I've now fully read and digested the Ninth Circuit's Kalshi opinion. I agree with the ultimate outcome, but the internal logic is somewhat sloppy.
It's correct that the CEA preempts state law as applied to swaps traded on DCMs, & that the case turns on whether these are swaps.
