TERMS OF USE
(1) DEFINITIONS

These Terms of Use govern access to and use of the BuiltWith website and services operated by BuiltWith Pty Ltd.

By accessing or using the website, APIs, datasets, or any services provided by BuiltWith Pty Ltd (“BuiltWith”, “we”, “our”, “us”), you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the website or services.

“Service” means the BuiltWith website, APIs, datasets, reports, software tools, and all related services.

“User” means any individual or entity accessing the Service.

“Customer” means a User with an active paid subscription.

“Data” means any datasets, analytics, technology detections, reports, or other information provided through the Service.

(2) INTELLECTUAL PROPERTY RIGHTS

Unless otherwise stated, BuiltWith Pty Ltd and its licensors own all intellectual property rights in the website, services, and underlying data systems.

All intellectual property rights in the Service are reserved.

No ownership rights are transferred to Users through use of the Service.

(3) LICENSE TO USE THE SERVICE

BuiltWith grants Customers a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Service solely for internal business purposes.

You may:

view pages from the website
access reports through your account
store report or API data privately for internal use

You must not:

republish material from this website
reproduce or distribute BuiltWith data publicly
store the entire database in any electronic retrieval system
use automated systems or software to extract data from the Service except through authorized APIs
attempt to replicate the BuiltWith database
resell, redistribute, sublicense, or commercially exploit BuiltWith data

Reselling access to BuiltWith data or reports on platforms such as Fiverr, Upwork, or similar services is strictly prohibited.

BuiltWith actively monitors and investigates illegal resellers. Accounts engaged in resale activity may be terminated and legal action may be pursued.

(4) UNAUTHORIZED DATA RESALE

BuiltWith data may only be accessed directly through authorized BuiltWith services and subscriptions.

Any acquisition, use, or distribution of BuiltWith data obtained from unauthorized resellers or third-party sources is prohibited.

Users who knowingly acquire or use BuiltWith data from unauthorized resellers may be subject to account termination and legal action.

BuiltWith reserves the right to pursue legal remedies against both unauthorized resellers and parties knowingly benefiting from the resale or redistribution of BuiltWith data.

BuiltWith may introduce monitoring or watermarking mechanisms within datasets to identify unauthorized redistribution.

(5) ACCOUNTS

To use certain features of the Service you must register an account.

You agree that:

- the email address provided must be valid and capable of receiving email
- accounts must not be registered using parked domains or identity obfuscation
- duplicate or fraudulent accounts are prohibited

You are responsible for maintaining the confidentiality of your login credentials and for all activity occurring under your account.

BuiltWith may suspend or terminate accounts at its sole discretion if misuse or fraud is suspected.

Accounts may not be shared between organizations or used as part of a service bureau or data resale operation.

(6) API AND AUTOMATED ACCESS

Use of BuiltWith APIs must comply with the following conditions:

- API access is restricted to licensed Customers
- automated requests must respect published rate limits
- attempts to circumvent technical limits or restrictions are prohibited
- bulk database extraction is prohibited unless explicitly licensed through BuiltWith datasets

BuiltWith reserves the right to suspend API access if usage threatens system stability or violates these Terms.

(7) DATABASE RECONSTRUCTION AND COMPETITOR USE PROHIBITION

The Service and underlying datasets represent substantial investment in the collection, processing, and analysis of internet data.

Users may not access or use the Service for the purpose of building, enhancing, or maintaining a competing product or service.

Without limitation, Users must not:

- systematically extract or store data from the Service in order to create or replicate a database similar to the BuiltWith database
- use automated systems, scripts, bots, crawlers, or scraping technologies to extract data outside authorized APIs
- aggregate or combine multiple reports or API responses to reconstruct substantial portions of the BuiltWith dataset
- use the Service to train, enhance, or populate machine learning models, artificial intelligence systems, or data products that compete with BuiltWith
- provide BuiltWith data to any third-party data provider, analytics platform, or commercial dataset provider

Use of the Service for competitive intelligence against BuiltWith or for development of a competing service is strictly prohibited.

BuiltWith reserves the right to suspend accounts and pursue legal remedies where activity indicates an attempt to replicate or commercially exploit the BuiltWith dataset.

Use of the Service for the purpose of benchmarking, evaluating, or developing a competing product or service is prohibited.

(8) ARTIFICIAL INTELLIGENCE AND MACHINE LEARNING USE

Data obtained from the Service may be used by Customers as input to internal analytics, artificial intelligence systems, machine learning models, or automated decision tools used within their own organization.

However, BuiltWith data may not be used to create, train, enhance, validate, or distribute any artificial intelligence system, dataset, or automated analytics product that replicates, competes with, or substitutes for the BuiltWith Service.

Users must not use BuiltWith data to construct technology intelligence databases, training datasets, or AI-powered services that provide functionality substantially similar to the BuiltWith Service.

(9) PAYMENT FOR SERVICES

BuiltWith is a Software-as-a-Service business intelligence platform providing electronic data services to businesses.

BuiltWith does not provide or sell data services to consumers and does not provide consumer personal data.

Payments for subscription services may be made by credit card or Electronic Funds Transfer.

(a) SUBSCRIPTION PLANS

Basic, Advanced, Pro and API services operate on a recurring subscription basis.

By subscribing, you authorize BuiltWith to charge the applicable subscription fees until the subscription is cancelled.

You may cancel your subscription at any time through your account dashboard.

(b) ENTERPRISE / TEAM SERVICES

Enterprise and Team subscriptions may operate on monthly or annual billing cycles and will automatically renew unless cancelled.

(c) REFUND POLICY

Refunds are not provided for change of mind. Chargebacks initiated without first contacting BuiltWith to resolve the issue will result in immediate account termination.

Your rights under Australian consumer law apply if services are faulty or materially different from what was promised.

(d) FAIR USE

Basic, Pro and Enterprise subscriptions provide access within reasonable fair-use limits.

Excessive automated extraction or generation of large reports designed to export significant portions of the database is prohibited.

The maximum dashboard report size is 10,000,000 results.

Larger data exports should use BuiltWith Datasets:

BuiltWith may suspend accounts that exceed reasonable usage limits.

(e) ENTERPRISE USER RESTRICTIONS

Enterprise and Team accounts are strictly limited to employees of the subscribing organization.

(10) ACCEPTABLE USE

You must not use the Service in any way that:

- causes damage to the website or infrastructure
- interferes with service availability
- is unlawful, fraudulent, or harmful
- attempts to bypass security controls
- attempts to scrape or copy the database
- access the Service for the purpose of building or supporting a competing technology intelligence or analytics service
- distributes spam or unsolicited commercial messages

Telephone numbers provided by the Service must not be used for marketing purposes.

Users located in Australia are not permitted to access email lists through the Service.

Users are solely responsible for ensuring their communications comply with applicable laws including anti-spam legislation.

BuiltWith accepts no liability for misuse of data by Users.

(11) USER CONTENT

If you upload or submit any lists, datasets, or other material through the Service, you remain the data controller and are solely responsible for ensuring that the collection, possession, and submission of such data complies with all applicable privacy and data protection laws.

BuiltWith acts only as a processor of such uploaded material for the limited purpose of delivering the requested Service. Uploaded lists are not incorporated into BuiltWith datasets, are not sold, shared, or redistributed, and are not made available to other users.

To perform analysis, BuiltWith may convert uploaded data into non-personal technical identifiers (such as domain names). Any personal data contained in uploaded lists is not retained beyond what is technically necessary to process the request.

BuiltWith may remove any content it considers inappropriate.

(12) TECHNOLOGY DETECTION DISCLAIMER

Technology tracking results are generated through automated analysis of publicly accessible website code and infrastructure.

Technology detections are based on signature evidence and may not be 100% accurate.

False positives may occur if:

- websites include unused technology code
- technology signatures remain after removal
- indexing delays occur

BuiltWith does not guarantee absolute accuracy of technology detection results.

(13) ACCURACY OF INFORMATION

The Service is provided on an “as-is” basis.

While reasonable efforts are made to ensure accuracy, BuiltWith does not warrant the completeness or accuracy of information provided through the Service.

Users accept that any decisions made based on the information provided are solely their responsibility.

(14) LIMITATION OF LIABILITY

To the maximum extent permitted by law, BuiltWith shall not be liable for any:

- indirect losses
- loss of profits
- loss of data
- loss of business opportunities
- consequential damages

arising from use of the Service.

Nothing in these Terms excludes liability for fraud, death, or personal injury caused by negligence where such liability cannot legally be excluded.

(15) INDEMNIFICATION

Users agree to indemnify, defend, and hold harmless BuiltWith Pty Ltd, its directors, employees, contractors, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including legal fees) arising from:

- use of the Service by the User
- violation of these Terms
- misuse of data obtained through the Service
- unlawful communications, marketing, or outreach conducted using BuiltWith data
- infringement of third-party rights arising from the User's activities

This obligation survives termination of the User's account and access to the Service.

(16) SERVICE AVAILABILITY

BuiltWith may modify, suspend, or discontinue parts of the Service at any time.

Access may be suspended without notice if:

- misuse is detected
- infrastructure stability is threatened
- payment obligations are not met
- legal obligations require suspension

(17) FORCE MAJEURE

BuiltWith shall not be liable for failure or delay in performance caused by events beyond its reasonable control including:

- internet outages
- cyber attacks
- infrastructure failures
- natural disasters
- war or government actions

(18) TRADEMARK

BuiltWith is a registered trademark:

Australia – Reg. Number 1544152
United States – Reg. Number 4554700
European Union – WIPO Reg. Number 1559880

Unauthorized use of the BuiltWith trademark may result in legal action.

(19) NO UNITED STATES PRESENCE

BuiltWith Pty Ltd is an Australian company operating exclusively from Australia.

BuiltWith:

- maintains no offices in the United States
- employs no staff or contractors in the United States
- operates no infrastructure located in the United States

BuiltWith does not intend to establish any physical, operational, or corporate presence within the United States at any time.

All services are operated from Australia and governed by Australian law.

(20) SURVIVAL

Sections relating to intellectual property rights, database reconstruction, artificial intelligence use, limitation of liability, indemnification, governing law, and any other provisions which by their nature should survive termination shall remain in effect after termination of access to the Service.

(21) GOVERNING LAW AND EXCLUSIVE JURISDICTION

These Terms are governed by and construed in accordance with the laws of Australia.

Any dispute, claim, or legal proceeding arising out of or relating to the Service, these Terms, or the use of BuiltWith services must be brought exclusively in the courts of New South Wales, Australia.

The parties expressly agree that the courts of New South Wales, Australia shall have exclusive jurisdiction over all such disputes.

Users irrevocably submit to the jurisdiction of the courts of New South Wales, Australia and waive any objection to the exercise of jurisdiction by those courts.

Users agree that they will not commence or participate in any legal proceeding relating to the Service in any jurisdiction outside Australia.

BuiltWith Pty Ltd does not recognize or submit to the jurisdiction of any foreign court or tribunal in relation to disputes arising from the Service.

Any attempt to bring legal action outside Australia shall be considered a breach of these Terms.

Any legal action commenced outside Australia shall be deemed invalid and unenforceable under these Terms.

(22) NOT INVESTMENT ADVICE

Information presented on the website regarding companies, technologies, or publicly traded entities is provided for informational purposes only.

Nothing on this website constitutes financial or investment advice.

(23) CHANGES TO THESE TERMS

BuiltWith may revise these Terms from time to time.

Updated versions will be published on this page.

Continued use of the Service constitutes acceptance of the updated Terms.

If a User does not agree to updated Terms they must cease use of the Service.

(26) SEVERABILITY

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, unlawful, or unenforceable, that provision shall be severed from these Terms to the minimum extent necessary. The remaining provisions shall continue in full force and effect as if the severed provision had never been included.

Where a provision is found to be partially invalid or unenforceable, it shall be modified to the minimum extent necessary to make it valid and enforceable, while preserving the original intent of the provision as closely as possible.

(27) DISPUTE RESOLUTION

Before commencing any legal proceedings, the parties agree to attempt resolution of any dispute arising from these Terms or the Service through the following process:

Step 1 — Written Notice: The party raising the dispute must provide written notice to the other party describing the nature of the dispute and the outcome sought. Notice to BuiltWith must be sent to support@builtwith.com.
Step 2 — Good Faith Negotiation: The parties shall have 30 days from receipt of written notice to attempt resolution through good faith negotiation.
Step 3 — Mediation: If negotiation fails, either party may refer the dispute to mediation administered by the Australian Disputes Centre in accordance with its mediation guidelines. The costs of mediation shall be shared equally unless otherwise agreed.
Step 4 — Litigation: If mediation does not resolve the dispute within 30 days of commencement, either party may pursue legal proceedings exclusively in the courts of New South Wales, Australia, in accordance with Section 21 of these Terms.

Nothing in this clause prevents either party from seeking urgent injunctive or equitable relief where delay would cause irreparable harm.
