Sections 1–12 apply to the website and digital products sold via Paddle. The 'Apps & Games' part below applies to our mobile and desktop apps.

1. Acceptance of Terms

By accessing this website, we assume you accept these terms and conditions in full. Do not continue to use our website if you do not accept all of the terms and conditions stated on this page. eliancodes.com

2. Purchases & Payments

Products and services on this website are sold through Paddle.com Market Ltd, which acts as our reseller and Merchant of Record. When you make a purchase, your order is fulfilled by Paddle and Paddle is the seller and merchant of record for that transaction. By purchasing, you also agree to Paddle's Buyer Terms. Prices are shown in euro (EUR) unless stated otherwise; Paddle calculates, collects and remits any applicable VAT or sales tax.

3. Digital Products & Licensing

Digital products such as website templates are licensed, not sold outright. Unless a product's own licence states otherwise, a single purchase grants you a non-exclusive licence to use the template for one end product (one website or application). You may not resell, redistribute, sublicense or republish a template or its source code as a competing template, theme or starter kit. Free and open-source templates are governed by the licence shipped with them (for example, the MIT License).

4. Delivery of Digital Goods

Digital products are delivered electronically — by download link or repository access sent to the email address used at checkout — as soon as your payment is confirmed. No physical goods are shipped. Please see our Refund Policy for cancellation and refund terms.

5. Use License

Permission is granted to temporarily download copies of the materials (information or software) on ElianCodes BV's websites for personal, non-commercial transitory viewing. This is the grant of a license, not a transfer of title, and under this license you may not:

  • modify or copy the materials;
  • use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
  • attempt to decompile or reverse engineer any software contained on ElianCodes BV's websites or products;
  • remove any copyright or other proprietary notations from the materials; or
  • transfer the materials to another person or "mirror" the materials on any other server.

6. Disclaimer

The materials on ElianCodes BV's websites or products are provided on an 'as is' basis. ElianCodes BV makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

7. Limitations

In no event shall ElianCodes BV or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on ElianCodes BV's website, even if ElianCodes BV or a ElianCodes BV authorized representative has been notified orally or in writing of the possibility of such damage.

8. Accuracy of Materials

The materials appearing on ElianCodes BV's websites or products could include technical, typographical, or photographic errors. ElianCodes BV does not warrant that any of the materials on its websites or products are accurate, complete or current. ElianCodes BV may make changes to the materials contained on its website at any time without notice.

9. Links

ElianCodes BV has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by ElianCodes BV of the site. Use of any such linked website is at the user's own risk.

10. Modifications

ElianCodes BV may revise these terms of service for its websites or products at any time without notice. By using the websites or products you are agreeing to be bound by the then current version of these terms of service.

11. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of Belgium and you irrevocably submit to the exclusive jurisdiction of the courts in that location.

Apps & Games

These terms apply to the apps and games published by ElianCodes BV (Limburgstraat 82, 9000 Ghent, Belgium, [email protected]) on Google Play, the Apple App Store and other platforms. The website and template terms above (including the restrictions on commercial use and Paddle as Merchant of Record) do not apply to our apps. By downloading or using an app, you agree to these general app terms and to the section for that specific app below.

1. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the app on devices you own or control, for personal, non-commercial entertainment. You may not copy, modify, decompile, resell or redistribute the app or its content, except where the law expressly allows it.

2. Store terms

Apps are distributed through Google Play and the Apple App Store. Your use is also subject to the terms of the store you downloaded from. If you use an app from the Apple App Store, Apple's Licensed Application End User License Agreement (EULA) also applies; Apple is not responsible for the app or its support.

3. Purchases and refunds

In-app purchases are processed by Google Play or Apple, not by ElianCodes BV. Prices, payment, taxes and refunds are handled under the policies of that store. Refund requests must be made to Google or Apple. Permanent (non-consumable) purchases can be restored through the store where available. Your statutory rights as a consumer are not affected.

4. Virtual items

Virtual currency and items (such as coins, caps or unlocks) are a licence to use content in the game. They have no monetary value, cannot be exchanged for real money or anything of value, cannot be transferred and are not refundable except where required by law or store policy. Items stored only on your device may be lost if you delete the app or lose your device.

5. Advertising

Some apps show ads provided by Google AdMob. Where an app offers a "remove ads" purchase, it removes the ads described for that app; optional rewarded ads may remain available. Ad consent choices are described in our Privacy Policy.

6. Platform services

Google Play Games and Apple Game Center are optional and provided by Google and Apple under their own terms. Player names and scores on leaderboards may be visible to other players.

7. Acceptable use

Do not cheat in ways that affect other players (such as leaderboards), exploit bugs, interfere with the app or its services, or use it unlawfully.

8. Updates and availability

We may update, change or discontinue an app or features at any time. Some features may need an internet connection or a current version.

9. No warranty

Apps are provided "as is" and "as available". To the extent permitted by law, we do not guarantee that an app is error-free or always available.

10. Liability

To the extent permitted by law, ElianCodes BV is not liable for indirect or consequential damages, or loss of data or progress. Our total liability is limited to the amount you paid for the app or in-app purchases in the 12 months before the claim. Nothing limits liability that cannot be limited under Belgian law, such as for intent or gross negligence.

11. Fiction

All characters, places and events in our games are fictional or used in a fictional, humorous way, even when they reference real locations (such as Ghent).

How each app handles data is described in our Privacy Policy.

13. Law and disputes

These terms are governed by Belgian law. Disputes fall under the competence of the courts of Ghent, without prejudice to mandatory consumer protection rules of your country of residence.

Gently Does It!

  • Free-to-play arcade game for Android and iOS. Play without an account; progress is stored on your device.
  • The game shows ads via Google AdMob. A one-time 'Remove Ads' purchase removes interstitial ads.
  • Optional Google Play Games / Apple Game Center for achievements and leaderboards.
  • The game contains dark, slapstick humour about fictional accidental "deaths". It is not directed at children under 13 and does not encourage dangerous behaviour.

Kluut!

  • Kluut! — De Vloek van de Stroppendrager has no advertising and no in-app purchases. No ElianCodes account is needed.
  • Saves are stored on your device; loss of local data cannot be restored by us. Platform cloud backups are managed by that platform.
  • Optional Google Play Games / Apple Game Center achievements.
  • Available on Android, iOS, macOS and Windows; the terms of the platform you downloaded from also apply.

Hold My Beer

  • Free game; play without an account. Saves stay on your device.
  • On Android the game shows interstitial ads and optional rewarded ads via Google AdMob. Ads are currently not available in the iOS release.
  • Optional Google Play Games (Android) and Apple Game Center (iOS).
  • Alcohol disclaimer: Hold My Beer is a fictional physics game. It does not sell alcohol, and does not encourage or reward drinking alcohol in real life. Please drink responsibly and only where legally allowed.

Den Dronkaard

  • Den Dronkaard: Café Tycoon for Android, iOS and iPadOS. Play without an account.
  • Contains optional in-app purchases: a permanent Remove Ads entitlement (remove_ads), a Starter Pack (starter_pack), and consumable crown caps packs (caps_small, caps_medium and caps_large), plus rewarded ads and occasional ad breaks via Google AdMob.
  • Crown caps and spent rewards are virtual items without monetary value, cannot be cashed out and cannot be recovered if your local save is lost. Permanent purchases can be restored via Google Play or the App Store. Starting over in-game keeps crown caps and paid entitlements.
  • Optional Google Play Games and Apple Game Center for achievements and leaderboards; no cloud saves.
  • Alcohol disclaimer: the game depicts a fictional beer café and is intended for adults aged 18 and over. It does not sell alcohol, offer gambling or allow cashing out virtual items, and does not encourage drinking alcohol in real life. Please drink responsibly.
