Organizer does not participate in the relationship between the User and/or Participant and/or their legal representative and/or any other person who made the payment but for reasons beyond the Organizer's control did not participate in the Game or did not receive other Services, transferred their rights to participate in the Game, or otherwise expressed their intention to refuse participation in the Game or transfer their rights to another person. In case of doubts about the authorized participant, the Organizer may consider the individual presenting the electronic ticket to be the authorized person, and in cases requiring a refund of the cost of Services as specified in this Agreement, the Organizer may refund the corresponding amount to that person (or their legal representative).

3. Booking and Payment of Services

3.2. When booking a Session through the Website, the User enters their data and registers the participation of all Participants in the Game. 3.3. The User (Participants) pays the amount of the Session cost at the Service Location or through third-party payment services provided by the Organizer (for example, via online payment systems).

3.5. The cost of participating in the Game for the available Session is specified on the Website and includes the cost for one player. The total cost for all Participants is calculated based on the number specified by the User during the booking and in accordance with section 2.4 of this Agreement.
3.6. The payment for the Services can be made by the User or by another person on behalf of the User. The Session will be booked for the User whose data was provided during registration on the Website.
3.7. The Session booking may be rescheduled to another available date or canceled no later than 24 hours before the initially booked Session time.
4. Admission Rules for Participation in the Game
4.1. Participation in the Game is allowed for individuals aged 8 years and older.
4.2. Individuals aged between 8 and 13 years (inclusive) may only participate in the Game with written consent and in the presence of parents or legal guardians. The form of parental (legal guardian) consent for participation in the Game is available at request at any WARPOINT location.
4.3. Individuals aged between 14 and 17 years (inclusive) may participate in the Game without written consent from parents or legal guardians.
4.4. The physical and psychological condition of the Participant must meet the conditions and requirements for participation in the Game.
4.5. The following categories of individuals are prohibited from participating in the Game:
- Individuals with limited health capabilities,
- Individuals with any kind of mental disorder,
- Individuals under the influence of alcohol and/or drugs,
- Individuals in soiled or dirty clothing, or without shoes,
- Aggressively inclined individuals,
- Individuals who do not comply with any other terms of this Agreement or do not meet the requirements specified herein,
- Any other individuals for whom participation in the Game may pose a risk of negative consequences for themselves or the Organizer (including property-related risks).
4.7. Prior to the Game, the Organizer conducts a briefing with the Participants and their legal representatives (if the Participant is under 14 years of age and the legal representative is present at the Service Location) to provide a detailed explanation of the rules of participation in the Game and to assess any potential risks of negative consequences for the Participants as outlined in sections 4.4 – 4.5 of this Agreement.
4.8. The Organizer reserves the unconditional right to refuse Services if there are doubts regarding the accuracy of the data provided by the Participant (or their legal representative) as specified in sections 4.1 – 4.3 of this Agreement, or if, following the briefing as per section 4.7 of this Agreement, the Organizer identifies any potential risks of negative consequences for the Participants.
4.9. The Participant and/or their legal representative have the right to voluntarily refuse participation in the Game at any time without providing reasons, subject to the conditions specified in section 3.7 of this Agreement.
4.10. If the Organizer refuses to provide Services before the start of the Session, no payment for Services will be charged, except in the case outlined in section 3.7 of this Agreement.
4.11. If the Participant violates the terms of the Agreement or provides false information as per sections 4.1 – 4.3 of this Agreement, which is disproven based on documents provided under section 4.6 or other evidence, or if the Participant or their legal representative voluntarily withdraws from the Game after paying for the Session, the Organizer will charge the User a penalty equivalent to the full cost of the Services that were to be provided.

4.17. Smoking, eating, or drinking is prohibited during the Game. Participants who violate these requirements will not be allowed to participate.
5. Basic Safety Rules for Participation in the Game
5.1. During the Game, the following actions are prohibited:
- Running or moving quickly,
- Lying on the floor,
- Passing through virtual walls and protective virtual nets,
- Removing the VR headset on your own,
- Moving backward,
- Getting too close to other players.
6. Conditions for Using Website Materials and Services
6.1. The User must carefully read this Agreement.
6.2. The Organizer has the right to send Users informational and promotional messages (mailing lists) to the e-mail address and phone number specified in their Profile. The User may opt-out of receiving these messages by contacting the Organizer with a written request in any form.
6.3. The Organizer may unilaterally impose restrictions on the use of Website materials and services for all Users or for specific categories of Users.

The responsibility for any decisions made by the Participant or their legal representative regarding the receipt of Services, including the booking of a Session and/or participation (the right to participate) in the Game (including the submission of false documents, signatures, or other inaccurate information) is borne by the Participant and/or their legal representative.
8.2. Before booking a Session or paying for participation in the Game at the Service Location, the User, Participant, and/or their legal representative may request necessary information, clarifications, and comments from the Organizer regarding any issues related to the provision of Services, specific conditions for participation in the Game by certain individuals, or other essential conditions for providing and receiving Services.
8.3. The Organizer may refuse to answer any questions under section 8.2 of this Agreement if they are not related to the User, Participant, or their legal representative obtaining information as consumers, and if the questions are intended to gather information about the Organizer's business activities that is not required to be disclosed under applicable legislation.
8.4. All actions taken by Participants during the Game are carried out independently, under the full responsibility of the Participants or their authorized representatives.
8.5. In the event of damage to the Organizer's property or any third-party property used during the Game, the Participant or their legal representative agrees to immediately compensate for the cost of the damaged property.
8.6. All materials and services on the Website are provided "as is," with no guarantees of completeness or timeliness, and without any other express or implied warranties. Access to the Website and use of its materials and services are at the User's own discretion and risk.
8.7. The Organizer is not responsible for any errors, typos, or inaccuracies that may be found in the materials available on the Website.
8.8. Some links on the Website lead to external resources. These links are provided for the convenience of the Users and do not imply that the Organizer endorses the content of other websites or encourages the actions of their owners. Additionally, the Organizer is not responsible for the availability of these resources or their content. This statement applies to all links presented on the Website and materials of all websites accessible through banners and links on the Website.
8.9. The Organizer is not responsible for any illegal actions by the User or Participant towards third parties, or by third parties towards the User or Participant during the provision of Services or as a result of their provision.
8.10. The Organizer is not responsible for any damages, losses, or expenses (real or potential) arising from the Website, its use or inability to use, or for incomplete, inaccurate, or incorrect information provided by the User during registration.
8.11. The Organizer is not responsible for any delays or failures in the provision of Services or any part of them caused by force majeure, as well as any malfunctions in telecommunications, computer, electrical, and other related systems.
8.12. The Organizer is not responsible for the actions of payment systems, banks, or transfer systems, and for delays related to their operation if payment for Services involves such systems or structures.
8.13. In the case of any doubts about who is the proper recipient of the Services, the final decision is made by the Organizer.
8.14. The Organizer does not participate in the relationship between the User and/or Participant and/or their legal representative and/or any other person who made the payment but for reasons beyond the Organizer's control did not participate in the Game or did not receive other Services, transferred their rights to participate in the Game, or otherwise expressed their intention to refuse participation in the Game or transfer their rights to another person. In case of doubts about the authorized participant, the Organizer may consider the individual presenting the electronic ticket to be the authorized person, and in cases requiring a refund of the cost of Services as specified in this Agreement, the Organizer may refund the corresponding amount to that person (or their legal representative).
