This Privacy Policy describes our policies on the collection, use, disclosure, of information about you in connection with your use of the Muck Rack Services, including (without limitation) all websites, mobile applications and other interactive properties through which the service is delivered (collectively, the “Service”). The Service is owned, operated and distributed by Muck Rack, LLC, a Delaware limited liability company (referred to in this Privacy Policy as “Muck Rack” or “we” and through similar words such as “us,” “our,” etc).

This Privacy Policy outlines the personal information that Muck Rack may collect, how Muck Rack uses and safeguards that information, and with whom we may share it. By using our Service or submitting personal information to Muck Rack, you acknowledge that you understand and agree to be bound by this Privacy Policy, and agree that Muck Rack may collect, process, transfer, use and disclose your personal information as described in this Policy. Further, by accessing any part of the Service, you are agreeing to our collection, use, and disclosure of information about you as described in, our Terms of Service and our Responsible Disclosure Policy. If you do not agree to any of these terms, you SHOULD NOT use the Service.

This Policy applies to all users, including users who are simply viewing content available via the Service, users who have subscribed for the Services, or are contributors of data and/or content via the Service. This Policy does not apply to journalists whose information may be available via the Service. Journalists should review our Journalist Privacy Notice for more information about the collection, use, and disclosure of their personal information.

Categories And Types of Information We Collect

During your use of the Service or through other communications with Muck Rack, personal information may be collected and processed by us. You may affirmatively provide us with certain personal information:

  • Personal Identifiers (such as your name, email address, phone number, mailing address, email receipt and open data);
  • Employment information (such as your employer or industry);
  • Billing information (such as your credit card number);
  • User content (any personal information about yourself or others that may be submitted as described in the Terms of Service).
  • Purchase Information — Purchase information, such as products and services obtained and transaction histories
  • Email content (if you choose to engage specific, optional messaging services as described below and in the Terms of Service).
  • Inferences — Inferences based on information about an individual to create a summary about, for example, an individual’s preferences and characteristics;
  • Geolocation Data (Physical location, generally)
  • Internet or other Electronic network or device activity information (Search history, information on interactions with the website or applications)

The preceding information may be provided by your employer in order to grant you access to the Service.

Please note that you should not submit to Muck Rack any sensitive data relating to your (i) racial or ethnic origin (ii) political beliefs (iii) philosophical or religious beliefs (iv) membership of a trade union or political party (v) physical or mental health or genetic makeup (vi) addictions, sexual life (vii) the commission of criminal offenses or proceedings and associated penalties or fines, or (viii) Social Security Number or other national identifier. If you provide such sensitive data Muck Rack, that data will be promptly deleted.

Muck Rack has not collected and will not collect characteristics of protected classifications under applicable laws, biometric information, education information; and sensitive data as described above, other than account logins and encrypted passwords. Although neither required nor recommended, it is your choice to provide any of the foregoing information in connection with the Service and to make that information public.

Please do not post on the Site or add to your account any personal data that you would not want to be publicly available.

Sources of Personal Information

We receive your personal information from any one or more of the following sources:

  • Directly from you. When you visit the Site, log-in as a registered user, or provide your information in a form on the Site, we will collect and store that information.
  • Indirectly from you. When you navigate and interact with the Site, some information is automatically collected by cookies and similar technologies. Not all information collected may be personal information, and some cookies are necessary to use different functionalities of the Site. The personal information collected may include information about your computer and internet connection, like IP address, operating system, and browser type.


How Does Muck Rack Use Collected Information?

Any personal information that you voluntarily disclose online (in messages, news articles and chat areas, within your public profile page, through a User Submission, etc.) becomes publicly available and can be collected and used by others. Once that personal information is made public, Muck Rack does not control subsequent use of that personal information, and you may be unable to exercise your data privacy rights as described in this Policy.

We use information, including personal information, that we collect about you or that you provide to us for a variety of purposes, including:

  • To present the Service and its content to you;
  • To allow you to participate in interactive features on the Service;
  • To provide you with information, products, or services that you request from us;
  • To fulfill any other stated purpose for which you provide it, which may be disclosed outside of this Privacy Policy;
  • To improve the Service and enhance the security of the Service;
  • To deliver content, including ads, relevant to your interest in our Service.
  • To comply with legal obligations


Aggregated And Anonymized Data

Muck Rack may aggregate, anonymize, and analyze User Content (during and after the Term), for (i) improvements to the Services; (ii) internal research, (iii) performance analytics; (iv) machine learning; and (v) product development.

Muck Rack may retain aggregated and anonymized, personal data, such as: (i) your approximate geographic position and your time zone; (ii) IP Address; (iii) the web browser and its version you are using; (iv) the version of your mobile application (when applicable); and (v) the operating system of your computer or device to improve the quality and design of the Service and to create new features, promotions, functionality, and services by storing, tracking, and analyzing user preferences and trends. Muck Rack may also use third-party services to track and analyze trends in User behavior. Disclosure of such information to third parties will be in an aggregated, de-identified, and anonymized format such that no Customer nor any individual or household Customer Data can be identified.

In addition to the above, Muck Rack offers the ability to connect your own email address directly to the Muck Rack messaging services through use of a third-party API. If you choose to use such a connection, Muck Rack and the third-party provider will be granted specific, limited access to certain data available through your email service (Gmail, Microsoft, etc.). Notwithstanding anything else in this Privacy Policy, if you provide Muck Rack and its third-party processor access to your email data, the use of that data will be subject to these additional restrictions:

  • Muck Rack will only use access to read, write, modify, or control email message bodies (including attachments), metadata, headers, and settings to provide a web email client that allows users to compose, send, read, and process emails and will not transfer this email data to others unless doing so is necessary to provide and improve these features, comply with applicable law, or as part of a merger, acquisition, or sale of assets.
  • Muck Rack will not use this email data for serving advertisements.
  • Muck Rack will not allow humans to read this data unless we have your affirmative agreement for specific messages, doing so is necessary for security purposes such as investigating abuse, to comply with applicable law, or for the Service’s internal operations and even then only when the data have been aggregated and anonymized.

If you have not opted out of receiving marketing communications from us, we may use your email address, phone number or other personal information to send commercial or marketing messages. We also may use your email address, phone number and other personal information for non-marketing or administrative purposes (such as notifying you of major Service changes, policy and subprocessor updates or for customer service purposes). You cannot opt out of receiving communications for non-marketing or administrative purposes without discontinuing your use of the Service.


Cookies and File Log Information

By using the Service, Muck Rack may collect certain non-personal information:

  • Information Collected by “Cookies”: When you access the Service, we may send one or more “cookies” to your computer. A “cookie” is a small line of text that is stored with your browser, which we use to help provide better service to you. We use ephemeral cookies for session tracking and analytical cookies for anonymized and non anonymized traffic analysis. You have the option to manage your cookie preferences. This information is provided in the Muck Rack Cookie Notice. We may use cookies for many purposes, including (without limitation) to save your password so you don’t have to re-enter it each time you visit the Service, and to deliver content (which may include third party advertisements) specific to your interests.
  • Log File Information: Our servers automatically record certain information that your browser sends whenever you access the Service. These server logs may include information such as your web request, Internet Protocol (“IP”) address, browser type, browser language, referring / exit pages and URLs, platform type, number of clicks, domain names, landing pages, pages viewed and the order of those pages, the amount of time spent on particular pages, the date and time of your request, and one or more cookies that may uniquely identify your browser.

Do Not Track

Muck Rack does not currently respond to Do-Not-Track signals. You may adjust your preferences for certain tracking, for example, by disabling cookies or using “private” browsing modes.


How We Share Your Information

We will not share your personal information with other, third-party companies for their commercial or marketing use without your consent or except as part of a specific program or feature for which you have the ability to opt-in or opt-out.

We may provide personal information to Muck Rack employees, consultants, affiliates or other businesses or persons for the purpose of processing such information on our behalf. In such circumstances, we require that these parties agree to protect the confidentiality of such information and to comply in all respects with this Privacy Policy.

If you choose to engage specific, optional services as described in the Terms of Service (e.g. PressPal), or in order to connect your email address to Muck Rack’s messaging services, Muck Rack may share your email content with our third-party provider that facilitates that connection. Such connection will only occur after you take appropriate steps through the Service and your own email provider to authorize such access. The data collected and shared as a part of that service will be limited as described above and in Muck Rack’s Terms of Service.

We may share non-personal information (such as anonymous User usage data, referring / exit pages and URLs, platform types, number of clicks, etc.) with interested third-parties to assist them in understanding the usage patterns for certain content, services, advertisements, promotions, and/or functionality on the Service.

In addition, we may release personal information: (i) to the extent we have a good-faith belief that such action is necessary to comply with any applicable law, enforce any provision of the Terms of Service, protect ourselves against any liability, defend ourselves against any claims, protect the rights, property and personal safety of any user or protect the public welfare; or (ii) to respond to a court order, subpoena, or search warrant.


Communications

We may use the information you provide to Muck Rack to market and promote the Service, for sharing renewal information, to provide customer support, for administrative messaging, and other communications and offerings. We will contact you through email, mobile phone including text messages, notices posted on our website and other ways through our Services. Where required by law, we will only send marketing communications with your consent.

Otherwise, we will market and advertise our products and services on the basis of our legitimate business interests.

You may change your communication preferences at any time by contacting us at privacy@muckrack.com. If you unsubscribe from our marketing lists, we will continue to contact you regarding administrative matters, and to respond to your requests. Please be aware that you cannot opt out of receiving service messages from us, including security and legal notices.

If you have a call scheduled with a Muck Rack representative, we may record and transcribe the call. You will be notified prior to the call that the call is being recorded, and you will be offered an opportunity to opt-out of having the call recorded.

COLLECTION OF PHONE NUMBERS

We collect your phone numbers only when you voluntarily provide them to us, for example, during transactions, inquiries, or when you sign up for our promotional messages. You can opt in to receive these SMS messages by providing your phone number.

USE OF PHONE NUMBERS FOR SMS

Your phone numbers are primarily used to provide you with personalized services, updates, and promotional offers. These text messages may relate to our products, services, discounts, or any updates that we think may interest you. We may also provide special discounts or offers through SMS messages. SMS messaging charges may be applied by your carrier. We will only share your phone number with our SMS provider, subject to their privacy policy. We use Zoom Phone to send all SMS communications to users who have opted in.

OPTING OUT OF MARKETING MESSAGES

If at any time you wish to stop receiving marketing SMS from us, you can opt out by:

  • Texting STOP to opt-out
  • Texting UNSUBSCRIBE to opt-out
  • Texting CANCEL to opt-out
  • Texting QUIT to opt-out

Please note that the opt-out process may take up to 30 business days to become effective. During this period, you may still receive some messages from us.

PRIVACY OF PHONE NUMBERS

Once you have opted out, we will not send you any more SMS messages, nor will we sell or transfer your phone number to another party.

No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

ACCESS TO PROMOTIONS AND DISCOUNTS

You do not need to sign up for SMS Messages to receive information about current promotions.


International Data Transfer

If you are located outside the United States, in particular if you are located in Switzerland or the European Union (EU), please note that Muck Rack is a US based company. If you use the Service, all information, including personal information, will be transferred to Muck Rack (including third parties to which data was disclosed as described above) in the United States and any information made public via our website may be viewed by individuals located anywhere in the world. Although this may include recipients of information located in countries where there may be a lower level of legal protection for your personal information than in your country, we will protect your information in accordance with requirements applicable to the law in your particular jurisdiction. By using the Service, you unambiguously consent to the transfer of your personal information and other information to the United States and elsewhere for the purposes and uses described herein.



EU Data Privacy Rights

If you are a resident or are otherwise located in the European Union ("EU") or the United Kingdom ("UK"), this section provides additional details about the personal data we collect about you, and your rights granted by the EU and UK General Data Protection Regulations, as applicable (“GDPR”).

Subject to certain limitations, the GDPR provides you the following privacy rights:

  • Transparency and the right to information. Through this Privacy Policy we explain how we use and share your personal information. However, if you have questions or concerns you can contact us at privacy@muckrack.com.
  • Right of access, restriction of processing, correction, erasure, and portability (commonly known as a "data subject access request"). This enables you to receive a copy of the personal data we hold about you and to check that we are lawfully processing it. You can make a request to access, object, restrict, correct, erase, or transfer any of your personal information by filling out Muck Rack's Global Privacy Request Form. You also have the right to withdraw your consent when we process your personal information based on your consent.
  • Right to Object to processing of your personal data where we are relying on a legitimate interest (or those of a third party) and there is something about your particular situation which makes you want to object to processing on this ground as you feel it impacts on your fundamental rights and freedoms. In some cases, we may demonstrate that we have compelling legitimate grounds to process your information which override your rights and freedoms.
  • Right to opt-out from direct marketing. You have the right to opt-out from receiving marketing materials from us by following the opt-out instructions in our commercial emails, by contacting us, or by adjusting your preferences under your profile details on the Site.
  • Right not to be subject to an automated decision, including profiling. We do not make automated decisions using your personal data that may negatively impact you. We use cookies and similar technologies on the Site to personalize your experience on the Site and recommend software products and services that may be of interest to you.
  • Right to lodge a complaint with a supervisory authority. If you consider that the processing of your personal information infringes your GDPR privacy rights, you have the right to lodge a complaint with a supervisory authority, in the member state of your habitual residence, place of work, or place of the alleged infringement. Muck Rack will retain your data for the length of time you engage with Muck Rack’s services until you request deletion, in writing, of such personal information. Muck Rack will take reasonable steps to permit individuals to correct, amend, delete, restrict processing of, and request portability of the personal information we hold about you. Muck Rack also relies upon each individual to assist in providing accurate updates of his or her personal information.

If you would like to submit a request to Muck Rack to exercise your EU or UK privacy rights under the GDPR, including deletion of your personal information or other requests regarding your personal information that is processed by Muck Rack, you can submit a request online by filling out Muck Rack’s Global Privacy Request Form.

Legal Basis for Processing (EEA, Switzerland and United Kingdom only)

Our legal basis for collecting and using your personal information will depend on the type of information and the context in which we collect it.

However, we will normally collect personal information from you only in the following circumstances:

  • We have your express consent to do so;
  • We need the personal data to perform a contract with you; or
  • Processing is in our legitimate interests and is not overridden by your data protection interests or fundamental rights and freedoms.

In some cases, we may also have a legal obligation to collect personal information from you to protect your vital interests or those of another person (for example, to prevent, investigate or identify possible wrongdoing in connection with the Site or to comply with legal obligations).

If we ask you to provide personal information to comply with a legal requirement or to perform a contract with you, we will identify such basis for processing at the relevant time and let you know if the provision of your personal information is mandatory or not (as well as the possible consequences associated with not providing such information).

If we collect and use your personal information in reliance on our legitimate interests (or those of any third party), this interest will typically be to operate the Site, communicate with you in relation to your account or the Site, to measure interest in and improve our offerings and Site, to engage in marketing activities, and to otherwise customize your experience with Muck Rack.

California Privacy Rights

If you are a resident of California, theMuck Rack California Consumer Privacy Act notice applies to you and supplements the Muck Rack Privacy Policy. This notice is intended to provide certain information to you as required by the California Consumer Privacy Act (CCPA)/California Privacy Rights Act (CPRA).

This notice applies to information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with you such as your real name, alias, postal address, unique personal identifier, online identifier Internet Protocol address, email address, account name, other similar identifiers (“Personal Information”) or Social Security number (SSN), driver’s license, state identification card, or passport number; account log-in, financial account, debit card, or credit card number in combination with any required security or access code, password, or credentials allowing access to an account (“Sensitive Personal Information”).

Personal information does not include publicly-available information, de- identified or aggregated consumer information and certain other information that is regulated by other applicable laws.

Subject to some limitations and exceptions you have the following rights:

  • That we provide you access to details on the categories or specific pieces of personal information we collect (including how we use and disclose this information);
  • That we delete any of your personal information;
  • That we correct any inaccuracies in your personal information;
  • That we provide the business or commercial purpose for collecting your personal information.
  • If your personal information was disclosed for a business purpose, the personal information categories disclosed and the categories of third parties to which the information was disclosed.
  • That we allow you to opt out of any “sale” or "sharing" of your personal information that may occur, including sensitive personal information; and
  • If your personal information was sold in the past 12 months, the personal information categories sold and the categories of third parties to which the information was sold.
  • To not be discriminated against for exercising any of the above rights.

Please note that you may only make the above requests twice in a 12-month period. You also have the right to request that any of your personal information collected and retained be deleted, subject to certain exceptions.

After we receive your verified request we will provide you with the following in accordance with the time period allowed under the applicable law:

  • The categories of personal information we have collected from you
  • The categories of personal information we have shared about you and the categories of third parties to whom we shared such information, by category or categories of personal information for each category of third parties to whom the personal information was shared; and
  • The categories of personal information that we disclosed about you for a business purpose.

Muck Rack does not collect sensitive personal information other than account login and password from its users.

If we receive a CCPA or CPRA request from you, we will first make a determination regarding the applicability of the law, and we will then take steps to verify your identity prior to responding. We will verify your request using information associated with your account, including your email. Further identification may be required. You may also designate an authorized agent to act on your behalf.

Please note that Muck Rack may retain a record of your request to delete your personal information.


Virginia Privacy Rights

If you are a resident of Virginia, this section provides information about your privacy rights under the Virginia Consumer Data Protection Act ("VCDPA").

Subject to certain limitations, the VCDPA affords you the following rights:

  • To confirm whether we are processing your personal information, and to access that personal information;
  • To receive your personal information in a portable and readily usable format;
  • To correct inaccuracies in your personal information;
  • To delete your personal information;
  • To opt out of the processing of your personal information for targeted advertising, sale to third parties, or profiling where there is a legal or similarly significant effect on you.

You may exercise these rights by emailing us at privacy@muckrack.com and by updating your cookie preferences.

Please note that Muck Rack does not collect sensitive personal information as defined by VCDPA.


Third Party Advertisers

We may allow other companies, called third-party ad servers or ad networks, to serve advertisements within the Service. These third-party ad servers or ad networks use technology to send, directly to your browser, the advertisements and links that appear on the Service. They automatically receive your IP address when this happens. They may also use other technologies (such as cookies, JavaScript, or Web Beacons) to measure the effectiveness of their advertisements and to personalize the advertising content you see. You should consult the respective privacy policies of these third-party ad servers or ad networks for more information on their practices and for instructions on how to opt-out of certain practices.


Third Party Services

This Privacy Policy does not address, and we are not responsible for, the privacy, information or other practices of any third parties, including any third party operating any website or service to which the Services link. The inclusion of a link on the Services does not imply endorsement of the linked site or service by us.

In addition, we are not responsible for the information collection, use, disclosure or security policies or practices of other organizations, or any other app developer, app provider, open-source software, social media platform provider, operating system provider, wireless service provider or device manufacturer, including with respect to any personal information you disclose to other organizations through or in connection with our Service.

  • Interacting with PressPal

You may choose to interact with a feature within the Service called PressPal, which allows you to generate, via ChatGPT/AI, a press release given a prompt (e.g. "Flying Car"). Muck Rack will subsequently use keywords from this generated text to search our database and provide a list of potentially relevant journalists. Any data shared in this experience will be shared with our AI vendor, (Open AI) who may keep a copy of your text or audio responses for their own purposes. Please do not enter any of your personal data.

Use of the PressPal Feature shall be in accordance with the Muck Rack AI Terms and Conditions.


Is My Information Secure?

We have implemented appropriate administrative, technical, and physical security measures to protect personal information collected on the Service against loss, misuse or alteration. In addition, your account information is protected by a password for your privacy and security. Our security and privacy policies are periodically reviewed and enhanced as necessary, and only authorized personnel have access to personal information that you have not published on the Site. It is important that you protect against unauthorized access to your password and to your computer by logging off once you have finished using a shared computer. Moreover, despite the precautions described above, we cannot and do not guarantee that the individual user information you have transmitted will not be intercepted by others and/or decrypted or accidentally disclosed, and we accept no liability for any unintentional disclosure.


Data Retention

Muck Rack retains your personal information for as long as necessary to provide our services or during the period in which we have an ongoing legitimate business interest, to prevent, investigate, or identify possible wrongdoing in connection with the Site or to comply with legal obligations. With respect to personal information that has been collected using cookies and similar tracing technologies, you can adjust and/or disable certain tracking. Information that you submit through your user profile is retained for the lifetime of your account with us.


Merger, Sale, or Bankruptcy

In the event that we are acquired by or merged with a third party entity, Muck Rack reserves the right to transfer or assign the information we have collected from users as part of such merger, acquisition, sale, or other change of control. In the unlikely event of our bankruptcy, insolvency, reorganization, receivership, or assignment for the benefit of creditors, or the application of laws or equitable principles affecting creditors’ rights generally, we may not be able to control how your personal information is treated, transferred, or used.


Children’s Privacy

The Site is a general audience site and does not offer services directed to individuals under 13 years of age.

No one under the age of 13 may provide any information to or on the Site. We do not knowingly collect or share personal information from individuals under 13.

If you are under 13, do not use or provide any information on the Site or on or through any of its features, do not register on the Site, use any of the interactive or comment features of the Site, or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use. Should an individual whom we know to be under the age of 13 send personal information to us, we will delete or destroy such information as soon as reasonably possible. Changes to This Privacy Policy

This Privacy Policy is current as of the last updated date set forth above. Muck Rack reserves the right to modify this Privacy Policy from time to time in order that it accurately reflects the regulatory environment and our data collection principles. When material changes are made to this Privacy Policy, Muck Rack will post the revised Statement on our website. You acknowledge that your continued use of the Site and/or continued provision of personal information to Muck Rack after we publish an updated Privacy Policy will be considered acceptance of any changes to this Privacy Policy.
