Litigation

Protecting your products, intellectual capital, human resources, and time.

The Litigation Group at LP handles a wide range of business disputes and commercial litigation, including real estate litigation, debtor-creditor disputes, finance and bankruptcy litigation, labor and employment disputes, insurance coverage disputes, trusts & estates litigation, and professional liability litigation. We know our way around the courtroom, using the judicial process to get our clients the best results possible.

Our litigation attorneys also represent clients in mediations and arbitrations. For many disputes, businesses find nonjudicial methods of resolution increasingly beneficial as these avenues are often more cost-effective and less time-consuming than conventional court proceedings. The speed, flexibility, finality, and confidentiality of these alternative settings are appealing and can serve to maintain or strengthen business relationships with adversaries.

While there is no shortage of litigation attorneys that can competently represent sophisticated and successful business owners and institutional clients, we take the time to really understand your goals and articulate a litigation strategy from start to finish.

We are more than great litigators; we are also dedicated business counselors. We understand that “winning” means different things for different clients, so we take the time to understand your objectives and goals. We advise clients on best practices and help clients protect their assets and capital through well-thought-out strategies.  Sometimes litigation is unavoidable, and when this is the case, we plan, communicate, and stick to a budget so that you can focus on running your business.

Our litigation services include:

  • Commercial litigation
  • Real estate litigation
  • Broker-dealer litigation
  • Trusts & estates litigation
  • Finance & lending disputes
  • Bankruptcy litigation

Practice Areas

Commercial litigation

We represent clients in a wide range of commercial litigation and business disputes, including those involving contractual disputes; LLC and partnership disputes; trade secrets, restrictive covenants, and employment contracts; real estate disputes; equal employment issues; and financing disputes.

Real estate litigation

Whether a real estate joint venture, a commercial leasing arrangement, or a real estate development, we take a proactive approach to counseling and advice so that the risk of a dispute is minimized. When disputes do arise, we litigate the cases efficiently so that a favorable resolution is reached as soon as possible.

Broker-dealer litigation

We offer a national broker-dealer litigation practice, representing individual brokers and national investment firms in securities brokerage litigation and arbitration in state and federal courts, and before the Financial Industry Regulatory Authority (FINRA), on issues including Protocol compliance, trade secret, non-competition and non-solicitation covenant litigation (both prosecuting and defending firms and brokers), as well as employment-related disputes and transition bonus collection matters.

Trusts & estates litigation

Our trust and estate litigators bring a wealth of experience to the table, representing mid- to high-net-worth individuals, estate executors and administrators, guardians, and individual and corporate trustees, among others. Our practice includes litigating will contests, estate claims, corporate fiduciary disputes, contested guardianships, heirship disputes, and trust-administration controversies, as well as family business conflicts of all types.

Finance & lending disputes

Our attorneys handle a wide range of finance and lending disputes, beginning with the exploration of any out-of-court workout options. If litigation is necessary, our team of formidable litigators is well versed in enforcement options, from commercial foreclosures, to Article 9 UCC Sales, to breach of note and guaranty cases in multiple jurisdictions and venues. Whether defending against or enforcing remedies, LP is well conditioned to work out a distressed credit.

Bankruptcy litigation

Our prominent restructuring attorneys know their way around a courtroom, having successfully litigated numerous bankruptcy issues, including cash collateral and adequate protection disputes, post-petition financing contests, automatic stay disputes, contested confirmation hearings, claim objections, and adversary proceedings. Keenly familiar with market, strategic, and procedural options, combined with a vast network of connections, our restructuring attorneys are able to create tailored litigation strategies that achieve unparalleled results in an efficient and cost-effective manner.

AI and Technology

We leverage a multidisciplinary team at the forefront of AI, GenAI, and similar technologies — both established and emerging. We combine our deep industry experience with focused legal knowledge of the transactional, litigation, intellectual property, information technology, employment, cybersecurity, and data privacy issues that come into play when adopting these technologies.
