    I've now fully read and digested the Ninth Circuit's Kalshi opinion. I agree with the ultimate outcome, but the internal logic is somewhat sloppy. It's correct that the CEA preempts state law as applied to swaps traded on DCMs, & that the case turns on whether these are swaps.

    My $0.02 on the 9th Circuit prediction markets decision: This is the kind of opinion you get when the states know what they're arguing. The Third Circuit opinion was based on poor briefing from the state. Anyway, this is going to the Supreme Court.

    It's not hypocritical to criticize the US's campaign finance system while having to run a campaign within it. It makes sense to solicit help from super PACs while wanting to regulate them once in office.

    People still don’t get the mindset of the MAGA base: less tourism is GOOD because now there is less competing demand for US vacation spots like Disney World and Miami. If you think deporting 100 million people is good, you don’t care about impacts on growth of reduced tourism.
