    Plenty of BREAKING posts for PM cases now, particularly on a decision like yesterday's, so I sat with the 9th Cir. decision overnight. Lots to complain about (or celebrate, ymmv), but two SCOTUS-related takes I haven't seen yet: 1) The opinion has a shelf life of ~2 months. 2)

    I’ll have more on this in the morning, but @mollyisonchain is exactly right. If you want to read the text, do that. If you want to legislate from the bench, do that. But don’t do B while telling me it’s A.

    Using words not in the statute to limit Congress's meaning of swap - strong disagree. "Based on its plain wording" the CEA "preempts state regulation of swaps that are 'traded or executed' on a DCM" - strong agree.

    Just caught up on today’s CFTC meeting. Two takeaways for me: (1) @luanalopeslara is a force (evergreen, but worth a reminder). (2) As she said, nascent markets create nascent issues. We can write new rules or others can write them for us. I’ll take the former.

    Fully agree, and I’ll take “30 years” as the outside date and “most small to medium” as the floor. Austin says it in the thread, but this will be gradual then all at once, and I don’t think the gradual phase is 3 decades.
