Terms of Service

1. Agreement to terms

These Terms of Service ("Terms") form a binding agreement between you ("you", "user", "student") and EURL Digital Casa, operator of Stoycway ("Stoycway", "we", "us"), governing your access to and use of the Stoycway website, AI Study Assistant, KnowledgeOS dashboard, AI Exam Correction, and related services (the "Services").

By creating an account, accessing or using the Services, you accept these Terms, our Privacy Policy, Acceptable Use Policy, AI Content & Academic Integrity Disclaimer, and Billing & Refund Policy. If you do not agree, do not use the Services.

2. Eligibility & accounts

You must be at least 16 years old to create an account. If you are between 16 and 18, you confirm that you have the permission of a parent or legal guardian to use the Services.

You are responsible for the accuracy of your registration details, for keeping your password confidential, and for all activity that occurs under your account. Notify us immediately at [email protected] of any unauthorised use.

3. The Services

Stoycway provides an AI-powered study platform: upload PDFs and other documents (web articles, YouTube videos, audio recordings, images, Anki decks) for AI-assisted chat, quiz and flashcard generation, mind maps, a cross-document "KnowledgeOS" knowledge graph, spaced-repetition review, and AI-assisted exam correction.

The Services are billed on a subscription or credit basis and provided on an "as is" and "as available" basis. We may add, change, suspend or remove features at any time. We do not warrant that the Services will be uninterrupted or error-free.

4. Fees, credits & billing

Paid features are billed in credits consumed from your subscription allowance or purchased top-up balance, as described in our Billing & Refund Policy, which is part of these Terms.

We may change pricing or credit costs prospectively; continued use after a change that takes effect on renewal constitutes acceptance.

5. Your content & licence to us

You retain ownership of the documents, notes, recordings, images and other material you upload or create on Stoycway ("Your Content"). You grant Stoycway a worldwide, non-exclusive, royalty-free licence to host, store, process, reproduce and analyse Your Content (including sending relevant excerpts to third-party AI providers) solely to operate and improve the Services for you.

You represent that you own or have the necessary rights to upload Your Content (for example, course materials you are personally licensed or permitted to use for study purposes) and that it does not infringe any third-party right or breach any law. See our Acceptable Use Policy and Copyright Policy.

6. AI-generated content

Chat answers, quizzes, flashcards, mind maps, summaries and exam corrections are generated by third-party AI models and may contain errors, omissions or "hallucinations". They are study aids, not authoritative sources or official grades. See our AI Content & Academic Integrity Disclaimer, which is part of these Terms.

7. Stoycway intellectual property

The Services, including the platform software, design, KnowledgeOS graph technology, trademarks and documentation, are owned by Stoycway or its licensors and protected by intellectual-property law. We grant you a limited, revocable, non-transferable licence to use them for your personal study during your subscription.

You may not copy, resell, reverse-engineer, scrape, or create derivative platforms from the Services except as expressly permitted.

8. Acceptable use

Your use of the Services is subject to our Acceptable Use Policy, which prohibits illegal use, uploading content you do not have the right to use, abusing or attempting to circumvent AI safety or billing controls, and other harmful conduct.

9. Third-party services

The Services rely on third-party providers to function, including AI model providers (OpenAI, Anthropic, DeepSeek, Google Gemini), a vector database (Qdrant), workflow automation (n8n), cloud storage (AWS S3), and payment processors (PayPal, SATIM). Your use of the Services involves these providers processing relevant data on our behalf; we are not responsible for outages or errors originating from them.

10. Suspension & termination

You may stop using the Services and delete your account at any time. We may suspend or terminate your access, with or without notice, if you breach these Terms or the law, fail to pay, or create risk or legal exposure for us or others.

On termination your right to use the Services ends. We may delete your data after a reasonable period in line with our Privacy Policy and applicable retention law. Sections that by their nature should survive (fees owed, IP, disclaimers, liability, indemnity, governing law) survive termination.

11. Disclaimers & limitation of liability

To the maximum extent permitted by Algerian law, Stoycway is not liable for indirect, incidental, special, consequential or punitive damages, nor for lost profits, data, exam results, academic outcomes or goodwill, arising from or related to the Services.

Our total aggregate liability for any claim relating to the Services is limited to the amount you paid to Stoycway for the Services in the three (3) months preceding the event giving rise to the claim.

12. Indemnification

You agree to indemnify and hold harmless Stoycway, its officers, employees and partners from any claim, loss, liability or expense (including reasonable legal fees) arising out of Your Content, your breach of these Terms, or your violation of any law or third-party right (including copyright in uploaded material).

13. Changes to the terms

We may update these Terms from time to time. Material changes will be notified through the dashboard or by email. Continued use after changes take effect means you accept the updated Terms.

14. Governing law & disputes

These Terms are governed by the laws of the People's Democratic Republic of Algeria. The parties will first seek to resolve any dispute amicably; failing that, disputes fall under the exclusive jurisdiction of the competent Algerian courts of Algiers.
