WARN Notice/ResourcesWARN Notice and Transition Guide
The WARN Act Notice was provided to Spirit employees pursuant to the Worker Adjustment and Retraining Notification Act (WARN Act), a federal statute requiring certain employers to give their employees written notice of plant closings or mass layoffs.
Since the shutdown of the airline on May 2nd, we filed a claim on behalf of all Spirit Flight Attendants over the company’s failure to abide by the WARN Act’s requirement to provide at least 60 days’ notice of their closure. Similarly, we also filed a grievance over the company’s failure to provide notice before furloughing under the furlough section of our Collective Bargaining Agreement. The company is arguing that they did not have to provide this notice under a legal defense called the “faltering company” exception. But we are arguing that you are entitled to these damages and the company should have provided notice sooner and that you should be compensated for that time, including the value of healthcare.
