Responsible use policy
This Responsible Use Policy (“RUP”) supplements the Base44 Terms of Service, or any other agreement or order form between Wix.com Ltd. (including its subsidiaries and affiliates), which operates the Base44-branded services (“Base44”) and you, being any Customer or User thereof (“you”), governing the use of Base44’s Platform, Website, the Generated Output or other products and services (each of the foregoing, together and separately, the “Agreement”). The RUP applies to your access and use of the Platform, Customer Data (including the Input Data you provide to the Platform and the Generated Output created on its basis), whether as part of your Platform or your use of Generated Output outside of it. Capitalized but undefined terms used in the RUP have the meanings set forth in your applicable Agreement with Base44.
You will not share with the Platform any Input Data that, nor knowingly use the Platform to generate any Generated Output or use or make available to others any Generated Output:
1.
That in any way violates any applicable national, federal, state, local or international law or regulation;
2.
Generating and distributing spam in violation of the CAN-SPAM Act of 2003 and other applicable laws;
3.
For the purpose of exploiting, harming or attempting to exploit or harm minors in any way;
4.
Contains pornographic, sexually explicit, or adult content;
5.
To generate or disseminate verifiably false, misleading or deceptive information and/or content (including with regard to medicine, health and science);
6.
To generate or disseminate personal identifiable information that can be used to harm an individual;
7.
To generate or disseminate information and/or content (e.g. images, code, posts, articles), and place the information and/or content in any context (e.g. bot generating tweets) without expressly and intelligibly disclaiming that the information and/or content is machine generated;
8.
To defame, disparage, cyber-bully or otherwise harass others, or encourage self-harm or harm to others;
9.
To impersonate or attempt to impersonate (e.g. deepfakes) others without their consent;
10.
For fully automated decision making that adversely impacts an individual’s legal rights or otherwise creates or modifies a binding, enforceable obligation;
11.
For any use intended to or which has the effect of discriminating against or harming individuals or groups based on online or offline social behavior or known or predicted personal or personality characteristics, or in a manner that is obscene, violent, hateful, racist or discriminatory or is otherwise offensive;
12.
To exploit any of the vulnerabilities of a specific group of persons based on their age, social, physical or mental characteristics, in order to materially distort the behavior of a person pertaining to that group in a manner that causes or is likely to cause that person or another person physical or psychological harm;
13.
For any use intended to or which has the effect of discriminating against individuals or groups based on legally protected characteristics or categories;
14.
To engage in political lobbying or campaigns to actively influence the decisions of government officials, legislators, or regulatory agencies on legislative, regulatory, or policy matters;
15.
To facilitate, promote, or publish content related to terrorist organizations, violent extremist groups, or entities designated as such by national or international authorities, or to systematically promote violence against civilians or specific groups;
16.
To offer, sell, or otherwise facilitate transactions in, or otherwise promote illegal goods and services, including but not limited to: illegal drugs and controlled substances, human trafficking, products made from endangered or protected species, illegally obtained materials, illegal sale or transfer of weapons, firearms, ammunition, explosives, instructions on making weapons, or illegal online casinos, gambling, sports betting, pyramid schemes, or Ponzi schemes;

To engage in phishing, fraudulent schemes, scams, chain letters, or any form of web forgery designed to trick individuals into providing sensitive information such as passwords, account details, financial information, or other confidential data;

To use any robot, spider, crawler, scraper, or other automatic device, program, script, algorithm, or methodology to access, acquire, copy, or monitor any portion of the Base44 services, their data or content, or to reproduce or circumvent the navigational structure or presentation of the Base44 services in any way not purposely made available;
19.
To publish, post, or disseminate other people's private or personal information without their express prior consent, including but not limited to addresses, phone numbers, email addresses, identification numbers, or financial information;
20.
To create, post, or allow the creation or posting of reviews, ratings, feedback, or user-generated content in a fraudulent or deceptive manner, including but not limited to: paid-for fake reviews, allowing the posting of reviews in exchange for payment or other compensation, or otherwise engaging in review manipulation to artificially influence ratings or rankings;

To provide medical advice and medical results interpretation, or promote pharmaceutical or medical products and services, without having the qualifications, licenses and permits required by applicable law;
22.
To engage in and promote regulated services and professions, and/or deliver any regulated products or services, including but not limited to legal and accounting services, investment advice, insurance, banking and securities, without having the qualifications, licenses and permits required by applicable law;
23.
To generate or disseminate information for the purpose to be used for administration of justice, law enforcement, immigration or asylum processes, such as predicting an individual will commit fraud/crime commitment (e.g. by text profiling, drawing causal relationships between assertions made in documents, indiscriminate and arbitrarily-targeted use);
24.
To infringe, violate or misappropriate any patent, trademark, trade secret, copyright, or other intellectual property or other proprietary rights of any other person;
25.
To transmit or otherwise makes available any malicious code, including any virus, worm, trojan horse, time bomb, web bug, spyware, or any other malicious or harmful computer code, library, file, or program;
26.
To circumvent the technical and other safeguards set out by Base44 or our Third- Party Service providers meant to ensure adherence with the RUP and such Third- Party Service providers' equivalent usage policies, as applicable.
27.
In connection with any prohibited use, as defined in applicable laws and regulations (including, but not limited, to Regulation (EU) 2024/1689 of the European Parliament and of the Council, also known as the EU Artificial Intelligence Act);
28.
In connection with any high-risk or regulated product, service or use-case, without fully complying with the applicable laws and regulations (including, but not limited, to Regulation (EU) 2024/1689 of the European Parliament and of the Council, also known as the EU Artificial Intelligence Act).
To the extent the Platform or Generated Output generate Generated Output containing any of the above, you will notify us in writing without undue delay upon becoming aware of it.
Enforcing the RUP, including the determination whether a violation occurred and determining its severity, is at Baser44’s sole and complete discretion, and failure to enforce it in one instance does not constitute a waiver to enforce it in any other instances.
You will promptly cease use of any Customer Data, Input Data or Generated Output violating this RUP, and Base44 has the right to promptly remove or delete any violating Customer Data, remove violating Generated Output from the Platform and Website in its sole discretion or modify the Platform to ensure compliance with the RUP and applicable law.
Action We May Take Against Illegal Content and Violations of the Base44 Agreement
Based on the "Good Samaritan" provision outlined in the DSA, Base44 may undertake voluntary investigations aiming to identify and act against illegal content, whether proactive or reactive measures. Base44 may employ the following measures:

Automatic detection of illegal content.

Allowing both individuals and law enforcement agencies to report content that allegedly violates the law, and/or our terms and policies.
If Customers upload any content that violates the applicable law, this RUP, the Agreement, or any other agreements between Customers and Base44 that governs their use of any of Base44’s services, we may, as appropriate and necessary, with or without notice:

Warn the Customer;

Restrict the visibility of any infringing or violating content, including removal of or disabling access to such content;

Suspend, terminate or restrict monetary payments;
-
Suspend or terminate the provision of the Base44 services in whole or in part; and/or
-
Suspend or terminate Customer’s Account.
Base44 has the right, but not the obligation, to monitor or investigate any content and the use of the Base44 services at any time for compliance with this RUP and the other Base44 terms, and with any other agreement between Customers and Base44 governing the use of the Base44 services.
We may take these actions against content that was generated by AI tools and services, even if these tools and services were offered on the Base44 platform.
As a general rule, we will base our assessment and decision-making for content moderation on the specific content Customers have made available on our platform, including information contained in any notices we receive. However, where appropriate, we may also consider actions and statements made outside of our services in order to maintain a safe and respectful environment for all our Customers and any other third party.
Internal Complaint Handling System
If Customers find any content or behavior on our services that Customers consider to be illegal or in violation of this RUP or of any other Base44 terms, please report it to abuse@base44.com.
Base44 offers the above-mentioned reporting mechanism in order for you to flag the content hosted by us that you think violates the Agreement, this RUP, our other policies and/or local law. Our support team will review your report and take relevant action in a timely manner. By using this reporting mechanism, you consent to submit inquiries in good faith and not misuse any reporting or appeals channel by making baseless reports or appeals.
In order to process Customer requests submitted via the above mentioned mechanism, the reporters are asked to provide as detailed information as possible and clearly define the reported content by providing direct links when possible. Additionally, reporters are expected to provide statements of reason why they believe Base44 is required to act on a certain content.
Our internal complaint-handling system is provided to enable users to challenge certain moderation decisions in a fair, transparent, and timely manner. This system must not be misused.
Misuse includes, but is not limited to:

Submitting complaints that are manifestly unfounded, repetitive, or abusive;

Filing complaints in bad faith or for the purpose of harassment, intimidation, or retaliation;

Repeatedly re-submitting substantially identical complaints after a final decision has been issued;
-
Using the complaint mechanism to disrupt or overload moderation processes;
-
Providing false, misleading, or intentionally incomplete information in support of a complaint.
Where a user frequently submits manifestly unfounded complaints, we may, after prior warning and in a proportionate manner, temporarily suspend that user’s access to the internal complaint-handling system.
Any such suspension will:

Be based on objective and transparent criteria;

Be proportionate to the nature, gravity, and frequency of the misuse;

Be limited in duration;
-
Be accompanied by a statement of reasons.
Nothing in this section limits a user’s right to seek out-of-court dispute settlement or to pursue judicial remedies.
As the Base44 service is operated by Wix.com, the point of contact for DSA inquiries is as designated by Wix.com Ltd.
